Ok heres the thing. One of my best friends slept with this chick a while back and this girl and her friend were writeing notes back and forth about my friend and how she slept with him. When it happened they were both sober and the girl had absolutely no problem with it because she was bragging about it in the notes that were written. A couple days ago her parents found one of the notes in her room and asked her about it and she said that it happened and that she said yes when it happened. Her parents are now pressing charges against my friend for stagitory rape. Is it still when they both said yes and there were no problems. Its just that her parents fell like being dicks and i dont understand how they can do that.

In Michigan when you turn 17 your legally an adult and get sentenced as one in court. Which is how my friend got away with a DUI when he was 16.

if they are both under 18, then it is not statutory rape. but, parents can still press charges. it is stupid, but if the girl insists that she wanted to, and that nothing should happen to this boy, then he will basically get a slap on the wrist. but with the rents involved, i dont know. when it happened to me, it wasnt that lame, cause it really was statutory rape, but my rents werent involved.

yeah, when both parties are underaged and are both consenting, then neither can be charged with a crime, and it is NOT considered rape. but, as your friend is seeing, if the parents of one of the kids want to press charges, then they're totally allowed to. your friend HAS TO hire a lawyer and get the whole thing sorted out. it's gonna cost money and suck ass for both your friend and the girl, but that's the way it is.

Alright you have to look up the age of consent in your state. All states are different. If the age of consent is not working for him, then find a technicality. Just a possiblity, if the girl testified and said she was fine with it could he get off?

also look at other laws of consent such as in oregon, it is illegal for someone over 18 to have sex with a minor under 18 EXCEPT if they are within three years of age ie if the guy is 20 and she is 17 but within 3 years IT IS LEGAL, Check here and look at 163.345 most states have laws like this so if their ages are close enough, that is a defense

^Such is the case with all minors, I believe. As was stated above, although the parents should not be able to win by any means, they can bring it to court and force your friend to hire a lawyer. He should do so, and hire whoever he wants, and then sue for his defense costs. Since the pursuant has brought a case which is basically bunk (foregone conclusion if the law is that no charges can be laid if both are underage), he should win that, and her parents will have to pay all his legal fees as well as their own. Basically, in that case, all he'd sacrifice is the time he spends in court.

different states have different laws defining different types of rape...statutory... rape has nothing to do with consent...just age difference, in many states if both are under 18 than there is a two year age difference rule...but in places like florida, you can be like 26 and bang a 16 year old scott free...thats the shit

wow. you don't know your states laws reguarding rape and age of cosent? how old are you? you should really take the time to find out. And as for your friend he deserves any charges for rape if he gets them. if you are going to be sexually active you really need to take the time to learn about the subject.

but yes, if your states legal age of consent is 17 and your buddy is 17, and slept with a 15 year old he can and will be charged for rape even if the girl did agree to the act. age of consent is when the state believes people are mature enough to make the decision to partake in sex. If they are both underage he can still be sued, but he can also counter sue, in that case it would probably come down to those letters as evidence, if she said she initiated it or he did.

I checked out the laws in your state:

Even if that girls parents do charge your friend with statutory rape they won't get very far with they're charges. If she is 16 she no longer legally needs her parent's consent to engage in sexual activity. Also, her parent's charges of 'statutory rape' are misapplied on the account that this law was engaged to prevent the exploitation of a younger person to an older person with more experience and 'maturity'. Considering that they are similar ages,(which would give the court an idea of similar maturity and experience)the court really can't do anything to support her parent's charges.
