Legal Issue (?)

So I did some searching, didn’t really find what I needed, so here I am. I’ve built a little 10 ft pvc rail and put it across the street from my home on a local sledding hill. I purposely put it out of the way so you have to carve to hit the jump right, figuring any sledders will have a hard time hitting it.

However, my dad has got his knickers in a twist and says some kid is gonna fuck up and break something, and we’re going to get sued. The hill is public property (school district land) but the city actual promotes sledding there. I’m not too worried, but it got me thinking. Does anyone know some precedent for this kind of thing or some general guidance?
 
Just camouflage the rail with hunting jackets bought from the Home Depot and then dig a small crevace around it filled with sharpened sticks so then no one will see it and even if they do the will be impaled and there will be no witnesses
 
A pvc rail. It could have come from anywhere. Did you even put it there?

It's not your property, other people are probably moving it around using it. It's not on you. Maybe bring that one home and leave another one there and say your friend brought it. He can't do anything about your friends rail on somebody elses property.

See, what I asking is if some goob broke his ankle and his parents decided to be dicks about it, would they have anything? It’s a tiny town, so people definitely know it was someone in my group, and a sizeable amount know I live right acrossed the way, so SOMEONE could probably figure it out. And im genuinely curious if I hold responsibility over it even though I leave it on public property

I'm not a lawyer but I really doubt it. Not your property.

One of the things my parents didn't duck at was telling out insurance company to get fucked pretty much. I had 2 mini ramps and 3 trampolines(all paid for by myself) but insurance didn't like the first trampoline. Insurance really didn't like 3 trampolines and the mini ramps. They wanted it all torn down. I get it, liability and whatever. This was like 2002-2007. Not sure how it all went own but that was pretty cool. Proabably would be harder now. Shit sucks though. If you go over to somebodies house and the trampoline completely buckles because of manufacturing defects maybe take that up with the company, but if you get hurt at somebodies house just being there and sue? Fuck that.

We should stop rewarding those people and kill them.

Agreed. People need to take some damn responsibility and stop suing. There are some actual reasons to sue, but if you fuck up it's on you, accept it and stop trying to make money off of your stupidity. America sucks

Some asshat could easily get riled up and sue, and even if there claim is baseless, it will still be a major pain in the ass
 
Hey chief, I have worked for parks and rec for 2 winters now clearing sled hills and skating ice for safe use. And It would absolutely be a smart idea to pull that thing out of there. Its not that no one has gotten hurt yet, but if someone does the parks department will come after your ass. Not with any true legal issues per say just with fines that will make that rail not worth it. See, they have to clear the areas for safe public use, and if they cant do this because of a rail then they come looking for whoever did it because its extra work on their end. They will involve police and a whole lot of shit goes with that. I would advise to remove it, just because of the possible associated fines. But best of luck to ya, and also dont be too surprised if your rail is missing.

Over a rail that weighs like 4 ounces? The rail disappearing is the only thing I'd be worried about if I was OP. But a cheap PVC rail is a cheap pvc rail. Can always build another. I can understand if it's constantly in the way, removed and another one pops up, but going after somebody with the police because you're not capable of lifting a 10 foot pvc rail that weighs barely more than your cell phone? Lol.

All the shit in the world and you're talking about going after a kid with the police over a rail? Jesus.
 
yeah, frankly when you have issues with the public daily doing things like it'ss its up to the police to handle the issue. This is assuming that someone called in the pipe to admin. Now what I am saying is any general parks guy would toss it in the truck and go on with our day. No need to go get heated about a thread regarding a sledding hill. Just adding my opinion on what should be done.

Lol at me getting "heated". I'm just saying it's retarded to start shit with a kid over a rail left out. If you don't want it there, removed it. Pretty simple. Your post made it seem like you hate your job or people in general. You post, people respond. That's the intranet. Deal with it.
 
NS is probably not a great place to get legal advise haha. Probably a good idea to remove it though, try and set it up in a more covert spot. Otherwise they could just grabed it as it is on their property without authorization. Just because it is public land doesn't give you a license to set up a rail on it.

I used to work a shitty job I hated. Then I slipped on the floor at the restaurant I worked at. I still have to keep a job, but having a house, a nice ski house, and a decent nest egg life is looking up. If you're ever living in the states I highly recommended. Like my father always said, sue or be sued.
 
Never say never in this day and age. The thing you have to think about is if someone gets hurt badly enough to be paralyzed or unable to pay their medical bills they are going to be looking for deep pockets. They may not have a choice. The parents of some wheelchair bound kid are going to be out for blood. In this case it would most likely be the property owner, but that isn't going to let you off the hook if you are somehow implicated.
 
Not a lawyer but my guess would be that if you put up a sign with a disclaimer on it then you'd be fine!

Id be more worried about getting done for dumping on public land without permission. Technically leaving a hunk of plastic on public land unattended is tipping.
