Of Outrage and Staunch Legal Rhetoric

Lets face it, L1P is old news. WME is the wave of the future. Fools like Berman just cant keep up. He cant take the heat!~

its a good article that has actually given me the most info about whats really happening. good find!

Good read. Check the blog that happens to be linked in my signature for a less informative, but more bullshitty angle.

It's nice to read the actual article. Well stated at the end, the way I see it is WME has lost its roots. It's a shame they are harming another fellow ski company, especially such a progressive one like Level 1. I'm going to try to help the cause for Level 1. Spread the word people, we can make a difference.

Rock on Brotha.

“Whether Mr. Miller’s participation in and endorsement of “Refresh” breaches his exclusive licensing agreement with the Plaintiff is a question that does not appear to be presented in this case.”

thats ridiculous, was level 1 even aware that Mr. Miller was not allowed to even appear in anything but Warren Miller films? Pretty bullshit they didnt even contact him before sueing him.

Berman Owns, did nothing wrong here. Of anything Mr. Miller should be prosecuted for it.

It sounds ass thought the judge is siding with Level 1- I agree that if your going to sue someone- sue miller not level 1

that is very very valid. Miller infringed the copywrite of his own voice. but then again, it still is fucked that WME can "own" his voice.
regardless of the outcome, this could seriously hinder level 1's ability to produce ski movies in the following years, which is an absolute travesty.

crazy stuffs goin thru my head right now.....here's a list

1) I hate WME for trying to hurt Level 1 movie sales

2) WME movies fucking suck and I am way more entertained from most youtube vids

3) NO ONE will buy WME movies as is, how the FUCK will this law suit help your sales?

4) Refresh is amazing and if warren miller entertainment doesn't allow me to see the film, I'm going to fill a rotting turkey with sour milk and leave it on the doorstep of their office, everyday until they publicly apologize for being self righteous assholes. Ever smelled rotting turkey + sour milk?

5) When you walk out the door of your office wearing an outfit you got in a package from EMS, hop into your luxury SUV, drive to whole foods and buy a 24 dollar personal vegan pizza, I want you to take a look at yourself and ask, "Is this really why I got into skiing in the first place?"

If you're answer is YES. Then you are even more ludicrous than a hundread page lawsuit to the COOLEST company every to make a ski film.

im not an expert; i leave expertise to mr. joshua bishop. but i do believe that WME is anticipating the vast difference in audiences between level 1 and themselves. I doubt that anyone that buys Warren Miller tickets or DVDs really cares who L1 is. i *believe* that they feel that people will buy refresh solely based on the participation of Warren. what a wacky world.
in any case, the onus of proving irreparable damage has been done will rest comfortably on the shoulders of the plaintiff. I, for one, vote that berman consider some serious legal assistance, including but not limited to the aforementioned josh bishop, or these guys:

^^^ ugh that was clear as dirt. i'm exhausted. what i meant to say is that they are not trying to help their own sales. simply to hurt a competitor. sorry. but still, call those niggas down at flint. they will rep yo set.

Haha, the difference in language regarding the last two post is pretty funny. Especially since it's from the same person.

Plus, people aren't buying the movie cause warren miller talks during it, they didn't even tell us that he would be narrating it. I wanted to get refresh from the time i saw the trailer.

I see how WME can own the pre recordings of Warren Millers voice, but they can't own his voice outside of that? What if Miller left a message on my answering machine, or went on a radio show? Would WME try to sue me or the radio station for having his voice? Goddammit this is so messed up.

oh definitely. refresh is, trick-wise, the most ridiculously creative and progressive ski movie ive seen since idea. seriously, that guy mike hornbeck is on some other shit.

From a purely selfish point of view - I cannot wait to see refresh, I have pre ordered my DVD (ages ago....) and i WANT IT NOW..... this f*****g stupid legal action had better not delay me getting it.... I'll take it very personally, as if it is a direct inconvenience to my life by WME.... and i'll let them know in no uncertain terms....

im guessing that no matter how this turns out, those of us who were not in montreal are not going to get to see refresh this year...

That would be an epic disaster..... surely that cannot happen.

I would like to here from Wazzer Miller himself about all this.... a statement from him would be nice.
