Mail fraud

So I bought some skullcandy GI on ebay hadthem shipped , come to find out they were shipped to my old address , well that was on nov 8th , i just found out today . so the guys living there decided to open the package according to the neighbor right after they got the package and have been using the headphones since then.

anyone know the repercussion for doing something like this . from what I could find its. fedral offense puishable up to five years in jail and fines?? ill be contacting thepost office tomorow!
 
it is your fault you know. i guess it had your name on it, but it had their address. go talk to them first?
 
I believe that offense would be punishable if they took it out of your mailbox. Since it technically was in their mailbox, I'm not sure what will happen. that is fucked though, they should have sent the headphones to you, seeing that your name was most likely on the package. I didn't research anything so don't trust what I say haha.
 
but its illegal to open someone else's mail without their permission. so no matter what, even if it was shipped to his old address, the guy who opened the mail is fucked.
 
don't take it to the authorities, i mean yeah they stole headphones but you should just go make them pay you for the headphones and get your money back, then you have free headphones and you don't fuck some over...
 
its illegal to open up mail that doesnt have ur name on it (I think technically u cant even open up siblings mail legally) but dont be a dick about it... talk to the people and try to get them if they refuse then do something about it
 
You're really trying to press fraud charges because you didn't get your headphones? Your paypal address was probably still set to your old one (which you should have updated if that is the case). If you want the headphones back why don't you just call the people that live there.. it's not that hard, nor out of your right to ask for your property. Perusing mail fraud charges is just stupid over headphones, and chances are they won't find any evidence that will allow for you to press any valid charges. Just call them and get the headphones..
 
yeah i mean normally I wouldnt make a big deal about this but the fact is they opened the package very shortly after getting it. and I know the neighbor lady and she said it was adress to a name similiar to mine but not me. , which is bullshit cause paypal and ebay is all in my name, also the invoice i sent when i paid for the headphones specificaly said the correct address to ship to but instead the shipper went into my profile and found some old address. I have proof of everything.

Whoever takes any letter, postal card, or package out of any post

has been delivered to the person to whom it was directed, with design to

obstruct the correspondence, or to pry into the business or secrets of

your fault! they should have sent the package back but then some guy from the post office would be wearing them. YOU should have changed the address.
 
They're yours. Even if the mail was sent to a different address, the package was in your name, so yeah, they're fucked. I'd recommend going up to them and explaining the situation, but also tell them that it's illegal to open your mail, even if it's at a different address. When they ask how long, it's up to 5 years, plus $1000 if they're unlucky, so just give'em back.

Also, I'd leave 1 star for the ass that shipped the pair to the wrong address. He should be using the paypal address, and not your ebay address. He's a noob, and it's his fault for fucking up.
 
I don't see how it is his fault that the people opened up the package and took his headphones. No matter how you look at that's wrong and it's pretty much the same thing as stealing if not the same thing
 
exactly I sent a invoice with my shipping info on it when I paid. like I do everytime I buy on ebay. he obviously dug into my ebay account and chose a address on there. but all that aside. i dont care where they were shipped. its the fact that these coooks opened my package and decided theyd keep them . where I live is a small city . I see the neighbor at least once a week.
 
File a paypal claim and say you never received them, get your paypal money back and buy a new pair. Then charge them with opening your mail too.
 
You don't use ebay much, do you? When you send an invoice to people (which is what you're supposed to do), it provides links for pay via paypal. When you go through the invoice, prices, shipping stamps and addresses are all set via the paypal information to avoid mixups.
When the seller used the ebay address, he wasn't using the proper billing address. You use the paypal address because this allows people to buy things online as presents or for other reasons, and have them sent to the proper address. Get it?
 
Also, the seller chose to disregard the address that OP gave him to send it to. He obviously fucked up, and he should know that.
 
i think its dick that they used the headphones but you cant be an asshole and not go confront them first about it and see if they will A) give them back or B) buy you a new pair....mabe they didnt realize the consequences that would result from opening it...i say go to them first and dont be that dick
 
They aren't going to send this guy to jail over a pair of $30 headphones. They probably aren't going to pursue it at all, not even give him a fine. Just talk to them about it face to face.
