That's right, John McCain was born on August 29, 1936, in the Coco Solo Air Base in Panama. As such he does not met the requirements of being a "natural born citizen" to accept the presidency.

"The first section of the second article of the Constitution uses the language, 'a natural-born citizen.' It thus assumes that citizenship may be acquired by birth. Undoubtedly, this language of the Constitution was used in reference to that principle of public law, well understood in this country at the time of the adoption of the Constitution, which referred citizenship to the place of birth."

Lacking citizenship by place of birth, and individual whould have to be "naturalized" through legal channels, and is not a "natural born citizen" in the sense the constitution uses it.

You're an idiot. His parents were US citizens, which makes him a US citizen, no matter where he is born. To become president, you have to be a US citizen by birth (not BIRTHPLACE dumbass), be at least 35 years of age and lived in the US for 14 years or something.

I'm sorry all you republicans are unhappy with McCain, maybe you should have had turned out and supported your candidate of choice in your primary or caucus.

The 14th ammendment clearly sets out 2 paths to citizenship:

born in the U.S.

or naturalized by law

the latter cannot hold the presidency

Maybe I'm crazy, but I think if this was actually true somebody would have noticed by now. I can't imagine them getting this far and saying "Oh shit! I guess we forgot all about that little list of requirements." Oops.

...Here's the exact wording of the relavent portion of the 14th ammendment, for thos who do not trust my interpretation:

"Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Well it would be easy to do, considering he served in the military and has been a congressman for 2 decades or so.

Dude, the court case you referenced was from 1857. The fourteenth amendment can pretty much be interpreted by congress at its current whim, and even though there is room for interpretation (Natural born citizen to me = he's a citizen at birth, due to his parents), I doubt congress could ever be persuaded to see it your way if they have to actually go and lay down judgment in this ridiculous case.
 
The 08 presidential elections would be over and done by the time McCain's case made it through the legal system. Maybe a 2012 run, lol.

But as it stands now, he was not born in the United States, and is instead a "naturalized" citizen.

oddly enough you mentioned both Dred Scott and the 14th amendment. oddly enough Dred scott doesn't fucking matter becasue when the 14th amdendment was ratified like 12 years later, it was immediatly obsolete, your agruent is just as good as the saying we're in prohibation still even though that was reapealed.

I think what you are referring to in the 14th amendment is this

Section 3.

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

I really don't feel like thinking and writing anymore but think about it, John McCain has been a miliatary officer, something that he would not have been able to do if he didn't meet that piece of crap i cut and pasted above.

 
Here is the best argument for McCain's behalf I could come up with.

The Naturalization Act of 1790 said:

"the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens"

However, it was repealed only 5 years later and replaced by the naturalization act of 1795, which says only on the subject:

"And be it further enacted, that the children of persons duly naturalized, dwelling within the United States, and being under the age of twenty-one years at the time of such naturalization, and the children of citizens of the United States born out of the limits and jurisdiction of the United States, shall be considered as citizens of the United States."

Putting people born overseas by citizens, in the same category as children that were born overseas by non-citizens, who were then naturalized. Neither would be Natural-born citizens, as their citizenship is defended through legal naturalization.

The point is that the president must be a natural born citizen (this does not apply to senators or representatives, or military officers). The debate is over whether John McCain is technically a natural born citizen. Signs point to no.
 
Could McCain be sworn in while fighting a court case to have legistlation passed to close the loophole that seems to exclude him? Probably, but it would be hilarious if he couldn't.
