story: a couple of my friends go out to a party i was supposed to go to but i was skiing, which is my anti-drug, they get trashed (kid driving had license since november) and so the girl they were with whose 15 took the wheel and blew a stop sign and got called out on it by a cop, she quickly changes seats with the original driver whom gets owned by the breathalyser and sobriety test (he said the breathalyser was fixed) so the cop tries intimidating him and says that he gets his license taken away for 3 years 15,000 dollar fine and all this other bullshit. this happened in Mass. legit? or non legit?
 
well, every crime has a maximum penalty, which for a DUI could be 15,000 dollar fine, suspended license, a year in jail. etc. The cop was probably trying to scare you, but he has no reason to exaggerate DUI consequences, your friend is going to get fucked if he doesn't get a good lawyer, and even if he does, he's still probably screwed.
 
not sure about the DUI thing but the chick was mad lucky... my bro lost his license till he was 21 because he got caught going 38 in a 25 when he was 15 years old. had a real expensive lawyer too.
 
he shouldnt have switched spots with the girl, after all she is the one who decided to drive the car, so either the girl got punished for something she actually did, or the kid gets in trouble for a dui that he didnt do. But I dont see anything that the cop did that could be rendered bullshit like you say.
 
I think the law depends on what state your in. but it very well could be that high. For reckless driving, you can get like a month and 5000 dollars. my friend almost got that, he was just seeing how fast his car could go >.> and then took out a Wall-Mart fence haha
 
might have been better off not switching drivers back, but whatever. I think he was giving your friend the extremes. As in, it can be up to 3 years, and up to 15,000, not a specific punishment for him. So i wouldn't call BS on the cop, but he is definitely trying to scare your friends
 
yeah he was talking extreme. u would get that if u got in an accident or if u got caught more than once
 
0.08% blood alcohol content if you've got your full lisence is illegal, those things can pick up the alcohol in the mouhtwash you may have used earlier on, and I'm assuming in the states if you don't have your full license any alcohol in your system is illegal while driving.

so basically you can't cheat the breathalizer unless you don't blow in properly and claim harassment
 
wouldnt it be better to get charged with driving with out a license then getting a dui and everyone else that was drinking getting an underage? haha
 
Our family friend who is a lawyer told me if i am every driving and i get pulled over and i know i am over a .08 BAC then i shouldn't blow... the cops will then book you with dui and take you back to jail were you will serve the one night call your parents all that bs.... but then you take it to court where the cops have no proof you were dui cause u didn't blow or give blood.. which then your charge is reduced to reclesse (sp) driving... happened to my sisters and hers got reduced...
 
I didn't phrase my last post well. I meant, what kind of offense(s) are needed to have a court ordered breathalizer in your car? (Where you need to blow below a certain level for the car to start)

You're right about the .08, unless your under 21, in which case I believe you can be charged if pretty much anything registers, although I'm sure at a certain level it would just be dismissed in court.
