Gnarly-ass Injury (pic not for the squeemish)

I think you should consider legal action here... If the resort is negligible then by all means go for it. I am sorry but what happened to his leg should not happen in a park based on how he is describing the incident.
 
I dont mind seeing these injuries at all but the only problem with me seeing them is sometimes my brain decideds to think about them right before i hit something so i was staying away from this one for this specific reason but decided to click on it to find it to also be my home mountain and i was in utah this past weekend and heard about this new dfd and was very excited to try it out.... till now hahaha but heal up man hope everything goes good

But really I would probably just ask for a free pass next year because that should never happen, I'm assuming its the DFD on the right side of the alley which is a pretty gnarly rail, but i've never seen anything sticking out of the rails, Park Crew keeps everything in pretty good shape.

That;s the problem with the legal system in the states. Some one makes a mistake and you try to make a buck. If it was to pay for your medical bill that i can understand but now you see an chance to make a few bucks from some ones oversight. pathetic
 
Please don't sue. I hate how fellow Americans get hurt and then try to milk the system for as much money as possible. Riding terrain parks is inherently dangerous, and suing will discourage them from setting up banger parks.
 
And semi off topic, anyone who thinks the waiver protects the business from getting sued is dead wrong. A lot of businesses with waivers get sued and lose all the time. Business law 101
 
So if I could spread some light on this subject id like to say two things 1 you are a scholar and a prince for being so chill about this injury. It takes a lot to go against ur dad when he wants to sue especially at 17. 2 this injury could not be from a nail at all. Due to the mobility needed in that area of skin it is a bit fragile. It can tear very easily. Thats why many injuies of this type are diagonal like you see. The skin likes to split across the grain. Tho its unlikely an impact could do this damage hut it would also break the patella in the process like you did. Also if the patella broke in the right spot it could have cut out ward. Good luck recovering. I had a similar injury myself on my left knee from a waterslide they actually heal very quickly

If you sue

1. You will get mad shit from ever park guy in the world, cause you know word spreads fast.2. You will loose, those big mountains are owned by big things, they have a army of lawyers, and many ways to counter a lawsuit.

3. Its not like it was the mountains fault, and over all parks they have warnings(another reason you cant sue)

4. Be the cool guy, and show off your scar in the park, chicks dig dat.

5. To sue anyone without a legit reason is stupid anyway.

The cut is as deep as it can possibly be on your knee cap. Doctor says whatever cut me may have also caused a fracture on my patella.

So I got 20 stitches and I'm out of action for two weeks, which isn't so bad. Now I'm 17 and my dad smells a lawsuit. I think it would be kinda gay, mainly because I ski park and hit urban and stuff, full knowing that shit like this can happen, and I wouldn't wanna be the little bitch that sues 7 springs terrain parks.

On the other hand, rails at resorts probably shouldn't have nails or screws or whatever was sticking out of them (it was a single barrel, so it's not like the rail cut me) that could seriously injure people like this. Just think if this cut my femoral artery....I may have been totally screwed. My ski's edge didn't do this either, they're way too blunt.

So what do y'all think?Has this happened to you guys before? Is it rightful to try to sue somehow and get some $$$$$, or should I tell my dad to tough it out? (which I personally think is the right move)

Sorry brotha- I did the exact same thing about a week ago, but not nearly as badly as you did. Stuck on the couch for now and it sucks. As far as a lawsuit, I don't think you'll get any traction. Not sure what the ski laws are in PA, but to my knowledge, in CO once you're working with "Freestyle Terrain", you're pretty much on your own in terms of legal liability. Good luck recovering!

Damn man. That sucks. I’m sure you’ll recover fast enough, mine was actually way more minor than it looked. And haha fortunately this happened about 8 years ago now. My knee healed up just fine though I certainly still favor the other leg a bit.

As far as a “lawsuit”.. god what the hell was I thinking. I was probably just pretty pissed off that my own flesh would rip so easily. And 17. Although multiple people even fellow park skiers told me they thought I should try and get some money from this somehow lmao

That being said.. suing the Nutting family and winning somehow wouldn’t be the worst thing in the world lol. Bastards.
