Occupy Pepper Spray Cop

I am so conflicted about this,

On the one hand I absolutely hate the Davis PD,

and on the other I can't help but smile at these morons getting all the skin exfoliating benefits of Cayenne peppers.
 
hahaha...funny ass pics. although i'm not sure how i feel about tebow getting sprayed down....that man is an angel. but the rest of them prolly deserved it...especially waldo...that prick has been alluding authorities for decades
 
the occupy movement has been over come by hipsters angry because they can't find a job in this economy because they got a degree in art history. this is unfortunately how it is viewed.

there are numerous other themes going on in this movement that need to take the forefront. Subjects such as police brutality which you more or less mentioned you have a problem with the way things are handled.
 
Exactly. As a former UC Davis undergrad, I think the protest is completely justified. They aren't protesting the same thing as many of the other occupy movements. The tuition hikes are absolutely insane, and while tuitions rise and programs are cut, salaries are still increasing...

The students should be pissed. I'd be pissed. There is no way that pepper spraying students like they are annoying weeds or something is ok-the cops could easily walk around the students, and they weren't being violent or aggressive at all. Give them a ticket, arrest them, whatever. But using a noxious chemical on them? A bit extreme. But as Jon Stewart pointed out, I guess pepper spraying is the new way to deal with minor inconveniences like protesting students and black friday shoppers.

However, these memes are absolutely fantastic, especially the dark side of the law one.
 
Look the cops told them they had to leave, giving them a ticket wouldn't make them leave and would require hours of paper work and probably court dates. Arresting them would have got them to leave, slowly, one by one, and it would have taken hours of arresting while filling up jail cells and caused more hours of paperwork. Pepper spray took probably less than 5 minutes, they left and there was no other work required, everyone went on their way. It's not the cops fault, he HAD to make them leave as per the request of the President of the college and so he did what he thought was necessary and perfectly legal as well as within the bounds of the law.
 
Was it legal though? I was under the impression that pepper spray is only to be used by a cop if the person(s) in question were being violent to the cop or somehow endangering the cop, or if the person is under arrest and trying to escape. The protesters don't fall in either category, and they were being quite peaceful, and a small group of students in a circle is hardly a disturbance as they were pretty easy to walk around or avoid. They weren't resisting arrest as they hadn't been arrested, and they weren't a danger to the cop in any way. Therefore pepper spray would be considered excessive force in this situation.

I'm not 100% on this though, maybe I'm wrong...in which case I would be interested to know what is considered legally appropriate use of pepper spray.

I also respect that the cops wanted/needed to make them leave, and most of the protestors did leave peacefully when asked, but I think there were much better and less intense methods of doing so. Additionally, Lt. Pike is now considered among the biggest deuchebags nationwide because of what he did (and the rapid spread of that video), and he (and other cops) were suspended for their actions that day.
 
Yeah except there is no legal justification for making a student leave a public area on campus in the middle of the day because they don't like what their message is. They were entirely non-violent and treated with violence. Doesn't matter what the orders were the whole thing is out of control.
 
i believe it was a public area, therefore they can legally stay there given they're not breaking any laws.
 
I don't see any tents in that picture and it is daytime. While there may have been people camping, they weren't when they were sprayed with mace. They were exercising their first amendment right to peacefully protest; at the time they were not breaking any laws, simply standing for something they believed in. You sir, are dumb.
 
They encircled the police and told them if they wanted out, they'd have to make a path. So the cops did just that.

By the way, the type of spray they got hit with is a fogger. It's essentially watered down mace. It really isn't that bad. Try getting a shot direct to the face with regular mace.

Being persistent is effective. If the police come and tell you that you're protest can't go on here, you say ok, thank you. You then move to a new location and start all over again. And do that as long as necessary.

Being resistant gets you nowhere.
 
the guy you're arguing with is a security guard or something which puts him in the same boat as university police; you can fill in the blanks on that sort of person's mentality yourself.
 
since a revolutionary war and a protest are very easily compared...

What good would resistance, as in fighting, do these people right now? They'd get their asses kicked by riot cops, lose people's support, and they would be effectively shut down.

Like I said, it's all about persistence. Cause problems and gain attention by not making the wrong headlines, but by constantly being in the headlines. Resist by being consistently present.
 
Also, the media doesn't portray the movement well. That is why so many people don't know what it is about. They also basically only cover the violence.
 
OC spray doesnt cause respiratory distress, It just burns your eyes.I only know this from having been sprayed for job training before with Oleoresin Capsicum at 10% concentration. Obviously it might have different effects on different people... but all it did to me was burn my eyes for like 20 minutes after i rinsed my eyes out. Slight discomfort for the next 2 days, and when I took showers or washed my face it would re-activate the OC and burn again. I would honestly do it again if I had to, or on a $50 dare. People just hype it up and when you believe somethings gonna hurt you.. it will. Mental strength. And as far as the whole protesters getting sprayed with it.. let them. It was their choice to disobey a lawful order. And if you think them getting sprayed is excessive then your just being a pussy. Getting put into an armbar or tackled and cuffed is more excessive than getting sprayed.
 
If you see the whole video (45 minutes) you'll notice those same students surrounding, pushing and threatening the cops. So actually that cop is legally within his rights to pepper spray the students in accordance to state law because there was reason to believe his life was in danger. The problem was that he stopped the threat and THEN sprayed them, should have been the other way around, but they did actually yell at him to spray them at one point.
 
Disobeying the lawful order? The lawful order restricts peaceful protest? Not according to the Constitution I've been reading...
 
Public property is government owned property that is dedicated to public use. Examples are national, state and city parks, public schools and colleges, historic sites, bike trails, conservation land, wildlife sanctuaries, national seashores, courts, libraries, etc. Its still owned by the local, state, or federal gov't. So... even though they are peacefully protesting, they can still be trespassing. Im not saying i agree with it but thats the fact of the matter
 
This, the cops were kicking out the campers which in many areas (including college campuses) is illegal. If you want to be a complete dumbshit about protesting and do it in ways that break the law be my guest. just don't be crying victim when the law is enforced

These types of protesters are fucking pathetic. Fortunately, many people realize this and their clout is severely waning, so whatever they are bitching about now is largely dismissed.

if you are saying i -k'ed you then i did no such thing. public property is available for the public to use lawfully. i saw no laws being broken in that video.

you can't camp on public property unless noted (like a state owned camp ground) the cops were arresting the people in tents. other laws being broken were making verbal demands to the police which you can't do
 
The legal justification for making the students leave was because they were blocking a main pathway and it was a nuisance. The dean or president or whatever gave the orders for the police to make them leave, hence it was justified.

I say leave them be they are all going to eventually have to get jobs sometime. they're just the modern day hippies. I have nothing negative to really say about the occupy movement. Freedom is what both Canada and the united states was built on so why ruin that by pepper spraying individuals that really didn't effect this cops life. Would he be fired for not evacuating these individuals? to put it simple enough no he would not. endangering the public's safety isn't what the police are supposed to be about. I swear cops no a days should be screened under a more intense psycological testing process than they already do cause some how a few "bad apples" always seem to slip through the cracks. I'm not hating on all cops, just the ones who seem to fuck up because they think they are immune to punishment just because "they are the law". I agree with some laws and disagree with others. there are some laws that have just remained unchanged for whatever reason. Did you know that if you are wrongfully arrested in Canada that you are supposed to be provided with a meal and a horse? and that if you are in a carriage drawn by two horses you are allowed to shoot natives? tell me the law system isn't fucked now. There is more problems with the law now a days than I have with my computer(I have a lot of problems with my computer). I think they should do a revise on all the laws and allow the people to vote what should and should not be a law. like we all agree murder is wrong stealing is wrong and so forth. but what about the corruption with all the governments it seems to be pretty legit to them. I cant speak for the US but I know in Canada the government is always finding new things to make cutbacks on. yet they always manage to find money to give themselves raises. to me that's criminal activity. I can go on about how the government is so corrupt but, I don't want to waste anymore time because I know it will get me nowhere further than I am right now.
