Snow guns and Chair lifts dont mix

Big ups for everyone who helped out at Dagmar and got everyone down from the lift on Sunday. Hope all is well and the lift is fired back up soon time.

Once again thanks to all you rope holders. Glad to be back on the ground.
 
Snowgun under the big daddy lift gets caught in the chairlift. Flips one chair(hope tommy is ok if you know him - apparently his arm got jammed between the chair and shattered the bone in his arm). Cable falls off guide. Dagmar gets shutdown.

thats sucks he broke his arm hope he is doin alright but at least u can still ski with a broken arm

What ended up happening???? is he gona sue them or anything??????? He should atleat be able to ride dagmar for free............. for life!!!

He's a snowboarder about 11 or 12 years old and im sure he has a pass. Since he has a pass im certain he cant sue since you have to sign a waiver to get your pass.
 
it is clearly dagmars fault. They were responsible for placing the snow gun to close to the chair, they shouldnt of had it that close. When i was there on saturday i saw the gun, and i thought it was to close.

they can still most likley get sued
 
shit eh i was wondering what the cops were there for, i was at lakeridge and i drove past on the way home to see what was set up.. thats really stupid tho, i hope they give the kid something yknow passes for the next few years or something, what are his parents saying about it?

I remember seing that gun on saturday , it was defiantly close to the chair

Now on the case for a possible civil suit, there are defiantly grounds to sue.

The only thing that the waiver and the lift ticket (on the back) protect dagmar from is from negligence on the part of the skiier.

Under the Occupier's Liability act, the occupier must protect everyone from foreseeable risk and this was an obvious negligent on dagmar's part to have a snow gun this close to the chair lift.

However, Dagmar will not have to worry about how much his family could sue for because they will just deflect liability to their insurance company and they will cover cost if they are found negligent.

 
Although I wasnt In Tomi's place Hope the kid is okay and heals up fast as he's always there rippin. I was on the chair in front of em riding with some random lil kid. I had my music on and heard a faint banging sound. Similar to that of the safety bar closing when a gust of wind blows. The lil dude beside me said something along the lines of " hey look at that" and I really wasn't paying attention to what he said and just said "yea man sometimes that happens no biggie". And then the Lift started to bounce So I thought to myself "some idiots must be bouncing the chair". And that's about the time I turned around and just about shit my pants seeing Tomi and the other dude getting tossed around on the chair like that bouncing and crap till it stopped. And then realizing the line was off the wheels was a lil freaky at first.

All I can Say is that shit happens And they managed to get everyone off the lift pretty fast. And hopefully Tomi heals up quick.

One thing I did notice though, that the most of the people that helped anchor the rope apart from staff and firefighters were skiers. So big ups to you skiers who helped (Im a snowboarder and just lurk here sometimes to see whats going down in the Park Yea I know sad but true)

And as for the snowguns being close to the llift. As stated the snowgun at post 2 was real high. And I saw The park staff along with another person from Dagmar fold it down on Sunday. It was the snowgun at lift 3 which got caught in the chair when the gust of wind came along. Just bad luck and im sure all the resorts will take caution when setting up their snowguns.

So lets hope the lift is okay the temps drop and it starts snowing and the guns blowing
 
I like how steve thinks he's a lawyer after a year of ski resort management.

It was a brutal accident, and I hope to never see something like that again.

Big Daddy will be good to go for the weekend for sure, if not sooner.

ive known him since i was like 10...went to school with his older brother...i hope he is alright..

and i bet he could get some $$$ for that. he is a lil kid all he has to do is cry and shit dawg. judge judy cant say no to a cute lil kid like tommy...

he wouldn't have suffered any loss?

1) Falling from a chairlift probably 30 feet or higher and then hitting the cold ground, lying there as your leg is broken and probably shattered...is a traumatic experience for a 12 year old. I would say that's a loss.

2) I'm sure 99.9% of newschoolers would say missing a full ski season when you are 12 years old is a loss.
 
i dont give a shit how much he can or cant sue for. just have a fuckin heart for the kid. he fell of a chairlift and broke his leg. say " oh shit that sucks man" .......dont say ......."oh it sucks he cant sue them for any money because of clause 36 on page 42 of article 7 in the district of ontario 3 sector 19 word 12 like 17"
 
At what point did "falling off the lift" and "a broken leg" come in?

He was taken down on the scoop and I thought it looked like he was grabbing his arm not leg.
 
It was his Arm only, you guys are like gossip queens. and Obvioulsy he Can sue, anyone can sue anyone, its just whether or not he'll win... but anyway, that is what insurance is for, it is pointless to speculate on what may happen.

Big Daddy should be open for Thursday night. yee haw
