Probationary Drug Testing

Whats up newschoolers.Two months ago i got pulled over when i was high and charged with driving under the influence of drugs and have court tomorrow. i am guessing that i will be on some type of probation, i am just wondering what the chances are of me getting drug tested during that probation if i don't have any prior drug related offenses. Also, when i was pulled over i had a pipe a bong a scale and close to a half ounce on me, i live in colorado.
 
Can't anyone just not smoke for a while? I mean, it's not addictive, so why the fuck would you risk it and smoke while on probation for smoking?

 
Well first off i never said i was going to risk smoking on probation, i was simply asking what the chances of me getting drug tested are. And my lawyer said worst case scenario is Deferred sentence without drug testing, i kinda doubt that will be the case though. And there's a chance that they might have to drop all the charges because they had no reason to pull me over but i seriously doubt that will happen.
 
Usually if your charges are drug related they'll test you more often then they would other wise. Honestly, just don't smoke, think of it as a tolerance break. When i first got put on probe it was tough, especially since all my friends would go hang out and blaze, and i just felt left out. But now, Ive been of for a week and a half, and haven't yet, and really have no want anymore to go smoke, but probably will the next time theres a smoke sesh gathering, but more just for the social aspect of it then anything.
 
^ well from my experience with lawyers, they are overly optomistic about everything. i just thought maybe someone on ns had been in a similar situation. i doesn't hurt to ask.
 
I'm assuming you were also charged with the paraphernalia and scale? That definitely does not help your case. Colorado is quite lenient when it comes to marijuana though so you may get off easy, I guess it depends on the judge and what kind of mood they are in. Good luck though.
 
I had a friend on for drug related stuff, and he got tested once a month. I only got tested 3 times in 6 months ( all in the same month, was weird). Really i think it more comes down to your probation officer, and how you act around him. Is he a hard ass? when you go into the probation office, do you look like a respectable young man and not some hood rat hooligan?

this is true. and punishable with UP TO $100 in fines. But if you get possession with intent to sell, which any lawyer worth his salt could prove, then you could be looking at more serious punishment. You wont go to jail, but you will probly have to do community service, you will have to go to some form of counseling, and court fees and fines. But all you can really do is take the punishment they give you at this point.

I copped myself like 3 different felony drug charges.. And I went to court for them like 5 times after i got bailed out never got tested once
 
I promise you that you'll be getting tested. You'll be at either RMOMS or interventions for probation. Make sure you PASS YOUR INTAKE TEST. Make up some shit about learning your lesson from the devil weed.

How did you manage to get a DUID for weed? Were you roasting a joint when you got pulled over?
 
And BTW, the judge will not care about your possession charge. You got a DUI in one of the worst states to get one. That's the big charge that'll guarantee you probation and piss tests. You'll take Track A therapy which is 33 classes, 2 hours once a week. Be smart with your PO and tell them exactly what they want to hear.
 
You won't get tested at all. I suggest smoking any time that you want. Fuck the police. Don't let the man hold you back. Do what you want. Unhhhh.
 
Also a reason why I almost never travel with a calculator on me unless I'm going somewhere like a show of fest where I'm going to need it. That's about the only time I'd drive anywhere with anything broken down either.
 
What happened was my friends and i were smoking up in a parking lot and someone got our license plate numbers and called the cops saying there was smoke billowing out of a car. my friend pulled out first and then when i pulled out of the lot there were two cops coming towards me, so if i had sat there for like 30 seconds longer i would have just gotten posession. they turned around and pulled me over for no reason and gave me a sobriety test which they said i failed. the reason it might be dropped is the police pulled me over for no reason and the guy who called the cops didn't see us doing anything illegal, he just saw us smoking something, which could have been anything. My lawyer says that there is nothing illegal about a bunch of kids sitting in a car with smoke coming out of it unless he saw us rolling a joint or something. so the DA might just drop it because it is kind of a fucked up situation seeing as how they had no reason to pull me over. and they put a warrant out to arrest my friend who they didn't catch for "suspicion of dui". eagle county police are gaaaay.
 
if you get put on a probation program there will be a meeting before you start seeing the probation officer.

at this meeting they will ask you about your recent drug use. at this point you need to tell the truth, and maybe even go over the truth.

if you say you've been smoking at least twice a week for the past two years, they won't test you until at least two months after you've started probation.
 
Probly going to lose your license for 90 days whether your case is dismissed or not. Anyone thats been through a dui will tell you it fucking sucks.
 
dude i got fucked last night cuz a cop came to my house and found all my weed and everything thank god i dont have to go to court i live in colorado to. why cant they just leave weed smokers alone?????
 
I spent 10 days in the county jail because i didnt think i was gonna get drug tested..and this was BEFORE i got put on probation...so dont fuck with drugs when your in trouble with the law...its fucking retarded.
 
Yee, %100 chance of drug testing. The way they do it in Washington if you're in school is you'll get assigned a PO and he/she will visit the school once every week or two, check your grades and ish, and make you do a urine analysis that checks for everything.

Happened to me and it was robbery/assault, not even a drug offense.
 
Yeah man, cuz cops just show up to peoples houses without a warrant and bust you for having a dub sack.

Its not a 100% chance of being drug tested, there are two types of probation, supervised and unsupervised. With Unsupervised probation you don't even have to check in with a PO and its zero chance of drug testing. With supervised probation, its up to the PO unless the judge specifically orders it. And my lawyer said he talked to the DA who said if they don't drop it, it will be a deferred sentence with a year unsupervised.
 
And i refused the chemical test because i didn't know that you lose your license for a year if you do, but the cops forgot to do the paperwork so they can't even take it away now.
 
no. me and my dad where fighting and i was in my room and the cops came because we where fighting and it got out of control not cuz of drugs. then one cop came in my room and said wheres the pot and i smell marijuana. then they brang the dogs in and i told them where it was and i didnt get in trouble they let me off with a "warning". faggot.

 
... not sure whats hard to comprehend. happens alot, if someone refuses to a search and they need probable cause they will get a couple of trained k9s to sniff out place, whether a car or in this case the kids room.

 
if your getting charged with a drug offense and put on probation they probably will drug test you.

I was a minor at the time of my arrest and was drug tested a couple times for this court mandated class
