Pulled over and someone has weed?

Quick question, I am going on a road trip in a couple of weeks with a group of people. We will be driving from MI to FL. There is a chance that someone who is going with us might try and sneak some weed along. We have told them not to bring it, but I wouldn't put it past them to try and pull it by us. If we were to get pulled over and the cops found it, what would happen? Would we all get in trouble or just the person that has it? Could we all face possession charges?

It's obviously a situation I am going to do everything I can to avoid, I just want to know what the worst case scenario would be were something to happen. Thanks.
 
why dont you just skip all of that and not consent to a search if you do get pulled over for what ever reason it would be...
 
That's not true. If they find it on the kid in the backseat how would the others be able to be charged, what if they know nothing aobut it. Come on.
 
if its in his possession its his responsibility, put if he sticks it in your glove box or something than its the driver/ registered owners responsibility unless the cop decides its in his "indirect possession" meaning its not on him but where he was / with his stuff. Honestly don't worry about it, tell whoever has it not to try and dump it in your car if you get pulled over. But its not like they pull you all out and search you if you get pulled over for speeding unless they can smell it or you did something really stupid. just chill and let him bring his bud its less shady than having him try to buy it along the way from god knows who.

Nope, my friend got pulled over, I had weed in my jacket. I got arrested and two tickets, my friend got nothing.
 
Because I was ignorant and I didn't want my friends car to get torn apart/searched which happened anyway while I sat in the back seat of a squad car and he was either in the other car or getting patted down.
 
ya as long as you guys arent smoking in the car and he has it stashed in a bag, you will be fine. If you get pulled over, they wont search the car unless you give them reason to.
 
if you get pulled over, and the kid has weed, when the officer asks something like "mind if i have a loom around your vehicle?"

you say something like "you do not have my consent to search this vehicle unless you present me with a valid warrant"

and then it doesn't matter if the kid has weed or not.

but if for some reason it does get found about, as long as its on his person (in a pocket, up his ass, in his bag) it should be just his problem and not yours.

 
This is all based off cops and public high school history, so don't treat this as rock solid data, but laws differ from state to state, especially transportation laws. From watching cops, I'm pretty sure its possible for a driver to get in trouble if there is a controlled substance in their car, but I doubt it would come to that over a dub.

Also, if a cop wants to search your car, say it violates your fourth amendment rights, and KINDLY request he get a warrant if he wants to search your car. This isnt rock solid though, so try to have nothing that would give him a reason to find you suspicious. If he says you look suspicious ask why. If he say you're young thats profiling and is illegal. cops arent suposed to do it but they do. why do you think more latinos and black people get pulled over then whites?

In all honesty though you'll probably be fine. I know kids who wouldnt dream of road tripping with out weed to hep make the drive mellow. I wouldnt worry, even if he does bring it. Judging by the fact you even asked if you can get in trouble, you're cautious enough to be smart about it
 
Seriously you are worried about this?

Just make sure your tags are current, never go more than 20 mph over the limit, and dont get pulled over right after smoking down and they will never search your shit. Oh and make sure he doesnt leave it somewhere dumb like the glove box. And you'll be good.

But... if by chance you do get pulled over and they ask to search tell them "not without a warrant". If they say "why? are you hiding something?" Tell them, "I understand you're just trying to do your job but refusal of consent is not probable cause". You'll be fine.
 
A cop does not need a warrant to search a car, you do not have the same rights in a car as you do in your house. A cop only needs one of four reasons to search you car
1) You give consent
2) Something illegal is in plain sight
3) Probable cause (this is the sticky one)
4) The officer believes his safety is threatened

Probable cause can be anything from the cop watched you buy drugs off of someone before they pulled you over, or if you are showing signs of being under the influence of a controlled substance. As far a possession goes I believe that if the weed is on your friend then the blame will fall on him, but if he stashes it somewhere in your car then it is you the blame falls onto, and if the find the weed for some reason, say it's just chilling in the open, then that allows the cop to rip all through your shit. The main thing to remember is that it is not an admission of guilt to not allow a search. And, if and when you are pulled over, don't start geeking out. Be calm and respectful, cops make dozens of routine stops a day, they are not looking to search a car unless you make them think that they need to.
 
how much weed are you talking about taking?

and as long as you guys are not smoking in the car and are not driving a really sketchy looking car with broken tail light or a head light out and are all up on your registration and shit i dont see you having a problem.

personally id tell the kid that hes not coming if he brings weed. if you find it on him leave him whereever you are. theres gonna be weed to buy in florida so tell him to wait till you get there.
 
as long as its on his person, i think you would be safe

but if when pulled over he drops it on the ground, all of you can be charged unless someone admits responsibility

at the same time though, 6 people vs. 1 saying its his, most cops would take the word of the 6

just dont get pulled over
 
dont smoke in the car itll never get searched, dont be high driving either. you have to be suspicious for them to search. they dont just automatically decide to search a car.

have him put it in his bag in the trunk, a locked trunk/glove box needs consent to search.

depends on the state, as long as you dont smoke it in the car they will have no reason to search the car. plus your guna have a shit ton of bags, you could hide it anywhere. Make sure its under an O, have a good trip!
 
This alone will be enough justification for you to have all charges dropped if you do get in trouble.

My professor (a judge of Indiana law) just talked about this in class on Monday. I'll put what he wrote for our outline.

'The act must be voluntary; not a reflex or convulsion or something which one was compelled to do'

'Possession of certain forbidden items is illegal only if it is conscious possession'

So you telling your friend is sufficient enough to not be liable. But really, it's just pot, and you'll likely not get pulled over. Try not to stress it.
