Legality??

how legal is it to camp out on top of a mountain in the woods....

i was thinking about camping out on the summit for a night or two, but i dont know how legal that is???

Far too many factors.

Who owns the land? State, federal or private? If publically owned land (IE- state nad federal land), what are the terms of the lease? What is the resorts personal policy regarding this type of activity?

You best bet would be to email the resort directly and contact them with your question for an answer.

Are you East Coast?? The AT runs right over the top of killington, I know you can do that if you want. You could probably park in killingtons lot and hitch down to the sherburne trail. You hike up over pico and then onto the killington mtns. I slept 50 yards from the top of the quad but that was in fall.

Yeah. I was in Rutland in June, and hiked Killington Peak. It was outside of Killington's technical "hiking season". parked at the K-1 Lodge, and hiked up from there. Saw people at the base, and saw some maintenence workers while hiking. They didn't care at all. They actually told me about how far I was from the peak as we were socked in by clouds and couldn't see very far.

But different places will have different views on land access and you camping there.

I worked at a state park in Killington where the Appalachian Trail runs right through it, so you would think that I would know, but I don't. There are a few through hiker lean-to's scattered about that you can use. Supposedly someone comes by once in a while to get money from people staying there, but it's only $4. I think you just have to stay a couple hundred feet from the trail. If its state land, then you should be fine if you just go away from the trail and nobody sees you.

I have hiked on the AT many times and have never stayed in a lean to or shelter of any kind, we just do as you say and hike off the trail some hundred feet. I have never run into trouble doing this. I advise if Thread starter is in VT that he should do this hike. Not as stated above by others though. The long trail and AT(together at this point) run right across the road out of rutland and head toward killington, it's about 8 miles of up hill hiking though.
