Rape is when a man attacks a woman (or in the rare case, a woman attacks a man) either aggressively (i.e. punches her) or passively (i.e. roofies her drink). Rape is not when a drunk woman and a drunk man consent to engage in sex. When true rape does occur, it is an awful, sub-human act and should not be tolerated on any level. However, rape has become such a grey term. If a woman is at a party drinking and ends up going home willingly with a drunk man, he can be charged with statutory rape (at least where I live). Similarly, if a woman behaves promiscuously, drinks, and decides to have sex, that is not rape, but the man can be tried for rape. There seems to be a large amount of agency on the part of the woman in such cases. No I am not saying that women bring rape on themselves. No I am not saying that any woman deserves to be raped based on what she's wearing. Again, actual rape is an atrocious thing, but the war on 'rape culture' that has been growing recently is a misguided affair, at least what I've seen of it.

So my question to NS is this: When does the woman become responsible, or is it always the man's fault?
 
hmmm only read the last line but when a girl rapes a guy it isn't rape.

it amazes me how ma girls yell rape after they fucked some dude and have regrets about it. Its happened to a few people I know and puts enormous unneeded stress on a guys life, it sucks now a days that a bitch can fuck up your life ASAP.

I think its a bit stupid that when you hit on a girl dressed as a slut they get all offended or creeped out. I mean if I'm walking up the road and some chick comes up and yells at me to come save her kid from a burning building and I really don't see why I should be risking my life to save her kid I might be a bit annoyed. But if i decided to dress up as a fireman that day I can't really be mad at her.
 
Honestly, I got too fucked up on Halloween and this girl had sex with me while I was too out of it. It was practically rape, I would not have said yes if I was sober... But in the end...

"judge ________ (name here), i was intoxicated at the time and therefore unable to consent to sex. the sex was not consensual on my part regardless of whether or not she had given consent."
 
One time when I was plastered this whale of a girl stole my hat so I'd get close to her, then she started making out with me. She dragged me to her room and it took me a solid minute to realize what was going. Managed to get a hold of my hat got up and walked out her door. I also somewhat disagree with the law that you cannot legally give consent while drunk, it's way to ambiguous and can be interpreted in many ways. You have to accept the fact that if you are going out drinking you may make a bad decision, that's the nature of alcohol.

You can compare it to drinking and driving. You're hanging out with some buddies having some (or many) beers and you make the decision to drive home drunk, on your way home you t bone another car and seriously injure or kill someone. You have to accept the consequences, it does not matter that you were drunk when you made the decision to drive home.

Lets say your some girl going out to the club with your friends, you get drunk and decide to go home and fuck some guy you just met. You wake up in the morning and regret it but the fact is you need to accept the bad decision that you made, it doesn't matter that you were drinking when you made the bad decision.

I actually met a guy who was accused of rape, he told me his side of the story that he had sex with a girl one night at a party. I was not there however he did assure me that he had consent and he seemed like he was telling the truth. A couple weeks later she went to the cops accusing him of rape, luckily for him there was absolutely no evidence and the cops did not take her word over his but it really pissed me off when I heard that. I hope that no one ever has to go through false accusations.

Just to make sure I cover my bases if a girl is physically forced to have sex, or does not agree to have sex then it is rape.

The whole you can't consent to sex if you're drunk is fucking retarded.

If you're drunk and get raped it's rape, if you're drunk and sleep with somebody it's drunk sex. If you get pulled over while driving drunk the cops don't say, you were drunk, you didn't really know that you were driving a car.

I'm not very well versed on this whole 'girls crying rape' culture you speak of. However, I have a question....

You say that on occasion, girls have sex with someone when drunk and then claim rape once they regret it, because apparently you can't give consent while drunk.

So, if the accused male was drunk at the time, why can't he in turn claim he was raped? Seeing that his grounds for rape are identical hers.
 
Because he has a penis and therefore it's different.

At the same time you have everyone bitching about how men are trying to make make women =/= men.

So women want to be equal with men, they just want to have completely different standards. You get it?
 
Not really, men are the ones who do the penetrating. Therefore its them who rape.

I don't know how a man can be unconsciously drunk and fuck a girl. Even say you get a hardon somehow despite being fucked up and too drunk to control yourself, are you really going to be able to bust and everything? If you are too drunk to not be able to get away from a woman you don't want to fuck, you aren't going to be able to perform and have sex are you?

Its like baseball and trying to say the pitcher/ball is responsible for hitting the bat and it wasn't the batter/bat who hit the ball.

Women should be able to dress as slutty as they want without every fucking loser thinking it entitles him to sex with said woman.

And finally if you are creepy and slimy enough to manage to have sex with a girl who regrets it to the point where she'd press charges...well you're probably a piece of shit and deserve bad things to happen to you. Hard to feel sympathy for anyone that big a creep.

If I was a woman and I was dumb enough to fuck some jerk and he was an asshole about it after and people found out and shit and I got made fun of for it I'd probably want some revenge.

Be a gentleman and treat all women like they are someones mother/sister/daughter and you will be OK. All there is to it.
 
Consent to sex is the whole point. If one person does not agree ( female or male) then I see it as being taken advantage of whether it be a power trip or whatever. men need to realize women are human as well

Charging him with rape simply out of spite and "revenge" is fucked up beyond belief. That would ruin a person's entire life, all for some girl who regrets having sex to claim revenge. If you genuinely believe this is ok I suggest you step away from the computer for a minute and seriously reevaluate your morals.
 
Because the male is the "penetrator" they are the ones held accountable and tried for rape in these drunk he-said-she-said cases. It is complete bullshit.

As others have said, you can be taken advantage of and/or raped by a girl and the next day find out you are being charged with rape because your dick goes inside of her.

That said, real rape is a terrible thing but that's not what we're talking about.

your phrasing was completely unproductive, but you don't seem like someone who's particularly persuasive in the first place. however, this phrase is pretty pertinent to this thread and most young men's opinions towards rape.
 
Has any guy ever gone back to a girls place drunk, both parties are drunk, and had sex then tried to call rape? I would be curious if that would hold up in anyway in court.
 
I don't disagree with the point you are making, but this is a terrible way to argue for it. Dressing slutty doesn't hurt anyone, standing on a street corner and yelling racial/homophobic/sexist/whatever other insults at people can. If you're gonna run your mouth, you should be prepared to deservedly get your ass kicked, if you dress slutty, you shouldn't have to prepare to get raped.

You think this is the first time this thread has been made? One thing I learned a while ago on here is that educating you kids is worthless. Just be happy knowing that all you idiots are perpetuating rape culture by saying that if a girl claims rape when she was drunk and dressed provocatively, that she brought it upon herself and that she's a slut that is crying rape because she regretted having sex... even though these cases of a girl falsely accusing someone of rape rarely ever happens. Although I love all the, "it happened to a friend of a friend of mine" bullshit.

See that's the clause in my OP where I said "from what I've seen of the Rape Culture argument...". Please, DO educate me. I did not make this thread out of sheer ignorance. I made this thread based on the information I have at hand. In all seriousness, PLEASE, PM me some reading, or links, or post them in here, I don't care, but honestly do, please. I don't say that with an accusatory tone or as a call out like "you can't produce such things", simply asking for some information.
 
rape is rape. its not about sex, its about violence. the fact people are making jokes and attempting to justify it is disgusting. when im walking home alone late at night and some creepy guy yells at me is it my fault because im alone at night? to justify being a creep to a girl because of how she is dressed or the circumstance she is in, i.e. alone, is messed up. in conclusion i dont think anyone on this thred, even me, can have a true say in the matter of how laws should be until it happens to them. yes woman can call rape and just be lying (which is messed up in itself, no one should lie or attempt to unjustly ruin someones life), but what if it actually was rape and you dont want to believe her just because she was drunk? well im just rambling now but thats at least a womans perspective to a thread filled with guys.
 
It's mostly directed towards the ignorant children posting in your thread. Just google rape culture and you'll find plenty of information about how idiotic attitudes, as displayed by the jackasses posting in this thread, puts blame on the victims. That not only results in the high number of rapes that go unreported but it also tells rapists to target drunk or what society perceives as "sluts" because it's the girl's own fault if she ends up in that situation.

That was a basic description but the issue goes more in depth. It really is fucked up how many kids have this warped view of how it is a women's responsibility to not get raped.
 
the issue is that, while you made some valid statements, when thinking about or discussing rape, these should be very small concerns. men too often feel attacked when talking about rape, and this half of the discussion, (well what about when it isn't rape?) is really appealing. the problem with focusing on it though is that it perpetuates the victim blaming and "innocent until proven guilty" stance that our culture too often hold towards rape (look at the steubenville case and the media's reactions to it).

it's true that false rape accusations are serious, but in reality they aren't usually very hard to disprove, nor are they nearly as prevalent or damaging as actual rape. men latch on to these concepts because they feel like they need to defend themselves, but the fact is that men really don't have much they need to defend. the whole mens rights bullshit is backed by men who just don't understand marginalization, and think their tiny problems outweigh their massive advantages.

so basically your question, while raising some valid points, should ideally be one of the last issues that's focused on when dealing with rape, there's still much, much more pressing issues to be dealt with.
