OK I opened up today's paper and read that this skier is suing the lift company over her injury, there wasn't much detail but this is what the article said:

'A woman who collided with a snowboarder while getting off a chair lift at a Victorian ski field yesterday accused the lift operators of negligence. Kerry Chisholm said she had not fully recovered from the knee surgery sustained after the incident, and is now suing Falls Creek Ski Lifts Pty for damages in the NSW District Court. She told court she was with three other skiers on a four-man chair lift when the incident happened at Falls Creek ski fields on August 21, 2001.'

I remember there was something not long ago about a child in a terrain park suing, now people who can't ride chairlifts properly are suing!

this old rusty water dripped off the lift on my jacket and messed it up and I went and complained and told them they needed to clean it because it was their stupid lifts. and they were leave it with us for 3 days and we'll clean it and I was like fuck that.

i heard also about some guy from denver suing a guy for running into him when he had just cut out infront of him. the guy did all he could to avoid the denver man, but the denver guy ended up witha broken leg and sewed.

she'll win. it's the lift operator's responsibility to stop the lift if the unloading area is unsafe. fucking up a knee doesn't exactly take much, we're talkin 8lbs of pressure on the inside and something like 9-10lbs of pressure on the outside. as far as the waiver on lift tickets are concerned, YOU GOTTA BE FUCKING KIDDING ME!!! those never stand up in court and are not legally binding. think about it, a 17 year old goes out skiing with his buds for the day and gets hurt; how is that waiver legally binding seeing as though you need to be at least 18 years of age in order to enter into a legally binding contract. waivers will be thrown out in court unless there's a signature on there and even then, it gets sketchy!

there's 2 cents from someone who took 1st year law last year.

Pipe Munky is right, those waivers don't mean shit, you can never waive your civil rights for anything, same goes for the waiver you sign when you pick up your skis from a shop. I worked for a shop that got sued because the womans( a lawyer) bindings 'did not release properly' she ended up fully recovered and back on skis, but the greedy bitch took everything the shop owner had and he had to shut down. that sucks.

people who do shit anbd hurt themselves should keep their ass on the couch where it belongs...thats what sucks aboutthese waivers...they never hold up in court and people always find a way to finance their stupidity. how did the shop get shut down? if your a certified shop tech by any ski company your fully backed by them in court. I know of a similar case where a guys son had broken his leg cause of what he thought was an inpropper din, but when he tried to sue, salomon brought in there top of the line lawers to back the shop, needless to say the whole case was dropped after the guy saw salomon bigwigs in suits not ready to fold.

I'm a little sketch on the details, but he had to liquidate to pay her off or recover his loss. She was a real shitty person, just looking for money. I see her at the local hill having a grand ol' time, meanwhile this guy's flippin burgers and another job to pay his daughters way through Middlebury. He wasn't shut down, he chose to close because of the BS involved with this woman, I guess he just got thoroughly discouraged with it all.

yea, that sucks big time, i guess thats why it a little nicer to work for a ski shop thats got backings ( i work at a stratton owned ski shop, which stratton is owned buy intrawest which is a fucking huge company) i guess thats what you call job security.

i work in a shop in MA and i can tell ya that if they can prove that you did not release test a binding,, (and well it doesnt get done all the time) you could be liable,, or if there was some obvious mistake, it really does suck that people are so sue happy in a sport where sometimes you just get hurt

I am a lift operator, and I have seen so much of that. Not to the point where it gets in the paper but a lot of complaints. I swear, if I had a camcorder set up at the top of the lift and submitted it to Americans Funniest Home Videos, I would likely win. There are times when I kill myself laughing at how 'yeti-ish' people can be. Some people dont even know when to get off, they stay on and think that they will go back down. Other times people put their feet down to early, stopping the chair's movement until the chair gets enough force to throw them - clearing the unloading ramp. Like I said, it can be hillarious at times but very pathetic.
