Samsung looses the court. must pay 1billion to Apple?

what do u think? me personallly, i think this is pretty stupid. apple has already copied some other products from different companies, even steve jobbs has said this has been done. apple complaining about the pinch zooming? yeah i kind of understand this, but then again.. if little copying is not right, where would we be if we wouldnt of copied some einsteins theorys for example. its normal someone makes a new thing, someone copies it and makes it even better, then someone does it again and it just keeps evolving.

Second we have the apples round phone corners. there are numerous phones who has this, apple thinks no1 can use because they had this "first".

instead of competiting in markets with theyr phones/specs, apple always goes for the court. if they keep going like this they'll end up being in corner rotting.

This is just my thoughs, so what do you think?
 
See icon to the left. How is technology supposed to evolve into something better if a company is able to sue over a hand movement and a shape? It's not like they stole the circuitry plans and cloned the device or anything. Patents will continue to kill progress. It's shit like this that has me further supporting open source software and the like.
 
Exactly. Its just the way it works, disregarding the frenzy that people will erupt into over Apple vs other consumer electronic products.
 
Before the iPhone was released, Motorola Razors were the most impressive phones on the market. As far as I'm concerned, Apple invented 95% of the smartphone as we know it and deserves to collect on the patents they legally paid for and acquired. If patents were meant to be disregarded, they wouldn't exist.

However, I could definitely be talked into discussing the limit of a patent, as I'm not well educated on the subject. I mean, Ford invented the car but are they able to collect on anyone who designs a car with 4 wheels since they came up with that first? What kind of limitations are there?
 
Ford did not invent the automobile for starters. And if he did, and filed a proper patent, then he could technically collect royalties until the patent expired, which would have been around 1912. In this case apple filed a proper patent and Samsung was found to have shown blatant disregard of it, and continued to manufacture their product, so now the legal system throws the book at them.

Apple's patent will last 14 years after the date of its filing, and the touch screen design will be free game to anyone

 
Honestly it has nothing to do with this. It is that (to my knowledge) Apple came up with the design, filed a proper patent which was approved, and Samsung pretty much told them to shove it up their ass, and Apple was like fuck you, and the Judge said yep you fucked up pay money bitch.
 
Sorry for the triple post, but for the record, I am a PC user and really just don't understand apple products, but to fly in the face of patent law is just really stupid on Samsung's part.
 
I Have been following this quite a bit samsung disregarded apples patents apple disregarded samsungs patents. it has been an on going battle. seeing as they just got another $1.5 billion from samsung I have just decided I am never going to buy another apple product. They dont even make that great of a product. its more of a status symbol than a good product. they are so far behind on the technological scale its ridiculous. take the iPhone 4s for example the newest feature about it was just software. they pretty much just re-released an outdated phone. now look at samsung galaxy s III fucking quadcore processor beast of a phone all around. 4.8" screen. apple got them to take their service off of the phone cause it was too much like siri. All that apple really has on any company is that they get more butt hurt than any other company. I say open source is the way to go.
 
I think you are missing the point of a patent. They exist so inventor/companies have a monetary incentive to innovate and invent. Without patents, no companies/inventors would put money and effort into inventing and improving products, because anyone else could just steal the idea and make all of the money.Patents spark progress rather that kill it. That being said, samsung's phones are far superior to apple's.
 
I'm not missing the point. What I intended was that patents are far too broad. Take this lawsuit for example. Pinch to zoom and a rectangle with rounded corners (among other things). Why on Earth should an individual or corporation be able to stake a claim on things so trivial? Does that mean I can now start selling S-shaped pancakes and nobody else is allowed to? As others have stated in the thread, Apple is behind the curve and is selling outdated hardware. Now if Samsung didn't infringe on the patent as is said, we wouldn't have the same progress in phone technology that we do now. It's a very fine line between protecting the rights of the inventor and allowing competition to push the envelope of design/technology. As I said before, open source is the way to go.
 
Complete bullshit, the modern patents ruin the information age, Apple patents everything, even shit they didn't create.

Also, the billion will never go through Samsung will appeal because Apples case is complete horse jizz.

The reason these finger interface motions are patented is because Apple most likely spent a long time figuring out what are the most natural motions corresponding with zooming, etc.

Samsung wanted a product that would compete with apples, and a key component of that product would be one that is easy to use. Too bad apple already figured out how to handle such actions, so they just had to infringe on their copyright.

Why is there even a patent on something intuitive as pinching. I think it's ridiculous Apple can even patent something like that. It's not that they're inventing something. Sure, they can patent the technology, but that doesn't mean Samsung can make their own system based on that. Fucking ridiculous.
 
While I certainly understand where you're coming from regarding the development of the gestures as they pertain to ease of use, I still hold my belief that the premise of this lawsuit is ludicrous (and that enforcing this particular set of patents early on would have inhibited progress). I also realize that it is unlikely that we will come to an agreement about the issue at hand. However, I appreciate that you were able to disagree while not being an unintelligent fuckwad; you provided thoughtful responses. While Apple legally has a right to challenge this, they are clearly upset about Android devices outselling them worldwide (despite their massive stockpile of cash). As far as your views on open source software, yes there are some horrible things about it, but it is still developing. And while there are lots of shitty programs, there are some very good ones too. I agree with you about operating systems, which is why I run both Windows and Linux for different reasons.

SpeakIng of patents and infringement, this is a big 'what if' I read in an interview with Mike Douglas. "What if you and Salomon patented the twin tip ski?" his answer was something along the lines of I don't think about it, wouldn't have wanted to do it. If they had, the ski industry may never have overused the word 'progression' as we know it. FOOD FO THOUGHT!
 
Usually technology is evolved by progressive and smart companies, not by companies that simply copy what others already come out with. So how is what you said relevant to this case in any way? Samsung didn't come out with something that was going to progress technology... that's Apple's job.

Patents might occasionally slow things down, but things are still changing and improving as fast if not faster than they ever have.

apple may have been the company that pushed smart phones to where they are today at the very beginning.

but they have fallen behind in the technical aspects of it all. samsung makes a killer phone with better specs, sick screen, lightweight, etc. they make awesome, and affordably customizeable laptops. not to mention they make amazing LED TV's as well.

This dirty but genius geek troll play is a new headache to Appleexecutives as they will need to put in long hours counting all that money, to check if it is all there and to try to deposit it crossing fingers to hope a bank will accept all the coins.

Lee Kun-hee, Chairman of Samsung Electronics, told the media that his company is not going to be intimidated by a group of “geeks with style” and that if they want to play dirty, they also know how to do it.

You can use your coins to buy refreshments at the little machine for life or melt the coins to make computers, that’s not my problem, I already paid them and fulfilled the law.

A total of 20 billion coins, delivery hope to finish this week.

Let’s see how Apple will respond to this.

the people being paid by apple do. im not sure what the exact dispute is but when it comes down to it, it is all about one thing, money, and with other companies "copying" apples ideas, it creates an oppurtunity for improvement beyond apples technology costing apple money in sales.

Normally I would agree but the "patents" that are being infringed on are complete BS. Do you really need a patent for having a little bounce at the end of a document or webpage when scrolling? or swiping to unlock?

Apple is being beaten at their own game and seems to see suing everyone in sight as a way to regain their hold on the market
