Underage Tobacco?

I know if you're under the age of 18 it's against the law to have tobacco in your possesion, yadah yadah. But is it against the law to attempt to buy it yourself? Can, let's say the gas station, do anything to hold you or call you in for trying to buy it, or would they just turn you down and send you on your way?

This sounds like a great opportunity for an experiment. Why don't you go down to the nearest corner store (assuming you're under 18) and try to buy some cigs. Then report back and let us know what happened. I'll be waiting on the edge of my seat.
 
um, dont pay with credit card and when they ask you for your ID say its in your car or at home. if you give them something they could probably refuse to give it back to you and call the cops or some shit.
 
It isn't illegal to have tobacco in your possession underage, it's just illegal to sell to minors. In all reality you can get away with it, but it's fucking retarded to. Just have someone buy for you, or find indian smoke shops that don't card.
 
just so you dont get stupid responses anymore, no, they will not. first of all, its not illegal to posses tobacco. its illegal for a minor to be sold tobacco products, but not fucken illegal to posses, come on man...
and no, half the time they dont even check the date on your license, so as long as you dont look like your twelve, you should be fine. hell, ive boughten seegars with a friends ID once, who isnt even 18 fine /claim, and im 15! in the occasion that they do check, what will happen is they will reject you, and it will be embarrassing. just be semi-smart about it. dont do it if theres a cop in the store with you, and stuff like that. think about it, is it illegal to TRY and buy weed?
 
It's not illegal to posess tobacco under 18. It's illegal to sell to minors. So if a store sells to you, they did something illegal, not you.
 
Jesus, it was a question. First of all I would never smoke cigs, does nothing for me. Second, who said I was going to do this? I was just wondering.
 
I'm pretty sure you have to be 18 in the states to posses it let alone buy it. Google would be your better choice for this question though.
 
^ True, thanks. It just occured to me because people at my school always brag about getting older kids to buy them shit, when they could possibly just grow some chest hair and try to get it themselves.
 
What if like a 15 year old was smoking a cig while walking down the street and passed a cop?

Because I was always told it was legal to smoke cigs no matter how old you are?

In most parts of the U.S., you have to be 18 to buy tobacco products. Some states (and even counties, I've heard) require you to be 19 to buy. For the most part, my understanding is that you can legally possess tobacco at most ages, although I know CT recently passed a law that makes it unlawful to possess tobacco if you are under 18. So, it all really depends on where you live. OP, what state you from?
 
Seriously just walk up and ask, sometimes they will ask for an ID and you just say you dont have it, or I left it at my girfreinds or something, and they usually go sorry and you walk out. Just grab and drink or gas, or something other then tobacco and usually the younger guys will sell it. If its a manager working or thiers a crowd in line sometimes it wont barge. If you get caught for some odd reason the station or whatever will get in trouble not you. I grew out a burly beard for a while and looked about 25 so I didnt have a problem, oh and if they ask for a birthdate make sure its 18, (I usually just add a year to my b-day). I think this clears it up? Sometimes the clerk will just ask for a date if you dont have an ID. Just dont look nervous just act like your buying anything else normal. Hope this helps?

No, they can't ID you. I've smoked in front of a cop, as long as you put it down and are generally polite about it, they won't bother you.
 
For those saying it's legal to possess tobacco under the age of 18, you're wrong. I got a ticket when I was 16 for 'Possession of Tobacco'. Yeah, I was/am an idiot.

Yeah man. We were just skating and a cop comes, tells us to hold on, and calls for back up. Some cops on bikes and one on a horse come to the park and 'find' a pipe made from those orange medicine capsules. They said it was ours, without asking anyone else that was in the park. They said that if no one confessed to having it, they would search us. Well no one did, because it wasn't any of ours (we're not that sketchy to use a homemade pipe like that). So I got a 73$ ticket, went to court for about 2 minutes and got it reduced to 43$.
 
Really didn't know that either. Everything I've read online and been told in health class and through people, atleast in PA it isn't illegal to posses tobacco as a minor.
