I mean yeah its sad, but you are on resort presumably paying a ticket fee for which you had to sign a waiver, you know the risks, especially if you are an ex pro
 
apparently he hit a ditch in the middle of the trail and didn't hit the sign? would love to see pics of the ditch cause thats more negligence and puts blame on the mountain, otherwise mans just ate shit and thats his risk he chose to undertake
 
I'm gonna crash into a tree and sue the USFS. Obviously trees should not be in proximity to trails that allow mountain bikes, trees within 20' of the trail are a blatant safety hazard!

Def not enough info in this article to form an opinion. Sure, there's inherent risk to MTB, but if they failed to maintain the trail and/or created a hazard that led to an injury, they could certainly be responsible.

The inherent risk is well established, and for that reason those lawsuits rarely go anywhere, you need to prove negligence and it's not that easy. So the fact that they settled for $10M instead of appealing also kind of implies that they knew they fucked up and wouldn't fare any better in appeal.
 
I’d expect someone who’d sue a resort over a crash to be a fucking gaper who started mountain because during the pandemic, crazy the suer is an ex pro. Wonder how pro he really was
 
A lot of the times in cases with bad crashes ending with somebody paralyzed their can be all kinds of medical bills. Sure sometimes people are looking to collect some $$ as well but it's not like he's in a great spot.

It wouldn't change everything but if we had a better health care system it would take the pressure off a bit. Especially if the person is a quadriplegic between the medical costs and just general care etc. Some of those people probably don't even want to sue, but they might not have an option.

No idea this guys situation.

As far as ski bowl putting a pause mtn biking, you really can't be surprised. Your insurance company isn't going to be stoked about a 10 mil lawsuit.

Actually surprised at how well the ski industry has done. With big cases like Salvini it seemed like things might be totally fucked. I'm heading to cutters camp in a few days. Interested if they'll touch on any of that stuff this year. At one point it seemed like the industry was going to have to go through some bullshit to build anything. Things have been pretty good though, builds are pretty consistent most places, at least way better than they used to be.

Some jumps are better than others but at least it's not like "Wtf is this thing?" Like some places used to throw up.

Def wish there were some pics of that trail. Would be interesting to see. Was hard to understand how the ditch and sign played into it, what they looked like. If he didn't hit the sign it'd still make sense to mention it though. If you hit a tree that's your fault. If it's a sign you can argue it wasn't in a good spot.
