So Ebay/Paypal froze my account and took 200 dollars from my account

Basically, the story goes like this

I purchased a pair of Armada AR5's off of my buddy who won them in a comp. They were both the same graphic, meaning that they were both the right ski. I thought, big deal, I switch my skis up all the time. So, i put them up on ebay so i could turn a profit on them. I took about 8 pictures of them, and included pictures of both skis face up, to clearly state that they were the same ski. I never said that they were a right and left ski, but i didn't say that they were both the same ski. I regret not doing that, but hey, i can't change it now. So anyways, i sell the skis, to some guy. I ship out the skis, he gets the skis, and he emails me to tell me how happy he is with the skis. He leaves a positive feedback that says "Wonderful A+ A+ A+". So, pretty much, he was very happy with the product. Now, my return policy says that you have 5 days within the package arrival to return it to me no questions asked. I usually find thats fair, and in the past, i have had people return items and i have refunded them no problem.

Now, flash foward EIGHT MONTHS. That's around 240 days. That's a little more than 7 days right? Well, i get an email from the kid, and he says "Hey, i just drilled the skis for bindings and they are the same ski. I want a full refund" WHATTTTT? Are you kidding me man? So, i attempt to resolve the situation, and we exchange messages without comming to a solution. So, finally, in a last ditch effort, i offer the kid a refund of 30 percent of what he paid for them. I based this on the ammount of time that has gone by, and on the fact that he drilled them for bindings.

So, two weeks go by. No response. Today, i wake up to a delightful email from paypal. They report to me that they took 200 dollars (the purchase price) out of my bank account. They also report that they have froze my account. They inform me that this matter can take up to 75 days to resolve, unless this guy cancels the charges. So I wrote my response to paypal, and now im waiting.

I know that this is sort of a rant, and might have a few grammatical errors and what not in it, but im interested in hearing your opinion, your advice, and any sort of comments you guys have on this situation. I have been a seller on ebay for 2 years, and have over 100 positive transactions, and a perfect score on the detailed seller ratings. I have never had this happened, and it's tough when a 19 year old kid who is trying to start a ebay business to make some money and this shit happens becasue of some guy who didn't use his common sense.

So please guys, leave some feedback for me, insight, information, suggestions.

SPARKNOTES: I sold a pair of skis on ebay. They were clearly shown in the photos to be two right skis. The winning bidder buys them, recieves them and reports how happy he is with the purchase and leaves positive feedback. 8 months later, he drills the skis, rendering them almost unsellable now. He tells me that he wants a full refund and for me to pay to ship it to me. I don't agree to the terms, so he files Fraud charges through paypal and through Visa. Now, my bank account is charged 200 dollars, and my paypal is frozen. For full story, please read the above paragraphs.

kinda dick that u sold 2 of the same ski- but they shouldn't be able to take ur cash- time to lawyer up if they wont give it back
 
that but shit like that happens. you should be able to get your money back i reckon, it's the buyer's fault that he didn't read/look at the pictures properly and see that he was buying two of the same skis.

however, that is what is dodgy about using paypal, people can use bullshit excuses/scams. most of my ebay transactions i do via bank deposit.
 
woah woah woah. I thought that you could only file a claims till 30 days after the person sends money. They shouldnt have 8 months to file a claim. When I receive something I purchased online. I do a quick look at it. Make sure its good then leave feedback. When a person leaves a comment saying A+ on yours, then complains later, thats kind of against the rules, because it gives you the impression that you've done your job and that your good to spend the money. good luck, its happened to me but it was resolved quickly with a 10 percent refund.
 
If it was obvious in your auction that you were selling two of the same ski, then you're in the clear and he has no grounds for doing what he is doing.

woahhhh woah i didnt read it carefully enough. same graphic makes it clear that its the same ski. you should have mentioned it but its still obvious to see

I hope you never use paypal again. They only care about the company and not the customers. I lost $1200 when someone decided it would be a good idea to scam me. Long story short, NEVER USE PAYPAL AGAIN.

As for the 30 day claim thing, I thought was the case too, but he filed the charges through the Visa company so, i'm screwed on that.

As for Paypalsucks.com - I have read that article a couple times, and it's funny shit. But it's the type of thing that you arn't concerned with until it happens to you. Well, it happened to me, and now im going to try to stay away from paypal.

If you can call visa and ask for someone you could talk to about this. Visa has helped me a few times and even called me one night at 10 asking if I wanted to approve a purchase online because it was suspicious. Visa is a company that aims to please. Paypal is not. And you're right. I thought nothing would happen. Now I wish I had closed my account as soon as I saw paypalsucks years ago.

Well, I filed my claim...here it is....

The item in question is a

pair of skis that was purchased over 6 and half months ago. Details of

transaction are difficult to recall due to amount of time between purchase and

dispute, but I did review previous order details and emails.

The merchandise in question

was described accurately. The Brand, the Size, and the fact that they were

brand new were accurately included in description. Photos were included-4-5

photos- that showed BOTH skis front and back, and the fact that they had the

same ski graphic on both. The photos were high quality and showed clearly the

print on bottom of both skis which were identical. There is a clear return

policy on Ebay which states the item must be returned within 5 business days if

there are any inaccuracies in product description.

I won these skis in a competition

and received exactly as how they were displayed, photographed and sold.

After purchase, the seller

drilled holes in the skis and then decided that the skis were the same and

therefore not what he was interested in, and again, this was 6 months after the

purchase, not to mention causing permanent holes in the skis rendering them

useless and "damaged"

The fact that this buyer has

waited for 6 months to dispute this item is an obvious sign of a bogus dispute.

I cannot speak for the buyer, but it appears that he decided he no longer

wanted the skis and did not have legitimate or eligible reason for return and

therefore has tried a dispute and see if that would lead to a refund

I pride myself on customer

satisfaction and a look at my feedback would certainly show that. I have a

4-Star rating on all DSR categories.

This dispute claim has unfairly affected my Papal and Ebay

account and has affected my access to my money.

I feel that the fact that Ebay and Paypal have immediately

"sided" with this bogus claim and therefore limiting access to my

money is unfair and very poor customer service for the seller of ebay. This

dispute practice seems to give "free reign" to the buyers and no

safety net for the sellers.

I am extremely disappointed in this whole process in which

Ebay partakes in regarding a dispute!

Again, due to the length of time between purchase and

dispute, this whole issue should not even being addressed right now.

I am strongly urging Ebay and Paypal to restore my acct

immediately to previous status and balance and end this tremendous

inconvenience I have incurred from a bogus claim.

I am sure the Ebay will take care of this quickly so I can

continue to sell many other items on Ebay that are ready to be listed.

Any other thoughts?

 
99% guarantee they don't do anything and you will lose your $200. Believe me. I spent months emailing them and calling them (after waiting FOREVER on hold and it's almost impossible to get their number) and they haven't even tried to help me. I get the same response over and over.

Things should def get worked out cus of the way you've handled yourself

you can throw in that in addition to yours that you received and email from the buyer saying the item was perfect. and that paypal has a policy that states the buyer has 45 days to file a claim from date of purchase.

You can say that it is obvious the buyer was beyond these limits which is why they had to file a claim with their credit card company. These policies are in place to not only protect the buyer by giving them ample time to inspect purchases items and file claims, but to protect the seller from bogus claims after extensive periods of time.

To qualify for PayPal Buyer Protection:

  • Use PayPal to purchase an eligible item on eBay.
  • Pay for the full amount of the item with one payment. Items purchased with multiple payments are not eligible.
  • Send the payment to the seller through the Pay Now button or the eBay invoice.
  • Open a dispute within 45 days of the date you sent the payment, and

    escalate the dispute into a claim within 20 days of the date you opened

    the dispute.
  • Keep your PayPal account in good standing

 
i also ment to add good luck dude i hope you get your money back. i am on the other end of the shit stick. i bought a book from half.com and never got it. i filed a claim and have not heard anything. the guy never returned any of my emails ever. so im out $100 and ebay doesn't seem to be helping me. so they dont just screw over the sellers...they screw over the buyers too.
 
remind paypal that they don't need another class action lawsuit on their hands like they did several years ago. Tell them THE FACTS, cuz facts don't lie, especially if you can prove that you were selling two of the same ski, go to your feedback on ebay and do a "prnt scr" shot of it, to save his feedback and if you still have access to your auction of the skis, then do screen prints of that as well, save a copy for yourself and then e-mail copies to paypal and ebay and remind them that thousands of people on this site use paypal and want to have continued trust in that THEY WILL DO THE RIGHT THING when handling our money, and yours as well.
 
Update for anyone who kinda cared:

Visa agreed with the buyer, so they awarded them the money, and of course, the buyer has yet to respond to an email from myself about giving me my skis back. Awesome. All the money, and they will continue to use the product that isn't good enough for them.

Paypal is a BITCH once they limit your account. It took me like a year to unlimit it and shit. They ask for so fucking much in terms of details and verification. I imagine NS has run into similar issues.
