It matters because the cornerstone of the legal system is the idea of innocent until proven guilty, red flag laws enforce kangaroo courts that are in violation of the 2nd and 4th amendments.

I’m not trying to throw fuel on this fire but I’m fairly certain that, if you give me enough time, I could go out and buy a gun without any checks or paperwork. Hell I could probably jump on armslist now and get one today. That is the very real limitation of any sort of control on FFLs

I'm not really sure your point, the black market will always exist. In colorado it is illegal to make private transactions without an FFL perfoming a transfer with a 4473. Other states that don't require an FFL 4473 transfer requir the private seller to remove reasonable doubt that the customer can legally own a firearm, and the knowledgeable sale of a firearm to someone who cannot posses one legally is illegal as well.

I mostly was trying to point out that the 4473 only goes so far. The only time I’ve seen people get worried about it is if their name is tied to a firearm they bought from an FFL aka they’re legally responsible for it. Due diligence when selling is not observed as explicitly as one would hope.

I think most states should be like CO laws.

That's kinda my point tho, the 4473 and nics is fallible and not a crystal ball that can eliminate wrongdoing, and poor discretion during private sales whether due to negligence or intention is near impossible to police. People for 'common sense' firearm laws are often either unaware of current firearm laws, or are unaware of 4th, 5th, and 6th amendment of the constitution that protects people from illegal search and siezure, self incrimination, and provides due process of law.
