is anyone else scared shitless of this moving closer to a complete police state in the united states? this is nothing near democracy, it is giving one person power that i dont see him fit to have

For those who don't know what it is, here you go:

This new Department of Homeland Security has the power to wiretap any American it wants, without a court order, without cause and without justification to any higher authority. Homeland Security goon squads will have the power to enter any American home, without a search warrant, without probable cause, simply because someone somewhere says “hey, this guy might be a threat.” No checks and balances, no due process. Nothing

They plan to erect video cameras on streets, along public highways, in neighborhoods and deploy them on helicopters and police cars to record everything you and I do every day of the year.

A secret court decision last May already gives the Justice Department expanded powers to wiretap phones, spy on Americans and “share information” with other law enforcement agencies.

They include provisions to allow private citizens to spy on other private citizens without fear of prosecution if the Department determines their actions were conducted “in the national interest.”

Under the new law, an agent of the Department of Homeland Security can walk into your bank, flash a badge and demand to see your checking and saving account records. No court order. All they need is the “presumption of guilt.” They can stop you in your car without cause and search it and you. They can hold you in jail for 30 days or more without filing any charges or allowing you to make any phone calls.

They can call up America Online and put a trace on all your Internet activity without a court order. They can require Visa to turn over all your credit card activity records without notice.

that is exactly the stuff that scares me. i really do not see how people can cheer on bush as the champion of anti-terrorism. all he is slowing down is diversity, and that is one thing this country was based upon at the time of its conception. what ethnicity do you think the vast majority of these people in question will be? surely not caucasians, because only people from the middle east will launch anti-american attacks. this will scare people with any information into a hole that the bush regime will drag them out of, if the hole even exists

im going to try to contribute to an inteligent conversation by writing one of my many conspiracys, this stuff that the homeland security department can do has already going on, just think about it, im on not going to name names (NSA), but its definetly been happening prior to the homeland security departments establishment

HOmeland security is terrible. It completely goes against everything that this country is supposed to be, however, due to the Elastic Clause, they can do whatever they want.

Also, after 9/11, people are scared soo much, that they are willing to do anything to make themselves feel safer. Even tho, I don't think Homeland Security is much protection anyways.

Whoa...slow down fellas. Now you are equating Bush to Hitler? Take a second and look at what's going on.

We have a state in this country where people are getting scared, maybe it's not very grounded, but people ARE scared. This stared with 9-11 and was exemplified with the sniper problem. We have a lot of freedoms in this country, but personally I don't mind some extra security measures (you don't think the government can't tap into everything you already do?? Come on, don't be naive).

More security at airports...terrific. I feel better getting on a plane than I used to. Stricter customs enforcement when people come into the country....fabulous. I'm not saying that we need a total shutdown, but I have no problem with 10 extra minutes on occasion.

Also, a lot of you are pissed about Bush not doing anything about the economy. Don't you get it that economic and physical security go hand in hand? During the sniper attacks, people were scared shitless. The ecomony in the greater DC area was hit HARD. When people don't feel safe, they don't spend, and the economy suffers. Simple as that.

So before you get your panties in a bunch over making our country a little less free for those who may cause harm, think about what is really going on. Unless, you have something to hide?

I agree with you and Franklin's quote. However, I do not believe that we are giving up a fundamental liberty. Nor do I believe that our impecable forefathers (or anyone) could have had the foresight into what has become of our world. If that quote also always held true, it would apply to total freedom during wartimes...in which total freedom needs to be lessened for security.

I don't want to loose my freedoms, but I also like my life. And at this time, there are those that would like to take that from me and you because of where we live. Right now, I do not wish for that to happen.

 
Did you just try to say that our forefounders didn't have a clue about terrorism or military conquest? Let's not forget that Benjamin Franklin was alive induring the period of intense fighting and violence of the Revolutionary War. Surely you cannot try to say that they knew nothing about a violent and hospitable world.

I think our founding fathers did lack a lot of foresight into our nation as it currently stands. And before you even made a point about it mentioning the elastic clause. If they would have known that a situation such as this could have existed, they wouldn't have placed the elastic clause as they did.

 
The elastic clause was put in on the premises that the natural checks and balances on governmental power would balance out any rules or ideas that were harmful to the ideals of the constitution. Essentially, some of the policies of this new Homeland Security plan take out a number of the checks and balances leaving a heresay and finger-pointing form of incrimination. Essentially, this renders the elastic clauses purpose completely and totally pointless.

I think everybody is having a good discussion, but just so those of you worrying about having your rights taken, the Homeland Security Act as passed by Congress does absolutely nothign to directly impinge on your rights, unless you are a government employee. The things you are debating (more relaxed premise for a search, detaining without charges, removing due process rights for certain criminals etc.) occured as a result of the USA Patriot Act passed in October, 2001, the intenet of which was basically to remove civil liberties to make it easier to pursue terrorist suspects. The Homeland Security Bill, passed last week forms a 170,000 person cabinet level unit (meaining under the control of only the President, and basically includes the Immigration Services, Coast Guard, and a bunch of other agenices that are in some way linked to National Security, as well as enhancing information sharing between agencies like the FBI and CIA and local law enforcers. The Constituional knock in it is that obviously its giving way too much power to the executive to basically control our security as he sees fit, but since the Congress and Courts seem to be rolling over to him in this situatuion, it seems there is very little that can be done to try and maintina an appropriate balance of powers at this moment.

The harms to your rights that you guys were tlaking about are very very valid in my opinion, and I find them extremeley disturbing to be happening in this country. However, its just going to hurt our chances of fighting against the injustices if the general population is not clear as to what is happening to them, so thats why I wanted to clarify that these thigns are happening, and happened over a year ago in the Patriot Act, and not last week in the Homeland Security Act.
