"The two women were taken to the hospital. Darbeau suffered a fractured skull and broken arm which required surgery, according to court documents. She is in stable condition. Edwards suffered a deep cut.

McIntosh served more than a decade in prison after being convicted of shooting and killing Oshan Litchmore, 17, a classmate at Bronx's Evander Childs High School in 2000, when he was only 19 years old. The two teens were outside Macy’s at the Galleria Mall in Westchester when they got into an argument. The fatal bullet passed through Litchmore and hit an eight-year-old passerby in the leg.

McIntosh, who presently lives in the Bronx, was sentenced to 10 to 12 1/2 years in prison. He was paroled last March after serving 11 years, and has been working in the Village McDonald's since then, according to police sources.

McIntosh is due back in court Oct. 18."

Looks like self defense to me. Dish shit out you better be able to take it. Maybe they saw the videos on YouTube what happens when they run out of nuggets.
 
She started the fight. He does not know if she has a gun especially in a ghetto part of NYC. The cops cannot be onsite instantly. By the time the cops come they could have picked up his dead body.

It would have been assault if she did not throw the first punch and then they jumped the counter.

What is the guy supposed to do, get assaulted himself and risk getting shot?

 
It became assault when he continued to beat them after the threat to his person and those around him was neutralized. You can't continue to go Barry Bonds on someone who isn't attacking you. Right or wrong, that's the law.
 
Does anyone else not feel bad for the chick. When you run your mouth like that and then jump over the counter she was initiating the fight. Simple way to not get beat, is to not start shit. With that said he did take it a bit too far with those last couple of swings.
 
everyone saying it was assault is wrong. she clearly initiated the fight. jumping the counter is serious shit and people are clearly gonna defend themselves when that happens. also, even though the last couple hits look like overkill you dont know if she was still trying to fight when she was down. you just cant see it so its not fir to make a judgement.
