Legal Help That Doesnt Involve Weed

So as it says I need some help.

This is about a traffic violation that i received a few days ago (Thursday). Its a long story so bare with me for a moment because i believe all of the details are important.

So ill will just tell you the story. The other day I just bought myself a new car. The day after i decided to take a short road trip to ride some bikes in a city that wasn't iced over. On the way back home I was driving down the interstate actually going the speed limit. When I was passed by a driver that was going probably about 100.. At this point I had owned the car for about 32 hours.. When the driver passed me they spit a bunch of rocks at my car and cracked my windshield. Now I know that, that was incidental, but if they hadn't passed me at such a high speed not as many rocks would have been thrown up with that amount of force. So I caught up with the driver and decided to fuck with them a little bit because i believed if they weren't driving like a jackass my window would be fine right now.

But anyways for about thirty minutes I wouldnt let them pass me. I was in the left passing lane and when they tried to pass me in the right lane I would speed up so they couldnt. Technically your supposed to yield to the right lane for faster moving vehicles, but at the same time I believe I legally had the right to be the in left lane because I was still passing vehicles.

But what I think actually got me was when they pulled their truck off the interstate on some off ramp to a tiny town. I then drove down the interstate pulled off as well and waited. but long story short. during this whole time I wasnt tailgating them, and I didnt ever technically cut them off because I never left, the Left passing lane. I was failing to yield to faster traffic, yes, but that isnt what it says on the ticket.. the ticket is a reckless driving ticket for the negligent disregard for the safety of myself and others, and CUTTING OFF, and HARASSING a FEMALE DRIVER.

that whole time I had no idea the driver was a female, and i was confronted and had my report taken down by a female cop. A male cop gave me ticket. When I got back to town there was a sheriff waiting on the exit for me who followed me. A highway patrolmen a few blocks down that pulled out and pulled me over. seconds after I got pulled over a third officer came screeching into the parking lot. I think i may have a case against gender discrimination, but basically I dont want to pay for this ticket because as I said, I just bought a new car, that classifies as "sport roadster" that i know the insurance will sky rocket on if i plead guilty of this charge. That and im a broke college student and i have enough bills that are tough to pay already. And also this ticket is 300 dollars. I dont have any bad driving history so i think that may help, and ive had a license since i was fifteen and a half without any prior charges. This all happened in the state of Montana, and any advice on the direction to take this helps. Im pleading Not Guilty, but i need some direction as to why i wasnt LEGALLY doing anything wrong. IF you have made it this far. thank you and any Advice is appreciated
 
sounds like your a fucking dumb ass. its not the other drivers fault if a rock breaks your window. you handled that situations like an immature 12 year old. karma bitch.
 
investment in a half decent lawyer will be way less than insurance skyrocketing. I would know, i just got dropped from my insurance policy. fml.
 
What you really should have done is hit her car so it stopped, then you should have peed in her butt. Then you wouldn't get a ticket for cutting her off.
 
And yes I am aware I handled it childish. It isnt their fault a rock breaks my window. but if they werent driving like a jackass i would have a fine windshield... which may or not be true. Rocks fly up because of pressure, speed, and coincidence with how you roll over them.. something with physics but whatever. I was looking for a legal out because I believe that its unsubstantial that the driver was a female, and that by definition I never cut the other driver. If i was doing anything wrong it would be failing to yield. Which i didnt get a ticket for
 
If a cop or multiple witnesses didn't see it then you have a good chance of getting it dropped. I would spend whatever you can on a lawyer and try to weasel out of it.
 
TWO WRONGS DONT MAKE A RIGHT. accept that you messed up, pay the ticket and get over yourself and learn from your mistakes. im sure if a lawyer read this thread they would tell you that you are stupid as fuck as well
 
wow so much hate, i'd be kind of pissed off too if i had just bought a new car and some dumbass fucked up the windshield because of their negligent driving

but i'd definitely just challenge the ticket, show up in traffic court; chances are the cop won't show up, they hardly ever do, and the judge will drop/significantly reduce the ticket. Judges aren't dicks most of the time for stuff like this, even if the cop does show up, just argue your case, especially the part about the female driver, that's bullshit.

Thank you for clearing that up. The lawyer would also do everything in his ability to clear this kid of charges because he would be paying him. Hence the thread asking for legal advice, fuck face.

but rly, i dono what to tell you, your story was a little vague....

a truck passed you and fucked up your whip

you fuck with said driver by not letting them pass? that makes no sense?

said driver exits highway and you follow them?

....you get pulled over somewhere and then pulled over again somewhere else?
 
So if i understand correctly because they drove like a jackass, you drove like an even bigger jackass and fucked with them on purpose? This seems like a pretty good example of two wrongs not making a right haha

 
Haha also, you did the exact same thing they did but even worse. All the other cars around you were probably pissed at you for being a fucking jackass and in fact for all we know you could have sprayed rocks and damaged a different cars windshield
 
If they would have passed him at a reasonable speed they probably wouldnt have thrown rocks onto his wind shield and cracked it.

BTW thats really fucked up that there is a ticket for harassing a female driver.
 
so...what you're saying...

is that you are pleading "not guilty" to the charge of reckless driving and "cutting off"

when you WERE, in fact, driving near 100 MPH and preventing a vehicle from changing lanes to pass...

all because they kicked up some rocks that busted the wind shield of your car?

this is one of those situations where the mother figure usually tells you that you should have ignored them and let them get in trouble...yes, they cracked your windshield don't get me wrong, that would piss anyone off...but now you have a cracked windshield, a serious driving citation, AND your insurance is going to sky rocket.

shoulda used your head there killer...
 
Yes thank you for clearing up that two wrongs don’t make a right, I was unsure that wasn’t true in anywhere but math. I am not saying Morally I wasn’t wrong for being a dick driver in response to them being a dick driver...

But what I am saying is that legally I’m not sure if I did do anything wrong. The passing lane is for passing. I was in the passing lane, and I was passing by slower traffic. They tried to pass me on the right a few times but I would just speed up so they couldn’t. And since I was speeding up when they did I was faster moving traffic so I had the right to be there legally... And last time I checked I’m allowed to pull over on the side of the highway. It could just be a coincidence that they passed me when I did and we met up later on the highway. I mean it’s not. But to convict someone there has to be real evidence. Which there isn’t. And even the other drivers testimony won’t be relevant I believe. Because legally I didn’t do anything wrong.

I am aware of all of this and we can woulda coulda shoulda all day and night but that isn’t going to help me in court. And to clear something up the ticket is for Reckless driving. I was apparently being reckless by harassing and cutting off a female driver. Legally I didn’t cut her off. I didn’t switch lanes... and that’s the definition. And harassing a female driver isn’t irrelevant, because the sex of the other driver shouldn’t matter, nor have any effect on the ticket. And since they wrote it down... it probably does...

I am aware that I was being a dick, and overreacted. But was looking for legal advice that can help.



 
Yeah I know you were asking for legal help, but part of posting a thread where you talk about what you did involves getting told you acted like an asshole just part of life. As for the legal standpoint, where is their evidence for any of this? Did a cop see you doing it? Maybe It's just me but i didn't get a very clear idea when reading this how you ended up getting in trouble
 
Well ya that is true... And no a cop didnt see any of this... which is another reason besides the technicalities as to why I shouldnt be In trouble. I wasnt called in by any other motorist. Just the female driver.
 
i knew what it was the second I opened this. If it's not weed on NS, it's a speeding ticket or something involving cars.
 
i think that is a common misconception because i see that all over the place when people are looking to get out of a speeding ticket

and i know quite a few cops, and they say that 9 times out of ten they go to court unless they have something really important going on

then again i'm from a small town where there isnt much else going on
 
And no I haven’t admitted to anything. I hardly said much. I started telling the female cop my side of the story, but she interrupted and she said that’s their job, and its not my business to patrol the highway is all she really said about it. And to whoever asked earlier about the car I bought is a Tiburon. I’m not into the "Tuner" or whatever scene. I just thought it looked nice, drove nice and was well taken care of, that and low miles. It’s a coupe, but once again... on the ticket it says sports roadster. Haha it says a lot of things that aren’t good. Roadster, Female, and Reckless, aren’t very forgiving words on the same ticket. I’ve contacted a lawyer and he said I have a fair case to get this dropped or the very least reduced to failing to yield to faster traffic. And also he said both cops have to show up. There were three cars there while I was pulled over but one took my statement, and one wrote the actual ticket... The other was just there because the probably thought I was going to kill her
