Grey area is that some of these morons who are completely unaware of their surroundings while they are so absorbed in their phones do create dangerous situations for others.
What happens when one of these cell-phone absorbed fools steps out into the street without paying much attention. The on-coming car swerves and loses control and gets into an accident. This puts an innocent person at risk over someone elses poor choices.
The law speaks volumes as to how self-absorbed our current society is and how people have become so attached to their phones.

-"In 2008, according to an Ohio State University study, more than 1,000 people — double the previous year’s number — visited emergency rooms after they were injured while walking and talking on the telephone."
-"Researchers at Stony Brook University in New York found that texters were 60 percent more likely to veer off line than those walking and not texting."
I'd like to see some more on the Ohio State study but that is a substantial increase. Curious if there are other factors that could be attributed to something other than phone distraction.
