Well theoretically it is your fault because he was your passenger, even though thats not right. Just dress decent and be polite, tell them you had no control over your brother not buckling up, maybe tell them he does it habitually or something. The bottom line is you are legally (yes its dumb) at fault, so take what you can get, at least you had your liscense, it gets ugly if stuff like that happnes with a permit.
