This is pretty crazy, it happend about 30 minutes away from where I live. I feel really bad for this kid. Who hasnt got a little pissed and unloaded on somekid?. I know i've gotten in a couple of fights. He only punched the kid once and it was a horrible accident that the other teen actually died. What do you all think the appropriate punishment would be for this? He is facing up to seven years and an adult record.

(WCCO) St. Paul A 17-year-old boy accused of fatally punching a Roseville Area High School student last month pleaded guilty to manslaughter Tuesday, Ramsey County court officials said.

The teenager was accused of punching 17-year-old Derrick New of St. Paul during a dispute over some property.

The fight occurred at a party in Como Park to celebrate the end of the school year.

New fell unconscious to the ground and was pronounced dead at Regions Hospital on June 10.

As his assailant is a juvenile, his identity is not being released.

The teenager entered his guilty plea as an extended jurisdiction juvenile and will receive both a juvenile sentence and a stayed adult sentence on August 3, court officials said.

If the teenager violates the juvenile sentencing, he will face an adult sentence. The adult sentence could add up to 86 months (seven years, two months) in prison.

 
A dude got mouthy with me once and took a swing at me, I dodged it and layed one into him and he dropped to the ground immediately - pure knockout punch on the button. His girlfriend screamed that I killed him.. I picked him up and brought him in out of the cold. Luckally he wasn't dead - he was just unconscious for 10 minutes.. that's what could have happened to me!

 
thats a weird kinda legal situation... at least it would be in canada. You are alwowed to have a fight in canada, but things become illegal if you say have th fight in the middle of a road, knock the guy out and then leave him there to get run over by a car. Or you fight on a beach, and you leave him there as the tide comes in. Then its straight up murder... but just from the punch in a consentual fight... where did he punch the kid? what did he break?

Im not sure exactly where he was punched, this has been on talk radio here all day. They are arguing over lethal force. I guess the kid who died went to punch him, the other teen saw it and layed him out. They are comparing it to if a guy was about to punch you and you shot him. Its a really crazy situation and ill look for some more articals when I get back from football.

 
thats accually pretty depressing.... it accually prolly sucks for the kid who punched the kid... killing someone with a punch would suck

I agree with the kids that say it isnt murder...but I do think that he should face some type of charge...but i think he should be tried as a jouvinal

well the way i see it, if someone threw a punch at you and you hit back, its more self defense than anything. its not "lethal force"... anyone can punch someone. its horrible that the kid died, no1 tries to kill someone in a highschool fist fight. its too bad that the kid died

which is classified as an accident, not wanting to kill. if he pleads guilty, he'll probebly just go to juvinial camp for a year or two, depending on how undrstanding the parents of the slain kid are. If the kid has a record of being a bully then he could be in more trouble than above

Well yea obviously, but I think they were going after the fact that he actually KILLED him. It was a total accident but the reason the radios are saying this is because to kill someone while your just getting punched at is excessive force. Obviously its a bad analogy, but he did kill the kid, so it was excessive even if it was an accident. I think that was their point.

 
That has got to be one fucker of a punch. I mean your right we do get pissed at people and get in fights, but this is different. he clearly did something special, like maybe he knocked the kid down and while his head was resting on the cement ground slammed his head into it with his fist or something.

If it was an accident, 7 years is pretty brutal, but I don't know how anyone would know if it was an accident. (in the sense that maybe the prupatrator didnt mean to punch him so hard or whatever)

Either way, maybe some counceling would be good.

I dont even think jail time is the worst part of the deal. He will have this on his record his whole life. His jail time is only going to be for so long, but once he gets out he is going to have a terrible time finding a job and other things when on his record it says he killed someone. That sucks.

 
he is a minor. I posronally dont think he should have it on his record. didn't they change that? I thought that it used to be that if you were a minor that you commited a felony, that your record gets erasted when you turn 18.

Earlier today in court, the judge asked my friend if he had any previous convictions (aside from the MIP he just got and was being arrainged for) and he said no. Then the judge said actually, he had another MIP on him, when he was 16... so he ended up being charged with two. Which was just $300 instead of $200. His exact words were "NOPE, nothing ever gets erased from your record, regardless if your a juvenille".

 
but also obviously his intension was not to kill him. he didnt even ponder the idea that hitting a kid once would even kill him, whereas sumthing like a hammer or a gun or sumthing would. i guess he should get some time, but not 7 years. i hear about people shooting sum1 in self defense and getting away with it. so this kid shouldnt get the shaft, but meh, my idea is to just not punch the person in the first place. being defensive without actually hurting is a better way. because not only are u the better man, but u also can show off ur crazy king fu defense skills. and what chick doesn't love that?

It's straight up manslaughter. No questions about that.

He didn't have intent to kill, but the person did die. That's manslaughter.

Yeah it's manslaughter. It's like drunk driving and you kill someone. Sure you didn't mean to, but it happened.

The outcome weighs much much more than the intent.

Also he only faces UP TO 7 years. It could be less. Maybe just parole or house arrest and that kind of thing.

In martial arts, you learn that some of the biggest men out there can be killed in a single swift attack. There are some weak points on the human body, If you hit it right, you could kill anyone.

This kid could've accidentally hit him at one of those areas, or as said, the guy who was punched could've hit his head hard when he fell on the ground.

 
its a stayed sentence, i think if he behaves in juvi it can be avoided

however, if he starts talking to the black kids and stuff hes goin to jail for 7 years

Whether it's stupid or not, and much of a freak accident it was is nuts, but the situation is, Somebody Died, and there has to be some kind of justice/justification for it.

a few years ago around my area, 2 friends were hunting. they both saw a deer and one guy was down below and in front of the other. as the top guy went ot shoot the other friend peeked up to get ready to shoot and the guy shot him in the head. obviously, he died, but i dont think he had any chages against him. maybe he did, i dont know, but i dont think he went to jail
