Right, I can understand your point that "you can't always team up with the little guy just because they're the little guy" but to the other point that the "rules" apply to everyone then its in the favor of Rock Art. Rock Art & the Vermontster beer has been around longer* than the Monster Brand. It's like McDonalds going after a small burger shack for using "I'm loving it" on their local ads when McDonalds has only used that phrase in their marketing for 5+ yrs when said shack has been using it for 15+. Of course, that's hypothetically speaking.
This should be interesting to watch the case play out regardless. Vermont, it's residents and the companies that reside within it are notorious for supporting their colleagues in stuff like this. Already Burlington beverage retailers are pulling Monster from the shelf and displaying Rock Art in it's place. Granted, Burlington isn't a huge city...its not even a large town (yet defined as a city) but it's still a good show of support.
