Last night at 11:55 i was out on a corner waiting for a friend. He flys past us and yells cops! I sit there and wait. I Have a fake id in my back pocket. My friends being nervous keep putting there hands in there pockets after repeated times they were told not to. He took our names and asked if we had any type of misdemeanors or anything. I told him about something that happened a while ago. He could coming up to me and shining the lights around to see if we threw anything. Could he have pat me down?Like what circumstances does it have to be under.

It was real weird, alot of shit happened that day.
 
^ You shouldnt have said anything except whats the problem, I am waiting for a friend. Where were you standing? Cops can't just stop in front of kids standing... but it was a little late and your friend went "flying by" in what? Details buddy your story is a little... "tard" lol

I was like were waiting and he was like your curfew is on in a few minutes and got out.

Apparently theres been tons of car break in's and the neighborhood hired this cop.
 
you skipped like 4 steps to the story. You went from your friend yelling cops to you not putting your hands in your pockets because you were instructed not to.

I don't really know how to answer your questin unless you give us the details. Did he stop for a reason? why did he start questioning you? did he find anything illegal? probabble cause? we need to whole sotry dude.
 
i am the master of what cops are allowed to do to you. if he had no reasonable doubt to pat you down then he couldn't do it. and he would have had to state why he wass searching you first. and he couldn't hold you if you were not under arrest so theoretically you coulda walked off at anytime. you shoulda said something like, "Am I under arrest?" "No" "Am I being detained?" tecnically they cant detain you if you aren't under arrest
 
I dont know, I'm pretty sure its pretty easy for the cops to be allowed to pat you down. I know they need probable cause, but if your a minor its really easy for them to make something up and get away with it, im not sure how old you are, but when its a cops word against a young teenagers you pretty much have no chance
 
In Canada you can be searched without reasonable grounds for an arrest, but articulable cause...similar to suspicion, but there has to be other circumstances present (ie..were you in an area that had recent break-ins??)....also, all the officer has to say is he/she thought you had a weapon and they were searching safety.
 
He can pat you down for his own safety. It is called a stop and frisk, but the thing is that he can only take out objects that resemble something that could be used to harm him. So if he felt something that resembles a knife or gun he has the right to take that out but other than that you would have been fine.
 
Around here after curfew they just stop and ask you where your headed and then either tell you to go there and straight home or give you a ride home, no searches or any of that styuff
 
Well the cop has the right to ask for id. But, unless you have not done anything wrong wrong, and you dont see the purpose, you don't have to give you id.

For the search, a cop does not have the right to search you unless he has visual proof of a illegal object. Like you haven't done anything, the cop should have stoped you in any way.

If the cop askes you anything about your history, the safest bet is to say nothing at all.
 
look suspicous is a good reason to search a kid. if the cop thinks the kid has it cause he is standing on a corner, i believe thats a good enough reason. a cop can stop and ask you what your doing, hes a fucking cop. he can drive on your lawn if he wants and do donuts. dont question authority. just if you got weed, thats your fault man. i'm being a hypocrit cause i carry weed at times but i know the threat of getting pulled over. don't write a check your ass can't cash
