Alright so shit just hit the fan. We smoked at this girls house earlier on with about 6 people, we smoked in the garage and then went into the house. Once we go in the house the cops rolled up. My friend was not smart enough to hide his weed(alot). He got arrested for having a QP on him with a scale, also he had a fake id. I know he is fucked but just how fucked? (he is one of my best friends and he never deals with this much weed)
 
also i had to call my parents which is fuckin bullshit cause im 18 and had nothing on me, i didnt even have a car at the house. Also in Massachusetts weed is just a misdemeanor

Wow, this kid is royally fucked if he is over 18. I am not sure about the legality of weed in Mass, but I think this is bad regardless.
 
aight yo, mass cops DO NOT GIVE A FUCK especially worcester cops man, but when it comes to sutton, fuck, they might go all the way... its only a misdemeanor for small amounts though...
 
im pretty sure he is fucked, i dunno about michigan but in idaho anything under 3 ounces is a misdemeanor. but he will prolly get distribution which is a felony he might be seeing some jailtimebut look into your states laws.hope everything works out that blows
 
I typed that before your second post, I was just curious of state.

A "small" amount is usually less than an oz.

Scales are just going to be a paraphernalia charge if there is residue.

A good lawyer might be able to get it down to personal consumption if he has a clean record.
 
dude, sutton sucks when it comes to weed man, they give such a shit, they kicked a kid out from sutton high last year for stupid shit, then they found weed, now kids got a lawsuit on his hands
 
4oz isnt that much. and in no way will he be in federal prison, and the scale means nothing more than a paraphernalia charge. Not even close to deep shit, less than a year in county jail if he sees any time at all.

However if they planned to show up. i.e. it was a bust not a stumble upon and they've been watching him hes fucked. or if they can prove hes been selling to kids thats always a bad thing in court.

If a false I.D. is involved with more than $1000, you can face 20 years in prison, and a $100,000 fine.

If not, up to a $1000 fine and 6 months in jail can be faced.

 
did the cops just bust in warrant less? or did he like really not hide it well and have it sitting on the table. you always can get a case on the warrant part, but if it was a bust your friend can kiss his ass (and his ass virginity) goodbye
 
a good lawyer will make it so that the cops never even found it. if the cops searched the house without a warrent that is illegal dude. your home is your safe place. if he allowed the cops to enter, he is just dumb.
 
Tell your friend to cover his butthole in a federal pen because with that much weed and a scale he is screwed. I don't care how good his lawyers are.
 
The cops showed up because they said they got a car about a party... this girls house is known to have parties, we were all at the house(4 guys) and the girl was on her with her firend. Then right after we had smoked a blunt cops pull in the driveway, 3 of us were inside, and my friend (sober) was still in his car. Then my sober friend and the cop came up to the door and my frind answered. My question is did they have a right to come to the house if there were only 2 cars and 4 people there. Also they searched my friends bag (he ran outside then came back) and didnt ask him if it was okay first. They found the qp, scale, and fake id, just wondering if they had a right to search. Also he got bailed out last night and already has a lawyer(very good). Just wondering if you think he can get out of it or is he still fucked.
 
I know that with a decent lawyer in Canada this wouldn't even be a case... But then again the laws and cops are really chill. One of my buddy's friends got pulled over with 3 oz on them and a bong and the cops just took all his shit and made him sit in a cop car for like 30mins to freak him out alittle then they let him drive home..
 
With taht much bud, a scale and a fake, hes facing at least 2 felony's. In the end he'll prolly have it droped just to one felony but there is no way in hell he wont be charged with intent to distibute which is a major felony. What state are you in? This make a huge difference on what kinda charges your buddy is looking at.

All in all, ur friend is gonna be stuck in drug court for about 16 months which means he will have no life for about the first 8 months and will be sober for about 95% of that time. Im sure youve heard this but your friend is stupid for rolling aroud with more than an ounce.
 
Also, as long as your friend gets a decent laywer, the most jail time he will ever see is about 2 weeks in a county jail which isnt that bad. But regardless, your buddy is about to have no life for a while.
 
not gna lie but thats fuckin stupid...i dont know why you would roll with a QP unless you were pulling a fast one and dropping it all in one place...he's probably pretty fucked...maybe not as bad cause its MA but still pretty shittaay
 
Did they have a warrant? Or a noise complaint? They have to show you a warrant before entering your home. Even a noise complaint isn't enough. Ask to see the warrant or noise complaint. Unless of course one of you fools broke the plain sight view.
I'm guessing one of you dumb asses gave them consent to come it, that is their easiest ticket in. You got what you got for being pussies. Its very easy to remain calm, courteous, but firm. They're just cops, they only have as much power as you allow them to take if you haven't committed a crime.
 
Your in MA, chances are your bud will be just fine. My buddy just got busted dealing brownies (60) to some kid in another town. 6 months probation and a drug/alcohol class is all he got.
And a QP is not that much, I have friends who push QPs every week. Watch Weeds then you'll get a better idea of what a lot of weed looks like.
 
I just know that in mass that much weed with a scale is a felony and ive heard of guys with similar cases getting a month though truly a lot of factors come into play in a situation like this
 
in michigan

possession with intent to distribute is a felony. the scale would definitely seal the deal on the intent to distribute part.

fake id's are also illegal. misdemeanor, felony, or federal crime. I don't know. But they don't take them lightly.

He could be looking at jail time, especially if he has criminal history.

Or your state will give him like 3 years of retarded probation and shit in which case you would have wished you just went to jail so you could be out living your life free instead of being on probation.
 
by the sound of it with a good lawyer you could get everything dropped for some type of bullshit im sure.

Police don't need a warrant if:

1)They have consent

2)They are in pursuit of a crime

So if they knocked on the door you open it and they see a bag, bong, anything they have the right to search, even if they don't see anything good luck proving in court that they didn't see anything. Or if whoever open the door allowed the officers into the house (past the threshold) they just gave them consent to search. Police will lie in court

"intent to distribute" is just a phrase that scares people. Yes it looks bad in court but its not a deal breaker. Kid at my school got caught with 10g's pre-bagged so it was "intent to distribute" but still a mistaminor (sp?) "intent to distribute" is usually tagged to anything over an Oz.

 
my brother in law got busted with nearly a pound, a scale, and bags (aka intent to distribute) in VA a couple years back. He ended up with a bunch of community service and managed to get it all expunged from his record a few years later. I'd say, in my own completely uneducated opinion that you're buddy's fine. No jail time, but I say you still rape him in the ass so he learns a lesson.
 
hes deffenately gonna get charged with intent to distribute, they probly wont really care about the fake id that much. hes fucked, but ma cops are pretty chill about weed, my friends got caught in my school parking lot with alot of bud and a scale, both over 18 and did not see jail.
 
MA cops are chill about weed... yes... but they have different opinions when there is a QP and a scale. id say pretty fucked dude sorry to hear that
