Music for movie do i need to pay someone?

Do you have to pay to use their music in the video? I am going to sell it. I will give credit to them but what are the legal consequences of that?

YEAH YOU NEED TO get permission, just mkae sure you telll them that you aren't planning on distributing nationally, cuz if they do find out you did no matter how likely they xcan fuck you over.

Call people and find out on their websites on how to do so. I mean it will be a very, very slight chance they will find out you used their music but if they did, you would most likely have a minor lawsuit on your hands.

your looking for "limited usage rights for music in a motion picture". tgr, pbp, msp all spend about 20 grand for their soundtracks. You will not be able to sell a movie w/o a contract from not only the artist but also the studio where that track was recorded.

just to give you a taste. the song "happy birthday" (yep it's licenesed, even if little kids sing it in your movie you got to pay) generates about 2 mil a year from hollywood. would cost you or i about 10 grand.

the best way to get music is to go to all the small time music shows in your town and bro down with them. "would you like to have your music in a ski movie, and can i buy you a beer" most small bands are looking for the exposure. and you can promise them the industry standard of 1.5% of final sales. Most big time main stream bands also want a couple of grand up front.

but the record companies do... especially now while the whole stealin music off the net issue is going on.

while its true that you might slide under the radar. one lawsuit would ruin your entire skiing filming career.

What kinda music are you using? I got a buddy that prolly wouldnt ask for anything. He produces hip hop beats n stuff like that. Really good too

Dude just use it. This is being brutally honest with you and may sound mean but your movie isn't going to be a great hit and you probobly will only sell enough copies to come sort of close to breaking even with how much you spent on making the movie. This is if your movie does very well too. 500 copies is shooting very high for a privately owned film production company.

See man the best way to do it is talk to a litle less popular bands and be really nice, I jsut did this for my film and got permission to use some good music, so if you got any questions you can PM me and I can kinda help you do it.

Are you into taking risks? If so, use whatever you want as you want it. Someone at a record company may find out and care. If you're worried about that, make sure your production company is a LLC (limited liability company) with means that your personal liabilty is limited. Costs about $50-$100 to register a LLC in most states.

If you want to do it straight up, partner with local musicians and bands in your town. Team up, have them contribute to the soundtrack. Have them play the party after your premier. Work together, get the tunes for free.

Probably not worth dealing w/ record companies even if you can get them to return your phone calls

yeah, look for smaller local bands. I doubt you can get your whole movie just from these bands but maybe a few segments.

I saw the band Ill scarlet play, and they are fairly small. (myspace.com/illscarlet) They played a couple songs that would be good for a ski movie.

 
i don't wanna get sued so i'm doin all local i can play guitar and i can learn songs pretty easy so if i can find an easy song

No matter if you like his music or not, he started playing his own soundtracks for surf movies he was producting.

Pretty cool that he pulled it off and now probably makes more money playing his guitar than making movies!

making recordings by playing other peoples music is illegal as well.

don't give up though. if you write enough emails your bound to find an artist who is willing to particepate. also your not limited to garage bands, you can find bands that play in your local area who need exposure. best of luck

Listen I did not read one post, but yes you will need some licenses to use the music, first you will need a BMI and an ASCAP license, these are generaic licenses to cover most everything as a person that will make a profit from any sort of music used that is copryrighted, in addition to this you will need a "mechanical" license to use the original studio recording of what ever song yopu are using. I am drunk so my spelling is all of but my logic is not, I have a degree in music business and work within theindustry quite a bit, please do not take this situation lightly you will only be screwed over by lawyers no matter how small of an operation you are running it is better to be safe than sorry. I do not intend for any ego or sarcasm in this message. good luck to you...

if you don't want to get sued buy the rights, if you don't care don't buy the rights. a small ski production company ain't gonna get caught unless years down the road you make it big and then people remember that in your first movies that you didn't buy the licenses for the songs. thats my .02cents.

cause i went through the whole rig-ama-role. to license all the music for my own movie. 13 professionaly made songs to make a good soundtrack. all you got to do is talk to bands and get em psyched. I can give anyone the sample contract if they you want it.
 
you can use thirty seconds of a song legally without permission.......

but seriously, check out newschoolers video section. How many people there got permission to use songs in their edits?

i doubt companies give a fuck...if the movies are sold to small numbers like 1000- they wont give a fuck and if they do fuck them. charles burrogues of new way productions doesnt get permission for his films because he sells 500- so...yeah, fuck them!
 
yeah if u dont buy the rights to use the music all the artists will sue the shirt off your back and your kids and thier kids backs for copy right infringement. oh and dont expect it to be cheap beacuse u have to pay for the rights and then pay royalties on top of every copy u sell
