Neglegent Driving

So i got a ticket the other day, with a total of $643. What happened was, i was stopped at a stop light, with the cop to my right also stopped. It was pouring down rain, like really bad. I was in the Left turn lane, and he was goin straight, so we were headed onto the same strreet and direction. When i got my green arrow, i was in my freinds car, with a extremly jumpy clutch, and i didn't want to kill the car on a hill so i gave it some gas and let the clutch out to make sure i didn't stall, and the tires spun for about 3/4 of a second, no joke. I let up and continued throught the turn and sure enough he pulls me over, and i give hmi all my info, and on the ticket, he gives me 2nd degree neglegent driving, andthen a intermediate license violation of 101 dollars. And i asked him why that was on there, because my 6th month period had already passed. And he told me well actually its a year, and i said, in drivers ed we were told it was 6 months so i asked to see the book. He got it out and it read and i quote:

''After the first six months, the holder may not have more than three passengers in the car under the age of 20, except for members of the holder's immediate family.''

And i said well sir i have 3 passengers exactly, and he said no you are miunderstanding, they are under 20. But i said i was allowed up to 3 under the age of 20. So i said whatever and took the ticket.

What do you think my odds are of getting this dropped. I am in a real hurt for money, and my mom isn't going to help me out, nor will my dad. What are the steps i should take, and what do you think will be the outcome?

dont just pay it see a judge and plead not guilty or no contest which means pretty much guilty but you have a reason which you'll get to explain so chances are the judge will hook you up and drop it or lower it a shit load or maybe the cop wont even show up and you'll get it all dropped. what i always do when i get into shit like that is plead no contest and tell em my story

yeah i know. but the cops have their system pretty well down to fleece you of $... but if you were actually legal and the cop saw this, and he could restate the facts before a judge... go for it and contest it.

Well I am going to plead not guilty, but i don't seee how that is neglegent driving, and also i heard that if he messed up the ticket, you can get the entire thing dropped. Is this fuk up big enough to get it dropped

basically if you fight it and the cop doesnt show up to court you'll get it dropped totally, and your pretty much guaranteed to get the fine lowered regardless

if you want a better chance at the cop showing up, when you get a court date, get it changed, because the cop usually has all of his appointments on one day so hes guaranteed to be there. they dont screw up all that often thoguh... they get paid by fucking you.

the cop could not show up for a lot of reasons. The court date could be set in his vacation time, one of his days off when he does other shit or has another court date that same day for a bigger case for being such a dick to everyone. Some cops don't want to be in court for stupid cases any more than you do so show him down.

Don't get me wrong, I like cops and all..

whoever said he gets paid to fuck you isnt really true hes going to get his fucking salary whether he shows up to testify or not he did his job to begin with by giving him a ticket, he probably pulled him over for something so stupid so he could make his quota thats it and could probably care less what happens after that cuz hes getting paid no matter what, its not like hes going to get paid extra just for showing up to court

if you were within the law, and he screwed you, you have every right to argue. if you can have 3 people under 20 in the car, and that's what you had, you are legit, and should argue.

if what you said is true, then a judge would have no choice but to drop it. its always better to contest it. Its what the courts are there for, your taxes are paying for them.. so why not use them?

dude, i got in so much driving shit last summer, i hit a phone pole going 80, got a ticket for going 91 in a 35 on my motorcycle, and got a neglegent drin=ving citation for passin 6 cars up a hill then running from the cops at 140 mph...through a construction zone. i know your pain. you cant win because your a teenager, cops have it out for you dude, good luck with fighting that

lawyer=$200 only if you win, you lose you pay him nothing...99.5% of the time the lawyer will win. They most important part is having a lawyer, because even if you go in there and plead for your ticket down, it's still on your record, so your insurance goes up and then if you get a second ticket you get your license suspended for 6months or untill you turn 18.

i dont know alot about american courts, but i dont think that you need a lawyer, if what you say is true you can contest it by your self and win. and if the cop gave you a ticket for too many people under the age of 20 and he was wrgon, that will be abolished from your record.

Dude, get that overturned in court, you shouldn't have to pay for either one of those tickets. Im sure that in court you could easily get both ticekts overruled if you planned out your argument well enough.

OK, first of all you don't need a lawyer. Their fees alone would probably cost as much as the ticket. Whenever you get a ticket you're automatically assigned a court date. You can either pay the ticket or go to court on your assigned date and plead either guilty (you pay all fines + court fees), no contest (basically the same as guilty, but you can tell your side of the story), or not guilty. You need to plead 'not guilty'. When you do that they'll assign you a new court date on which the cop will probably show up to contest your testimony. If the information that you've provided us is correct, the judge should see that the cop was wrong and throw out all the charges. Even if he doesn't throw them out, you should at least be able to get the fines reduced. The very worst that could happen is that you'll end up having to pay 100% of the fines, which you would've done already had you plead 'guilty' or 'no contest'. Trust me though, your chances are much better if you try to beat it.

 
you'll always get a better deal going to court, but it most likely wont get dropped altogether. I'd say its better to stall the car than burn a blackie right beside a cop. automatic ticket.
