Just got arrested- a few questions

i just got a MIP for alcohol, the cop searched me and my car without consent, but he saw the alc. in my hand before he searched me anyways. is there any way i can get out of this? i also dropped the alcohol beforei talked to the guy.

ps. im still drunk
 
if you were holding alcohol then you were possessing alcohol. thats what the MIP (minor in possession) thing is for. the search or whatever else is irrelevant if he saw you with booze. ive gotten one of those and they are usually really cut and dry.
 
Hahahaha where do you live that a cop will charge you with MIP??

Seriously, that's unheard of to me. Getting a fine for having alcohol?? How do you guys have fucking parties?
 
ya i live in a suburb of boston. how does having alcohol in my hand give them the right to search my car though? but that doesnt even matter. so basically, im fucked then?
 
You aren't 'fucked' you'll have an araignment and some fines. Depending on your city you might have to go to random Breathalizers and possibly an AA meeting...not too much worse. The 2nd one is much harsher.

at least ur not in NH. Some kid on my soccer team went to jail for 21 days for mutliple offenses. Usually if u do diversion is wont go on ur permenent record.
 
what about this? they didnt read me my rights untill i was at the station, about to leave with my parents (i had been un cuffed for a while at this point). is that legal for them to do? is it enough to get the case thrown out?
 
you got an MIP whats the big deal?!?! you just have to pay a small fine and your good to go, its nothing, at least you didnt get a DWI.
 
Well not readiny you your rights gives you some stuff to fight with.

but you did have alc. in your had wich then gives them a right to arrest you wich gives them a right to search you and your car.
 
your a minor. the rights dont fully apply to you man. live with it. your a kid. adults have rights. not kids.
 
dude why are you asking a bunch of 14 year olds about rghts? maybe you should go do some research yourself, hell maybe even get a lawyer if your that concerned.. but at the end of the day you were breaking the law and got caught, man up and face the conquences. If the cops did something wrong with arresting you or searching your car you might be able to get repariation for that but they still have a solid case for you being in possesion. Im not from the us but Id imagine something like that is only really gonna affect you while your underage. Most employers or whatever will probably just put it down to being young and stupid, like Im sure they've all got drunk underage before too.
 
So a friend of mine got a MIP a few years ago, he pleaded "no contest" in court, and went without his driver's license for a month. I don't know about the searching, the cops just saw him in it when he was rolling up to camp on his skateboard (they were campin' on the beach and he was riding over to his truck) and he set it down, but yeah, still saw him with it. I don't remember, but I don't THINK he had to pay a fine... anyway, yeah, sounds lame.
 
One time a couple of cops searched me when i had a bottle of vodka in my sweatshirts pock, i told them it was for my dad and they let me go.
 
hahaha wow, asking the wrong group of people...luckily someone, being I, have some crimal justice classes under my belt (haha ohhh claim)

anyhoo, A) you dont have to be read your rights until your being questioned, they could not say shit to you till you got to the station...they do that all the time actually

B) As a minor, they can charge you with an MIP if you have even a drop of alki anywhere near, aka empties that still have a little inthe bottom...yeah that, they can charge you with "residual alki" (yes yes, even if you have a giant bag of bottle returns, still can getcha)

C) MIP and CONSUMPTION are different things, you should be lucky you only got MIP.

D) As a minor, your pretty much fucked, its going to cost more for a lawyer then the fines will be, mine was 100 bucks after i went to court and pleeded guilty

E) MIP's don't mean shit, my friend has 13 of them right now and yeah....

F) I bet the first one you get will be dropped, something like 90% of the time it does, just show up to court looking nice, be polite, and don't try to BS your way out, the judge will prolly be alot nicer to you
 
It does where I live. I just got a ticket for drinking under legal age like 3 months ago. Fuckin cop searched my bag in a park and found it. Something about the "liquor control act" . I fucking hate cops
 
that doesnt answer the question, but from what youve all said i guess theres no way out of it unless the judge is a cool guy
 
just take it like a man. if you're under 18 then it won't make it on your record. if you're a 1st offender, they might cut you a deal. but you're not geting out of it. if you go to court, get an lawyer, and NOT a public defender. you'll be happy you did in the end. or you can do what i did and just move to Scotland right after you get busted. here we can drink at 18.
 
my parents wont get me a lawyer, so thats out of the question. i guess im stuck with the one they give me. how bad are they?
 
its just an mip. all that will happen is you will get a fine and take a youth alcohol abuse class. its not horrible. just costs money.
 
Dude its a fucking MIP, I dont know how old you are but if you are over 16 and you make yourself look presentable in court. and speak well, and just be straight up with the judge you will probably end up needing to make a donation to a food bank or something. my buddy has like 6 and he just made a foodbank donation each time (the amount obviously increased with each violation). but seriously a MIP charge is much different than getting arrested.

not sure how similar the law is to Canada's, but in Ontario if you commit a liquor offence (whether it be minor in possession, open liquor..etc) in a vehicle, the police can legally search you, the passengers and the vehicle for the liquor/beer only...and if they stumble upon anything else you could be screwed.
 
You're fucked, but an MIP in Montana anyways is no big deal... You go to court, they generally slap down some community service and some bullshit alcohol education course you have to go to for a certain number of hours, maybe a small fine depending on the circumstances, and that's all. Pain in the ass, but livable.
 
I got an MIP, had to do 24 hours of community service, got suspended for 2 football games, cant letter this year, and now im not getting accpeted to do any extra-curiculars, it sucks a fuck.
