Wherever you come from, imagine this scenario:

You wake up in the middle of the night to hear someone breaking into your apartment. You silently make it to the kitchen to grab a knife for a weapon - to protect yourself, of course.

The assailant, who is armed not only with a crowbar, but with pepper spray, sprays away at your eyes and you lose your vision. Being the badass you are, you start swinging your knife wildly and manage to wound the robber 14 times while in pain and disoriented from the spray.

End result:

You, whose house was invaded; you, who were defending yourself; you, who was momentarily blinded from a pepper spray attack and stood your ground...

YOU are sentenced to 1½ years in prison and you have to pay the robber, who only got five months to serve, 2000 euros for pain, emotional suffering and cosmetic damages.

We've got no Castle Doctrine here.

That's happened in a number of major countries, including Finland, the USA and Canada......shows you don't need to be a reasonable thinker to be a judge
 
A judge is responsible for interpreting the law as it was written to fit the situation. Poorly written laws can have outcomes such as this in court, but a judges integrity is what keeps the justice system from becoming completely corrupt. No it isn't perfect at all, but I would not blame the judge.

How bout this:

Man beats, kicks and rapes his then pregnant wife multiple times in 2004-2005. The district court sentenced the man to three years in prison on four assaults and four rapes.

However, the court of appeals mitigated his sentence by four months and the sum of compensation to his wife by 5000 euros. Why? Because they believed that brutal assault is actually always a part of a rape crime, so they dismissed the four assault charges. Before that the considered dismissing the rape charges as well and instead changing them to "forced sexual intercourse" charges.

Hey-ho. This place is like a rapist's dreamland sometimes.
 
it's also a pretty 'grey' area in belgium, but whatever, i'm sure if i'd ever encounter a burglar in my house at night, i'd grab whatever weapon i can find and mess that fucker up, i think it's no more than normal that you protect your property and family with all your power ....

if i'd go to jail for something like that i'd be pretty pissed but in the end i'd be happy knowing i did what i believed was right and, at the risk of sounding like a hoodlum gangster, if that differs from what the law states, then: 'fuck the police' !
 
i think that depending on the situation someone is in, their legal rights should be waived or partially waived. if you're breaking into someone's house with multiple weapons and then "attack" the homeowner before they do anything to you, your rights should be waived
 
Much of Europe currently has an excessive amount of laws that protect the rights of criminals, at the expense of law abiding citizens.

In the United States (With the exception of the Peoples Democratic Republic's of Kalifornia, Maryland, Chicago, New York (State), and Washington DC. You have the right to fuck that home invader's world up. Regardless of whether they have a weapon or not.

We have had a couple of cases like this before that reached the news.

(Had to translate it all, not responsible for the mistakes I made.)

The 55-year old wife of farmer Piet Bisseling discovered a burglar that had broken in to the barn of their farm. The Burglar, a 34- year old man was looking for tools to nick. When he spotted Bisseling’s wife, he grabbed the pitchfork from the wall and stabbed her in her leg.

Bisseling, (the 52-year old farmer himself) responded to his wife’s screams and got in to a fight with the burglar. The fight was extremely violent, during the fighting they both ended up in a pond and then Bisseling held the burglar under water until he let go.

The burglar was dead, his wife was severly bleeding and Bisselink had to be treated for life-threathing injuries including some very serious bite marks. He said he was fighting for his and his wife’s life.

When he was still in the hospital he was accused of commiting homicide.

This of course brought extreme public outrage. And this forced the attorney general to drop all charges against the farmer.

But on a more serious note, this is absolutly not acceptible. It makes no sense. The Finnish judicial system is fucked(no offense)

Ah well, if he was sentenced to go to jail it wouldn't have been for long. And he'd have access to a pc with internet, flatscreen tv, PS3, XBOX 360, fridge microwave, pool table, bar.

You know what to do.Just stab someone, or attempt to rob a bank. (Hey if you escape: you will have money: win-win situation.)

And you can live in a safe, comfortable environment were you don't have to worry about paying rent, gas or electricity and can play video games all day. Only skiing get's a bit hard but I bet there is an annual ski trip.
 
now let me first make clear that I am not saying i agree with the decision made...but we're missing some important details of the story. 14 times is a lot... what happened to get the assailant stabbed 14 times as opposed to 1, 2, 3, 4...10 times? from the little snippet ive heard it sounds like we could be missing some important aspects of the story..
 
Wound =/= stab.

Read the OP again, imagine the situation of having an assailant come into your house, see a crowbar, get peppersprayed, then try to defend yourself in a blind mix of fear, rage and pain.

14 hits or slashes in the midsection, and none of the wounds were serious. Doesn't sound like the most important aspects of the story.

Well that si kinda fucked up, but I heard of worse cases (from the US this time :D)

Someone was trying to break into a house through the garage and somehow got locked in in the garage.

Now the owners of the house were on vacation, so they only came back after a few days. They found the guy in their garage, who then sued them for not having anything to drink or eat in the garage.

As far as I heard, the owners had to pay him quite an amount of money because of that...
