Ski Resort Sued for Lifty Error

An Australian resort is being sued because a lady copped a chairlift arm rest to the pubic bone.

"Australia’s Perisher Valley ski resort has been ordered by a judge to pay nearly AUD $1.2 million (approximately $1.13 million US) to a Sydney area woman who was injured in a ski lift incident on July 18, 2003.

Ghita Nair-Smith, 54, was attempting to load a chairlift at Perisher but when the chair came around the safety bar was down. Both parities agree that a lift attendant swung the bar upward before Nair-Smith loaded the lift but they do not agree on what happened next.

“The ski resort contends that the lift operator raised the safety bar in time for Nair-Smith to safely occupy her seat, but that she moved out of the proper loading position when she overreacted to the situation. Nair-Smith contends that the raising of the safety bar caused the chair to begin to swing from side to side. In either event, both sides agree that the handrail on the side of the chair struck Nair-Smith between the buttocks, resulting in an injury to her groin area.

In July, Justice Robert Beech-Jones found the ski resort negligent and ordered both parties to come to terms regarding damages. Last week, after they were unable to come to a mutually agreeable figure, he awarded Nair-Smith AUD $1,192,597.50 plus interest.

The court found that the collision has prevented Nair-Smith from fully carrying out the functions of her occupation as a general practitioner. It also agreed with her contentions that the injury has resulted in a psychologic pain disorder, has interfered with sexual relations, and that she would need a house cleaner and domestic assistant for herself and her family, as well as a kitchen remodeling to accommodate her injury.” firsttracksonline.com
 
But what was the actual injury that was worth over a million dollars? Cooter bruising? Butt fracture? These are the questions we need answers too
 
I can't stand those types of people... especially the idiots in court who think that she's right suing after her not being able to sit on a chairlift.
 
Was on the Mt P triple chair, it's a shitty lift but punters get smashed on it a bit. Not enough respect for the force lifts use.
 
highly doubt this was a lifty error, rather the skiers. probably a very incompetent user.

as it doesnt list any specific injuries like articles of this nature usually do, and instead saying "injuries to her groin area" i highly doubt it was anything serious at all. shes from a wealthy part of sydney and at the end of the day probably had a good lawyer.

it is ridiculous that she needs a new kitchen etc. i hate people like that. its some judge judy shit. turning aus into america.

i feel as if perishers statement was correct. and she overreacted and moved, ive seen a lot of people down there completely useless and just scared and have no idea what to do.

im still confused how that could cause any serious injury at all. ive been pushed out of the way several times by idiots and gotten hit by the arm rest and just dont understand how a million dollar injury could ensue.

usually every lift tickets includes some sort of liability waiver. and if the lifty got the bar up and she wasnt actually hit by the bar i dont understand at all how it is negligent behaviour on behalf of perisher which is usually one of the only things that would override the waivers.
 
She won the case because the lifty was deemed to be to Far away from the E stop.... not that it would have stopped in time anyway.

That chair does hurt, though agreed, not 1 mil worth. Women...
 
Are those physical restrictions permanent? Why the hell would she need her kitchen remodeled if she is just going to be fine in a few months...

If she was paralyzed or something I would understand where she is coming from. But that's fucking pathetic if it was a minor, temporary injury. I wish the lift would have smashed her in the head to rid the planet of people like that.
 
People are fucking stupid.

They should get 1.2 million in pennies and place it at the top of the mountain. In order to claim it she must ride the chairlift up and take it down one bucket at a time.

Perisher should sue her for being a bitch. It makes as much sense as her stupid lawsuit. I really hate incompetent people like this
 
hahaha wow. I doubt that liftys would be able to pull the chair over the 1-2 feet nececary to hit her in the groin... the judge should have gone out and watched how the skilift actuallly worked.
 
... The mountain isn't called perisher valley. The resort is because it's located in the valley. The resort is spread out over multiple peaks.

damn this makes my blood boil.several years ago in Collingwood, Ontario my parents were on a chair that actually dislodged and fell 20+ feet from the ground. they were injured for worse than this woman, but certainly weren't awarded even close to that amount after the settlement.

mistakes happen all the time on lifts, just take responsibility for yourself instead of playing the blame game

If the judge did not see how the lift operated in person, then Perisher should have the right to appeal, unless if you can't appeal a ruling in Australia.
 
I know what perish means, still not understanding why people are asking if that's the real name. The lady didn't die. It's not like perish is a gruesome word. It's not like it;s called Homicide Valley or something.
 
Sounds like her valley certainly perished in that accident.

She expensed her kitchen remodel... Judge, I had to buy a Lamborghini because I can only enter cars that have scissor doors!
 
Does this woman have a US Passport? Sounds like something that would happen here.
