The Laci Peterson Case

Okay, i am sure some of you know about the Laci Peterson case. The pregnant woman who went missing on christmas eve. Her husband was never formally named as a suspect, but he was the only logical killer.

Now, her body just washed up on shore, as well as the body of her child. Earlier, when the bodies first washed up they said the baby was full term. Meaning it had gone through what a full labour...not neccessarily a live birth though.

Anyways, now they have charged the husband with two counts of capital murder. In the same article they are no longer calling the child a 'child' but a 'fetus'. Does anyone see where i am going with this?

This case could set off a firestorm of opinion in the states, because the courts are essentially going to have to make the final decision on whether or not a fetus is considered a human. Does anyone have any idea of what sort of reprecussiong this could have on the whole abortion movement?

Anyways...that's the topic. Discuss.

I think cases like this have already been decided. Mothers that were killed late in their pregnancy, also causing the child to die. I think for this case there is no contest that the man knew what he was doing, he knew he was killing both the mother and the child. It would be more difficult if the killer didn't know the woman was pregnant or the baby was almost at the stage where it could have been born. In this case it is a double murder. but you do bring up a very good point.

i dont know. because if they claim this 'fetus' and charge him for the murder of 2 people. then abortions would become an illegal move. or if he doesnt then it shows that abortions are accepted. because all in all the child is dead because of his actions. whether or not it had been born or not. it looks like this hearing/sentencing will change the view of baby/fetus murder/abortion for the world. because whatever is found to be just in this case will have to be the same in others. or at least will be referred to. but i dont know where is tand at the moment on the issue. murderand abortion is wrong.

but the baby went through a full term. meaning that if it was born right before it was killed it would have been able to live. which makes it an easy decision. If the baby was in the 5-6th month(late second trimester) then the decision might be a little more difficult. Abortions aren't usually done after the 3rd month (I believe) unless there are serious health risks to the mother. So a baby in the 5th or 6th month might be able to survive with the medical care of today but abortions can legally be done (athough rare) on babies that late in their term. So if the baby was a few months younger than more contraversy could follow. Fetus can mean anything from a 4 months unborn child to a baby that is overdue so by them calling it fetus instead of a child shouldn't change the fact that he'll be charged with a double murder.

I was gonna write something really good...but I forgot...so all i'm gonna say is that even if he gets the death sentance, theres already 600 people on death row, so he wouldnt get executed, but more likely would die of old age...dunno why i said that but yah. Serves him right

Laci's baby was due in febraury, making the baby 7 months old when it was originally missing in december... I believe that would definitely be an illegal abortion, premies are born that early and still live... the point is, there is a specific law in california saying the fetus is a person after something like 8 weeks, and this baby was long past that deadline, making it two counts of murder

Ok Im pretty sure about this. Abortion being legal and killing a mother and a fetus contradict each other, one of the main arguments of pro-lifers. When it comes to abortion, it is legal from Roe vs. Wade because a 'woman has right to privacy when it comes to her body.' Although this seems to most people like there shouldnt be a difference between the two, our law doesnt which is kinda weird.
