WME vs. Level 1 lawsuit details

flashkick is right, they have done nothing wrong. before the movie went out they made sure to dot the i's and cross the t's before they moved fwd, its all a bunch of bs
 
The most frightening part is how they claim L1P is misleading their audience. If that's what L1P is doing, then what the hell is WME doing by putting voice overs of Miller in movies that Warren Miller himself wants NOTHING to do with?
 
NS doesn't seem like the place where people get really stoked for WM movies anyway, so a boycott wouldn't change much i believe. Though what would change things is to stop riders from skiing in WM movies. Also I believe PBP sells some of their footy to WME, if they stopped that as well, I think there would be a massive negative impact on WME. This should be a call out to the industry to stand up and do what is right and cut off WME.
 
I can't believe this shit. When I first heard about it I was in shock. How can they sue L1P for someone deciding to talk in their movie? I mean, I guess it's possible due to all the stupid intellectual property laws and shit, but really? That's fucking LOW. Fuck WME.

I've got nothing but respect for THE Warren Miller. If it wasn't for his years of making ski films, who knows where skiing would be today. His respect went up 10 notches when 86 year old Warren Miller involved and recognized NS skiing in Level 1's 10th anniversary, while WME has Johnny Moseley doing the narration for WME's 60th anniversary.

Support Warren, not the group that believes they purchased his soul....
 
That pretty much nails it. Thats really what it would come down to, if some sort of agreement existed, which im doubting, because it looks like WME issue is that they feel Level 1 is misrepresenting their product as a Warren Miller themed movie.... right... because when you watch the refresh trailer all I can think of is 'oh boy gee this is a really swell Warren Miller movie'.
Its all pretty interesting, because Im sure this will make its way around the community (beyond Newschoolers) mainly because in a sense WME is indirectly attacking Warren Miller himself. I wouldnt be surprised to see a real backlash against WME
 
Like it or not WME could have easily been in the right if they had some sort of no competition agreement with Warren. That is a pretty standard practice in the business world... I loved the new Level 1 movie but it's not really a stretch to see they are claiming copyright infringement.

The silver lining is controversy sells- hopefully the added publicity sells more movies than ever.

We should go support Warrren by telling him how much we loved his involvement first, and then go to WMEG and really unleash the hounds....
 
This is true, if their was an agreement there would be a rightful suit, HOWEVER, Level 1 would not be the target, because they didn't sign anything with WME, it would be against Warren Miller.
I know you can't own someone's legal name, so there's no legal issue there, you CAN own someone's likeness, but that doesn't include their voice, it includes their fictional character - key word fictional, however he is not a fictional man, so that doesn't seem likely. So I don't see where WME can have any legal stranglehold on Warren Miller or Level 1.
 
I would figure it would, they usually only last 5 years.

And, Trademark infringement is a stretch, you can't trademark a person, unless you are that person, so unless they actually said "Warren Miller Entertainment" I'm pretty sure there's no trademark on Warren Miller.
 
Agreed on the suit against Warren unless it could be proved he had entered into some sort of agreement with Level 1 that could classify him as an employee?
 
and 5 years is a pretty long non-compete clause so i would def think its expired by now.

in the first thread on this topic I didnt understand why they werent suing warren miller himself for this reason. but now realizing that the non compete most likely expired and Warren Miller Enter. threatened to sue the theater also i can see that it is just another greedy company looking to milk as much money out of the industry as they can. so far removed from what this industry is all about.

Props to Warren Miller himself for doing the Level 1 flick and fuck the greedy corporate media company that has lost touch with the sport it makes movies about.

I hope Johnny Mosley's check bounces!
 
Does WME even have a movie coming out this year. I was thinking about going and picketing there denver premier if they did. Just make a sign that says warren miller does not support warren miller entertainment.

Realistically I don't think they make that much money on premieres. If you could get enough people together that your little demonstration made local news, that would definitely be something.

It's hard to know what NS's membership can actually DO in this situation.

Although if you people were half as gangster as you dress, WMEG and their legal team from Ireland Stapleton would be shaking in their fancy expensive boots.
 
The worst part about this lawsuit is that either way, Level 1 is gonne lose a crapload of money. A lawyer is fucking expensive and they might need more than one in order to fight WME. I think that the only thing that we can do now is to suppourt Level 1 productions by buying a crapload of Movies / Tall Tees / Hoodies. I'm not even sure that WME is really trying to win their thing, they might do it only to make Level 1 lose money.
Would you imagine how we would all feel if Level 1 had to file bankrupcy after the lawsuit ?
 
Given the seriousness of the claim they've pretty much mandated that JB lawyer up. So this is going to cost a lot no matter how it ends. And we have nowhere near the information needed (nor do any of you know what you're talking about, nor do I, given that it's the US) to even speculate on the nature of the claim. I'm assuming WM himself is going to steer way clear of this.

wow this really disturbs me, and i hope josh comes out of it un scathed. level 1 has for a while been my favorite movie company and i believe set the standard for both quality of shots and cinematic for many years, that being said warren miller films blows. those guys took a film that use to be a staple to every person, no matter wether they were a hard core or a weekend warrior and turned it into a joke. half their footage is bought and the shameless editing of warrens voice over the last few years have been both disturbing and disheartening. ill be writing a letter of complaint to them today for sure and i would encourage you to do all the same. WME has become the laughing stock of the ski movie industry and they deserve to be flamed in everyway possible for trying to defame josh like this. come on ns, lets band together and let them know how we feel.
 
Just so everyone knows who these DUESCHBAGS are over at WME. There names are Max Bervy and Kurt Miller. They are the parasites of the Ski Industry and moves like this only scream were desperate. Well then let's make sure they stay desperate and not only stop going to there movies. But all of you skiers out there who are working with WME need to stop what your doing by skiing for them.
WME is past being creative and totally redundant in the movie making process. We need to police our sport and make sure people like this go away. The only way that happens is a complete BOYCOTT.
 
I t seems to me that the best way to support Level 1 given that they are going to court regardless of what happens is going to be to buy stuff from them so that they can make money to cover the damages which there will be whether they win or lose. You can also show your encouragement n the comments box as you buy.It makes me proud to support Level 1 by buying there film every year and if this could mean them losing money that would be put nto next years film that would be a loss to us all. Sending WME hate mail wont help Level 1, nor will boycotting premiers or anything like that. Although it might make us all feel better if WME get fucked over it is more important to support the company that matters to us.
 
well L1P could counter sue for legal fees and the "irreversible damage" getting sued causes.......right

this is crazy. but all press is good press so hopefully word gets out. and I wouldnt pull a kanye anyone, because you might get sued for that.
 
This might actually be the best thing NS is actually able to do. Show your support for Level 1 by buying the movie and going to the premieres.
 
i used to love warren miller premiers, you would get a free lift ticket to some cool mountain and a bunch of coupons and a magazine, and the stoke of going to a warren miller movie in burlington in november just before the season was amazing. we would usually leave the movie and it would be snowing.....the last one i saw there was snowriders i think.
