if the cop arresting you, does it matter if he doesnt read you your rights?

yeah im pretty sure, but they can handcuff you i think and not formally arrest you until later at the police station, and if you are a minor they cant arrest you wihtout your parents being threre i believe, although they can handcuff you and detain you i think. why do you ask?

there was something going through the supreme court about that, whether cops had to read you your miranda rights or not, the case was to make it so the cop doesn't have to read you the rights but all I know is that they were trying the case, so I have no idea whether it passed or not, you might wanna check that out somewhere on the net.

If you show cops a little respect no matter, what the cercumstance, thinks will always be a little easier on you.

and usually as long as you don't have a crimal record, they'll let you off with most things

My advice, go nuts as long as your a young offender, then mellow out.

you can also be put under informal arrest without hand cuff's...they can do this if they are searching you for drugs or what not if you're in a park or whatever and they have a probable cause

 
they have to read you your rights when they cuff you or its not a legal arrest. you can use that against them in court.

obviously none of you have ever been arrested and spend too much time watching television.

The police can essentially do whatever they want to you, short of beating the shit out of you (which they can if they feel their safety is being threatened). You can be put in cuffs and not arrested, same way you can be arrested but not put in cuffs.

I am not totally sure about the states, but in canada you don't have to be read your rights.

ok say someone called them and said people were buying drugs in the park, and they came and you were there and searched you because you smelled like it and they found 9 grams and a pipe in your pocket, then proceed to putting you in cuffs and taking you in without reading you your rights, is that ok or can you use that against you in court?

no, you're fucked. What you should worry about now is exactly how fucked you are. Were the drugs all seperated out into grams etc? Did you have a bunch of cash on you? Anything that points to you being a dealer (regardless of whether you are) will make your life a living hell.

unless you live in b.c., then they'll probably let you out of jail the next day and never charge you. We're all fucked up here, the police are so fed up(or paid off) they ignore all the crack dealers, and people who break into house and try to beat the shit out of people get out of jail the next day. It's realy messed up. And i don't think they need to read you your rights in canada they just need probable cause or a warrant.

I dont think they read you your rights until they press charges against you, or something. Same kind of thing happend to a friend of mine and he got really fucked. The cops waited like 3 days to press charges cuase three days after was when his 17th birthday was so it is as an adult. And i guess the DA or whatever for my county rapes people with hard sentences and community service and stuff for drug stuff

It goes like this, if they dont read you your miranda rights and you admit to shit they cant legally use that in court. You will still get charged for whatever they feel like charging you with, but until they read you your rights than they cant use anything you say against you.

k .. in canada .. if you're detained or arrested, you have to be told the reasons for it and they have to read you your rights .. if they don't .. anything you say is inadmissible in court
