What am i supposed to fucking do?

tuesday night i went to the fair and got drunk. my friend was taking me home in his girlfriends car and i was throwing up before we left. well it's a 2 door car and instead of being smart and putting me in the front seat so i could puke out the window, he put me in the back, and he sat in the front. well when i said i had to puke, they pulled the fucking car over and let me out so i could puke. at that time a cop showed up and asked me what was wrong. i said i had taken too much oxycontin but when he started yelling at me i told him i had a little bit to drink. my "friend" being an even bigger dumbass, told the officer that i was drinking, and he was sober. well i got a ticket for minor in possession by consumption. i had no alcohol on me at this time. i live in the u.s. mind you so i really don't know what the fuck to do. i've gotten so many different opinions. oh and by the way, he didn't take a breathalizer. and the "friend" who took me told me i couldn't leave with anyone else. i had 3 other people at the fair or near the fair willing to come get me. so fuck him he;'s a stupid piece of shit. anyways i need to know what the fuck i am supposed to do. should i plead guilty or not guilty since i had no alcohol on me at the time. anyone who knows anything about this should help me. anything is appreciated

yeah you cant plead not guilty to pretty much anything. the very instant that you say you had been drinking (even if only a little bit) you had consumed alcohol (by definition, that was the charge given to you.

there is no way to argue it whatsoever.

plead not guilty, is it even a misdemeanor? its minor charge regardless. go to the hearing and say you were feeling sick, without proof in court or a sobriety test officially conducted they have no proof. its no big deal

 
and, yea ... i got a ticket for the same thing, pleaded guilty because I figured it would be some mundane consequence...

had to pay about $250 in charges and had to enroll in a class that met once a week for about 3 months.

"plea in obeyance" is the way to go. It's not admitting guilt but it's also not admitted you didn;t do anything. It's pretty much saying, I don't have enough evidence to fight this thing but I won't admit I was wrong. They usally result in a few conditions 1) paying fines 2) can't get in trouble for "X" amount of time 3) usually exsponged from your record. Look int oit

i was supposed to go get a lawyer today, but my mom who keeps bailing on me won't take me downtown. she took my car away so i don't evenm know how i'm gonna get to the trial. i know i can't miss it tho but i need to talk to a lawyer

its nothing major, sure the fine you may have to pay is a huge hassle, but when you're no longer a minor, your record gets scrubbed clean. i got caught for being drunk in public a bunch of times, caught for vandalizing twice, and now that i'm no longer a minor, it doenst show up on my permanent record. WOO

fuck mip's i have to go to court wednesday and pay 200 dollars. but they did breathalize me and im pissed cuz i only blew a .038 so i wasnt even that drunk but i still have to pay. one isnt so bad i know a few kids who have had 3. but you should plead not guilty there is nothing they can do, no breathilzer, just your fucking friend saying shit, and you saying you were sick.

It's almost expected out of teenagers to get one.

I got one beginning of grade 12, and didn't pay it until May of this year. Almost 2 years later.

It doesn't go on any kind of criminal record or permanent record. I think it's too petty of an offence to deal with for it.

Or, you can go to court and give the "so obvious it shouldn't need to be said" argument. It goes along the lines of "me puking doesn't mean I'm drunk. I could be sick, have heat stroke, or any other number of things". When the silly judge tells you that one of your friends said you were drunk, you can ask the judge if your friend is a Toxicologist. When the judge replies "no, I suppose he isn't", you can then tell him that you have thoroughly owned his ass and that all charges should be dismissed.

you shouldve asked for a blood test. then they have to take you to a hospital and it can be hours before they draw your blood. and after 3 hours they cant hold you any longer so you could get lucky and get to leave but thats unlikely.

I'm going back to court for an MIP. I plead not-guilty and now after much hassle and hiring a lawyer, I get to meet with the judge, and most likely he will give me a six month probation period. The probation is nothing other than the fact that I can't get in trouble in the sixth months, and then my MIP will be dropped, no drug tests or curfews or anything. I'd say its worth it, because eventually I will be at Michigan State where getting MIPs is probably not hard, and what fucks you over is when you start accumilating them.

Otherwise for my friends who plead guility, the judge said "alright your charged with M.I.P., thats $200, pay at the front desk". So shit could have been easier.

 
Your fault, hope they getcha good, next time dont get so smashed, or just walk home if you can't find anybody who not only will drive you home, but that will also lie to a police officer for a drunk underage girl. You were wasted, so your the one to blame, not the cops, not your damn friend, take responsibility for ur actions.
