The WORST Week Ever

It began on Sunday, September 23. Saturday had been great, our soccer team remained undefeated and we had won our game 5-0. We arrived back in our town, Whitefish, MT, home of Big Mountain ski resort, around 10:30 pm. We all got baked and drunk and had a great time.

The next day my troubles began. I awoke with a bitchin hangover and an essay to finish. Before I started, I made sure my bong was hidden and packed for a lunch session the next day, and my weed was in my backpack, along with a piece and my stem. But while I was taking a shower, my mom searched my backpack and luckily only found the weed, pipe, and stem. She just thought the stem was another piece so she didn't continue searching and find the bong. She was pissed, but I've been caught before so it wasn't that big of a deal, and my dad doesn't care cause he smokes and grows chron also. Everything was fine again, until Wednesday. I had hid my bong, which is a little over a foot tall in a drawer in my room that nobody ever rifles through, but apparently my dad had told my mom that my stem was a bong stem and she searched and found my bong. This made her a little more angry then the other things, but I was still not in a lot of trouble.

Then Friday came, it was the homecoming football game and I got drunk and high once again. At half time we returned to a kid's house to continue our party, and didn't go back because it was raining. At the end of the game, I had to go back and talk to my parents so they could make sure I wasn't fucked up. I made sure I had eye drops in, and plenty of gum. Upon my return, our school resource officer approached me and immediately asked, "How much alcohol have you had to drink tonight?" and I lied and told him I had had nothing to drink besides a coke. His responded, "That's bullshit cause I can smell it all over your breath, come with me right now and you're getting breathalized." In front of a large number of family friends the stupid bastard breathalized me and cuffed me right there on the spot. I got charged with a M.I.P. for alcohol right in front of the entire town of Whitefish.

So far I've been suspended for 3 days from school, anything I miss is zeros, I've been kicked off the soccer team for the season, and I have a court date set in October, where I'll receive some gay huge fine and have to do something like 20 hours of community service. And to add to that, my parents through out my bong and grounded me until further notice, which is like a month.

Yet, that still not the end of it, that fucking resource officer covered something up and lied because he arrested me incorrectly and didn't want to get into any trouble himself.

I'm a freshmen though, so my coach wasn't that pissed, even though he knew I was with all the seniors on the team.
 
Should I get you the razor? Stop complaining you got yourself into it. You obviously know of this resource officer that will most likely be at school events, that's he is at school for, you could have waited to drink or smoke AFTER the game or after you talked to your parents. But since thats not fun, you obviously did something to point out you were drunk, there is something missing here. Cops don't just come up to someone and say "you smell like alcohol you're drunk" unless you really reek like alcohol, period.
 
no dude, its really easy to smell it on people sometimes. also its pretty easy to tell when someones drunk, they get glassy eyes.

Almost every kid at that game was intoxicated. Cops in Whitefish hate soccer and target soccer players, cause they're football loving deuchebags and hate when we do better than our horrible football team. The only other person that I know of that got a mip that night was the goalie for the girls soccer team. The other explanation is that someone tipped him off that I had been drinking, which is fucking lame, but yeah, I somewhat got myself into it, but it wasn't like I was stumbling over and slurring my words like some drunken idiot. He also came out of his way to walk over and inspect me, and theres no way he could have smelled me from 20 feet away.
 
Yeah I have a very hard time believing that. Blaming the cop on your own dumb ass moves is the wrong thing to do.
 
You realize it's your right to refuse a breathalizer, right? They can argue that it implies that you had to be drunk, but it isn't conclusive. On top of that, doesn't an M.I.P. charge require you to... yknow... be in possession of alcohol? Thus the "I.P." parts of the thing? Look up what the actual criminal offense is and how it's worded. If it doesn't fit what happened, move no evidence. You're off the hook.

Really though you should have just flat out refused to do what the guy said. You'd still probably have been kicked off the soccer team, but whatever. If they arrest you on suspicion of being in possession of alcohol that'd be (a) retarded and (b) grounds for a claim in abuse.

With all that said, the fact is, you broke the law and you're getting it handed to you... sucks, but it happens, that's why we have law enforcement.

And JD, I'm pretty sure if you have a blood alcohol content of .02 you are technically in possession because it is in your body.
 
So am is he "in possession" if some fuckwad spills beer on him? I don't think that works. Once it's been imbibed it's no longer measurable. Usually there will be some statute that defines what "possession" means, and unless the MIP section of the criminal code or whatever the law that applies says differently, that's how it should be interpreted. But the reasonable assumption would be that intoxication and possession are different states of being with regard to the prohibited substance (same as with MJ, right?)
 
I'm pretty sure if you blow over a .02 you are in possession (learned in like health class an officer came and talked to us) or were in possession and you get a MIP, at least in the U.S. I think they just interpret someone who is underage and intoxicated as the same as a minor in possession of alcohol, because they would have to posses the alcohol in turn to become intoxicated. I'm really just speaking from experience, seeing friends and peers get MIPS. I dunno where you got the spilling beer part but you could reek of beer, but if you blow below a .02 and don't have any beer on your (empty would be a open container ticket not MIP) you won't get a MIP.
 
Spilling beer -> Alcohol is on my person, arguably in my system through the skin, so does that mean I'm in possession of it? I would say no.

Second, for chrissakes don't just trust the officer! It's the easiest thing in the world to go on a search engine, look up the criminal code, find the relevant section (possession of alcohol by a minor or something like that) and read it. It'll take you 5 minutes to find and 2 minutes to read, they're intentionally short sections for the purpose of clarity. Then you know exactly what the law says, not what Officer McDumbfuck, whose job it is to discourage you from drinking, wants to you think it says.

Thirdly, courts are not allowed, constitutionally, to assume guilt without direct evidence thereof. If they imply that you're presumed to have been in possession from ANY fact, and you have to prove otherwise, that's a reverse onus, and a violation of your right to be presumed innocent until proven guilty. So that can't be true.

1. If someone spills beer on you, you wont blow a .02 BAC.

2. True, but still it's a law if you are under the age of 21 and you blow over a .02 BAC you get a minor in possession ticket.

3. Regardless of the courts, he took a breathalyser, he's fucked. There is concrete evidence he what drunk and had alcohol in his system.

I get what you're talking about thought with the courts and laws and such, but in the case of this guy, he really has no outs.

maybe it was different cause this kid is like 14 years old.. in a small town. but an mip doesn't make sense.. i woudl think he'd get public intoxication but would have to do community service and shit cause hes under 18. maybe a drug/alc class.

Maybe you should stop your stupid bull shit that the po-po is after you and someone tipped off the cop that you were drinking. If everyone was drinking, you would have blended in. I HIGHLY doubt everyone was, or else more people would have gotten in trouble. School events are patrolled heavily. In this case you fucked up, get over it.

just that can get u out of it. believe it or not. my friend was driving drunk tottaled his car choped his ear half off in the accident and hit someone else and since the cop did the arrest wrong and filled it out wrong he got off scotch free... get a good lawyer and you will be fine im sure.

Pretty much the same thing happend to a friend of mine except he was so drunk he tried to run from the cops. They tackled him and then tried to lock him in the squad car, so he kicked the window out and tried to run again. He spent 4 nights in juvy and now is pretty much fucked because thats 2 fellonys at least.

But sorry man, that sucks real bad. You did break the law though so your bitching is just bitching...

 
my sister crashed two seperate cars this weekend, a forester on friday and then she came home and didn't want to drive that so she traded me for the WRX, then on saturday or sunday she got hit in the WRX.

i guess yours is worse in some ways. but the WRX got hit so maybe not.

well you could have been placed in a holding cell with some big guy who decided to rail your ass for an hour or so. then been deported by the CIA to Saudi Arabia and tortured until you confessed to terrorism charges so over all I would say you had a damn fine week.
 
i've never been fucked up at a sports game. and if i was, and i got caught i would think "damn, i'm a fucking dumbass. i ought to not do that again!"
