Lady blew a stop sign and I ended up in the ER. Sick.

no offense, but i was expecting "i got rocked" and a trip to the hospital to show a little more than a couple tiny scrapes and a bump. looks like you fell off a bike.

My knee was badly tweaked, my neck is super stiff and sore, and my ankle is most definitely sprained... None of those are all too visible. I'm going to the doctor tomorrow to see if I have a bone bruise on my hip.

Either way, I'm extremely lucky to not have broken anything or worse off been killed.. I'd show you guys my bike, but the police took it since it wouldn't fit in the ambulance I guess.

Why would you waste your time going to the doctor to determine if you have a bone bruise? Even if you do all he'll tell you to do is to take it easy, ice it, and take Advil. Unless you're getting an MRI to see if it's fractured I guess.

a doctor's confirmation of injuries in a medical report = bigger payout when it comes to insurance payouts for medical bills / pain and suffering / etc.

i had a hematoma on my thigh, not as bad as yours but its still raised from the scar tissue. so im sure yours will be too

ER doctor told me to see my primary doc within 2 days. I'll be seeing one within 5 since I'm out of my "home" area since I moved last summer and never updated my location in the system (since it's a pain in the ass to do so and I simply didn't have time.

If you're going to sue, maybe. A bone bruise isn't something an insurance company is going to dish out cash over.

It's extra time lost in recovery that they'll have to dish out for.

If I had broken something i'd be getting a larger payout obviously, but at this point I really just want my property damage and time missed from work compensated for. Throw in pain/suffering/whatever else and hopefully even with insurance lowballing i'll get something that's fair. Nobody wants to go to court if it's not necessary and I'm not asking for 100 grand here.

Not add insult to injury, but that isnt a simple nor a quick process at all. You're looking at a few years before they'll even consider tossing some money at you.

not necessarily true. I'd estimate about a yearish to payout if he has to sue. If he settles up with their low ball offer, it'll only be a month or two. At least that was my experience.

my roommate got taken out off his moped by a car in the summer of 2011 or 2012 and just got his settlement money a few months ago. obviously, every case is different depending on the the state, the insurance company, the details of the crash, the lawyers, etc, etc, etc... but just throwing that out there.

I work with guys that represent the insurance companies on cases similar to these. So many documents have to be filed, followed up by depositions of the parties involved, etc. Takes a lot of time.

I'm not exactly in any rush here... and I'm not going to settle for peanuts. This isn't even about making a crapload of money to have a massive shopping spree party with... this is about making sure I'm protected if I have any complications later. Who knows. My hip could have massive scar tissue growth that limits my mobility for the rest of my life... I could have damage to my rotator cuff or a muscle tear in my neck or shoulder that won't ever heal back right.

This isn't about a quick buck, it's about having a sort of fallback protection if say, I have to go to the chiropractor on a regular basis, or have surgery in the future if my shoulder never returns to normal, or if something else comes up that I didn't even know of.

keep moving the hip to prevent scar tissue build up

13390196:DingoSean said:
Yeah, right now I'm not exactly feeling like doing that haha. Maybe after a couple norcos kick in.

Yeah anything helps though. I kept my leg straight for too long after my knee surgery and got some scar tissue build up. Having a physical therapist push your knee in to bust through scar tissue is no bueno

Damn bro thats shitty hope ya heal alright. at least u got those A's to look forward too soon. We gonn have a buncha good match ups this year

sorry to hear Op. i think you should press charges though - people like that need to have their license revoked. it's somber to think about, but you could have like ... been killed

You know, this shit happens to anyone. We've all run a stop sign. This time, she hit somebody. She'll remember it. Pressing charges will only be frustrating to me. I'm not trying to gain, and I can't get her license revoked - that's the police's decision.

No, but nobody on a bike expects someone to run a blatent stop sign and plow into them. So there's that.

Idk how you took me thinking I could get hit when I am riding on the road to expecting everyone to see me. I obviously am thinking no one gives a shit, and thats the problem.

lol I can just take what you quoted and go one step further and call you a complete fucking idiot. Workplace or not, if theres someone operating a machine thats moving towards you, you make eye contact. That's at red lights, stop signs, crosswalks, construction sites ect. Because if you don't, and by no means was I calling op an idiot, you might end up in a situation a hell of a lot worse.

Heal up op, hopefully you can get some postseason in once your swelling subsides. I've ended pretty much every one of my seasons early and its super shitty.

do you even read what I post or just prop hunt? Word for word said I wasn't calling out op, just made a general remark that I left open ended. Even if you aren't one of them, people do change. Maybe day drinking isn't your thing after all.

I wouldn't say the word idiot, but he has a good point. When you're on a bike and you're around cars that can very easily kill you, you have to be much more vigilant than the driver. worst case scenario as a driver you go to jail or get sued worst case scenario as a biker who is much smaller and harder to see you can could get killed.

Same thing with motorcycles on the freeway, when you're on a motorcycle you're never supposed to be in a car's blind spot, because they can merge right into you and kill you. defensive driving while driving a car super defensive driving while on a bike.

Get a lawyer asap bro!! the same thing just happened to me, granted i was in a car. Woman ran a stop sign, t-boned me and sent me thru the garage of a house. totaled my car, the houses garage and i missed weeks of work. Insurance settlement seemed decent but i went to a lawyer just to see, and there are an insane amount of hospital bill/insurance loop holes that you will be responsible for if you take the insurance settlement. In my case, if i took it, i would be out over $7K with no legal recourse to get it back. Seriously, do not even consider the insurance settlement.

hope you heal up!

Of course you have to be vigilant. You're super exposed because you don't have airbags and crumplezones surrounding you... but I don't think any cyclist who commutes on a regular basis, or who has ever heard of any horror story involving a dead cyclist would ever even remotely consider that they weren't in some form of harms way while they were riding where there are cars containing drivers who are texting their BFF's about what Johnny said to Kate last night and OMG.

Yeah. I wasn't wearing one. I usually never do unless I'm going very far. In this case I was coming from somewhere 12 blocks from home, and in a residential neighborhood. Not a busy street. I rarely even encounter many cars in that neighborhood in the first place at that hour - especially on a Monday when people are sleeping or netflixing.

I probably still won't unless i'm riding on crazy busy streets or carving up some mountain downhill roads... I'll just be more aware of people sucking at driving from now on.

honestly tho I hope you heal fast. Being out of commission for anything fun sucks even worse when it's not your fault in the first place.

so you were riding at night, in the dark i assume. do you at least have a light on your bike?

13394886:ElGato said:
I ride my bike often in one of the shittiest cities to ride a bike in and have gotten hit by 2 cars that were absolutely, 100% completely out of my control. One was a guy completely running a stop sign like this, I saw him, tried to swerve, was hit. The second I was riding in the bike lane and the car drifted and knocked me off my bike. Saying that someone needs to be vigilant or whatever is a total given. There are frequently times when you're just fucked, from what Sean described this is one of those times. If you're going 20-25 MPH, respecting the law, and some bitch decides to run a stop sign, you're fucked.

You clearly don't know what defensive driving means. You should assume that every car will run a stop sign, and while biking everyone can't see you. if you do that the accident would have been avoided. Just like with my example if you're a motorcycle assume that every car is about to merge into you so don't get into the blind spot.

13394984:ElGato said:
Yeah man you're totally right, if you stop at every intersection and every green light you'll be much safer. In fact, it's probably best to just walk and roll your bike alongside you on the sidewalk.

If you dont like it buy a car, if you don't see a car slowing down assume it won't stop. you won't get hit

I live in Montreal and got a small incident today. I usually bike in the bike lane, but when there's none, I ride in the car lane, like I'm suppose to. Today I got it by a car because he was texting and he was doing a american stop, when someone don't fully stop at the stop sign, nothing major happened but the guy gave me shit because I wasn't on the side walk.

I don't have a car anymore because I got it by a bus who pass on a red, no more car and got a big concussion, can't do any sport, nothing, even had to cancel some classes at the Uni. So now each time I'm rolling, whit my mom's car or whit my bike, I look everywhere and try to be careful, but sometime there's nothing you can do.

13395090:ElGato said:
Or I can just choose to obey simple traffic laws when I drive and not hit any cyclists. Share the road, motha fucka

Which again goes back to my point that you're much slower and smaller than a car, so sure go on the road but be more vigilant what you're basically saying is other people should look out for me to protect me, not how the world works.

No. Fuck that shit. People should look out for all cyclists and pedestrians, and really, anyone else who shares the road in any fashion. Otherwise, they're going to get fucking sued if they kill somebody out of negligence and the lawsuit exceeds their policy limit.

It's not my job to expect cars to just not give a shit about the most fundamental laws of the road - IE: fucking stopping at stop signs or staying in their lane, or checking their mirrors for cyclists before they open their car doors when parallel parked, or when merging from the situation.

The amount of times I've had to, or seen others have to swerve out of the bike lane because some idiots can't check their fucking mirror to make sure this kinda accident doesn't happen is fucking out of control.
