Roof caved in landlord complaining about blunt smoke?

My roof got screwed. They had this leak because they clogged up their gutters never cleaned them. It rained like 25 inches in about a month and caved in my roof in a room. Its fuucked. I complained about it for 4 months.

I was sitting in my living room smoking a blunt this girl rolled up because the roof was fucked and I was freaking out. Then the landlord stops by without notice after I text the dude the roof fell in.

He walks in a and sees a bunch of smoke, a blunt two other girls in the living room and some fifths laying around.

He then says, "oh sorry about the roof. I should have fixed that earlier." yeah brah much earlier. I pay him 1,500 a month so something should get fixed.

Anyways he then emails my parents I am smoking weed and stuff in the house. They dont even pay rent they are just co-signers. Haha whats the dudes deal? The roof fell the fuck in where someone was living and smoking is what he is concerned about. I pay the rent and he just tells my parents I am smoking weed in the house and bitches about that. Haha

The lease says no smoking, but the damn roof caved in and this dude just stopped by unannounced.

Can he do anything about the weed? Its legal out here. I know I shouldn't have been smoking a blunt but I woke up to a roof falling in at 5 am I was hungover and agitated.
 
Well you did say you hit him up about the roof falling in, so he kind of has to show up about that. You probably should have anticipated that.

But if he wants to be a real dick, and the lease says no smoking, he could evict you. But that seems a little excessive.

Just don't do drugs, mmmkay

So are landlords. If stated explicitly in the text of the lease he can definitely start the eviction with a 30 day quit or move. In reality it will cost him way more in legal fees to get this going so you will most likely not hear anything. He can try and get you to move with a quit notice but that will take upwards of three months to work its way through the courts. My bet is you will lose you deposit for the "smell" and good luck using him as a reference on future rentals. Not to be a dick but weeds legal in your state not by the feds, He is just covering his own ass. That being said calling your folks....... That's just lame.

not to mention that smoke is known to weaken the properties of wood and cause it to deteriorate much quicker, i wouldn't be surprised if he sends you a bill for the roof now that he has proof you're the cause.

My landlord earlier said it was ok to smoke weed in the house. Just the other day he came by tripping out that the house smells like too much weed and he said its going to take months to get rid of the smell? I find that hard to believe even thought the house does reek.

Every time the dude comes by he has to crack the windows open and says, "it smells too much like weed in here". Just the other day he said that we smoked too much weed in the house and said to move it outside and is threatening to take 1,400 for cleaning services.

How can i get the smell out? I want that 1,400 back or a gold chain.

I stopped smoking 3 days ago and there are some smells lingering for sure, the parents notice it still when they stop by.

But OP, I thought your landlord already knew.

This is a new landlord. The dude is a dick. All I do is live in the house, go to school and work. I pay rent all on time and I complain my roof is going to fall in he does nothing about it.

Then the roof actually falls in, and tries to blame it on excessive partying in the house that I have caused.

When he came over these two girls were in my living room one was hungover and asleep on my couch and the other was smoking the blunt and there was an empty fifth with some bongs out.

He then emails my parents again saying, "they partied in the house last year, they party in it this year they should expect these problems because its from their partying."

I dont get where she comes from, I haven't even had any parties. I have 3-7 people over to have some beer and chill time to time but nothing out of control or raging. I work 30 hours a week and I have school full time.

My old landlord was awesome. Best guy to deal with.

If the lease explicitly says no smoking then yes the landlord can do something about it. However you can also do something about living in a house with a fallen in roof. these are two separate incidences so they can both be brought up. If all he did was call your parents then I would consider yourself lucky for violating the terms of the lease.

Yeah the thing is there was a bedroom out for like 2 months since shit was slowly falling down. Then it too like two weeks to get fixed. The guy lied about when he was going to fix it and kept putting it off saying we would get compensated by reduced rent. Which he lied about and never happened.

Now he and his wife are bitching about the weed smoke. While I am still paying them full rent which they lied about and told my mom even reduced rent would happen. A god damn roof caved in and they treat me like this?

They are fuckers and basically only communicate with my parents and none of the tenants and my mom gets these emails about how I partied there last year and how we smoke weed indoors. Lol I never even lived at the house last year and I have told them this many god damn times. My friends lived at the house but never partied. We go to school which costs too much to fuck around.

They still threaten to kick me to the street and stuff. The guy wants to sell his house.

Its just ridiculous man, I pay rent and ask them to fix my roof which is falling in still happily paying rent because they say they are going to get it fixed in a week. A week passes, oh yeah next week we will work on it.

Then it falls the fuck in two months later after I had been telling them about it. Still paying rent at full after being garenteed reduced rent.

Then they threatened to evict me if I didn't pay full rent, so I paid them again. Now they make all these complaints, and dont even talk to me at all.

It's like since I'm 21, she thinks I am some college kid that parties all the time. Says that we throw parties all the time when we don't. And makes all these other false judgements and wont even try to contact us or talk to us at all about the issue. She only talks to my parents and my parents think she is ridiculous as fuck. This is the dudes wife they are both crazy as can be.
 
Stop paying rent and stay there for free until the cops kick you out. These cocksuckers asked for it. You can probably make it 4-5 months before that happens. Once the roof gets fixed get your revenge. TEll your mom to block his phone number and email.

They're co-signers on the lease, of course he can tell them. Grow up and stop smoking weed in every situation including when your roof collapses... friggen addict.
 
Some landlords are just shitty and try to milk every possible penny out of you. When he came over he was looking for anything to grab on to that would make you seem responsible, not him. By involving your parents he's hoping to have a better case against you since his end goal is to make you pay for the roof.
 
As a landlord myself I am so grateful for a tenant that works all the time, has money, doesn't have friends over, doesn't smoke, etc. And generally keeps my place in like new condition.

If I were your landlord I would probably be irritated that you smoke in the house to the point that I would keep a portion of your damage deposit to deep clean the place after you left, thanks a lot for stinking up my house, prick.

But if I were you I would withhold paying rent until the house is returned to the condition it was in when you signed the lease. Or until you have some binding agreement if you don't think you have the leverage because of the condition you are keeping the house in. Bottom line is you gotta have a roof. Its winter for fucks sake.

You always get agreements with landlords in writing.

You know your landlord doesnt like you smoking weed in the house, yet you continue to do it.

You know your landlord is coming over to asses the emergency repair, and proceed to light up some weed.

Your parents know you smoke weed, so why do you give two shits if the landlord tells them you are drinking and smoking?

"partying" doesnt just mean throwing ragers. It can mean getting drunk with friends, doing drugs, etc.

Do you have the emails letting the landlord know the issues with the roof, from 4 months ago till today?
 
someone probably already told you this but if the lease says no smoking, he can fine your or kick you out for breach.

your parents are co-signers and liable for the lease--so if he kicks you out, you'll likely have to pay him the remainder of your rent until your lease is up and your parents would be on the hook, too.

But it sounds like he had been a great tenant prior to this and he should be using his rights and with holding rent until things like the roof are fixed.

I know landlords have costs and all that but they just don't deserve the money if the person is living with that big a problem.

If the situation is unlivable for OP and this dude has crossed the line only solution is to get some free months rent and then find a new spot.

But if it were real, the landlord has the opportunity to get the problem fixed for the tenant. If the place is not livable in the meantime, the landlord should be putting the tenant up in a hotel. OP did'n't say the landlord wasn't going to fix the roof or didn't offer to make the repairs, so I only assumed your idea of withholding rent and squatting to get revenge was in response to the landlord complaining about the pot smoke and contacting his parents.

OPs main post is much more about the pot smoke than the roof--sounds like the roof has problems and the landlord has agreed to make the repairs but both agreed that he should have gotten on the repairs sooner.

if the unit is not habitable, and the landlord refuses to make timely repairs, then OP can move out and will not be liable for breach of contract.

He told me I need to move out in a month so he can do some fixes and the roof is still fucked. My lease is good for like 9-10 months still.
