Gnarly-ass Injury (pic not for the squeemish)

So I was skiing this past Friday at 7 Springs (home mountain) and I was lapping a park with a DFD in it. I had hit the rail a bunch of times throughout the day and the rail and everything else was in prime condition. So on one lap, I slipped off the rail early and my leg rubbed up against the rail. I pulled up my pant leg and...................ah noice there's my patella! (picture below)

The cut is as deep as it can possibly be on your knee cap. Doctor says whatever cut me may have also caused a fracture on my patella.

So I got 20 stitches and I'm out of action for two weeks, which isn't so bad. Now I'm 17 and my dad smells a lawsuit. I think it would be kinda gay, mainly because I ski park and hit urban and stuff, full knowing that shit like this can happen, and I wouldn't wanna be the little bitch that sues 7 springs terrain parks.

On the other hand, rails at resorts probably shouldn't have nails or screws or whatever was sticking out of them (it was a single barrel, so it's not like the rail cut me) that could seriously injure people like this. Just think if this cut my femoral artery....I may have been totally screwed. My ski's edge didn't do this either, they're way too blunt.

So what do y'all think?Has this happened to you guys before? Is it rightful to try to sue somehow and get some $$$$$, or should I tell my dad to tough it out? (which I personally think is the right move)

 
Thats a crazy cut!

im pretty sure you sign away your rights when you have the pass/ticket on you, that way the resort isn't liable if you fuck yourself up.
 
That is indeed gnarly..and I understand about your position on the law aspect of it...I probably would be against too. I think you should go through with the suing though because your right...that should not happen.
 
Well yeah see the other thing is it's kind of a mystery as to what cut it. There's a tiny hole in my pants like from a nail or something, but then my friends went back to the rail and said they didn't see anything that would have cut me.

The ski patrol people were SUPER inquisitive as to which rail and where on the rail. Park crew grinded off all the screws after I got slashed? hahaha purely hypothetical but who knows
 
definatley this. 1. you don't want to be one of those dicks who sues just because something minor happened to him. Unless you really need the money in order to pay for medical bills i would say no.

2. It would RUIN your reputation as a cool guy around the place and you would most likley be treated like shit there for a long time

3. the lawsuit could end up with the closing of the terrain park, and why would you want that
 
After seeing this I am going to poach the alley dig that bitch out and melt it down for scrap. I fucking hate that rail.

And dont sue, Bob Nutting will in fact win and your family will end up living in a shoe because that lawsuit would go on for years and cost entirely too much.

I doubt they'd close all the parks though. I mean maybe if I died or something.

At the same time, it wasn't like I was at some urban spot somewhere. Like I can't believe a ton of other kids didn't get cut like I did

Did you slam into the single barrel really hard or just nick it? While unlikely, a blunt impact could POSSIBLY cause a cut like that (kind of unlikely.)

I wouldn't sue. Chances are you probably aren't in any kind of financial crisis from this, and you will most likely be out skiing again in a few weeks.

Besides, who knows if you would even win, and you would be seriously disliked if you tried to sue ski hill.
 
If you sue them because you fell off a rail i will wish nothing but pain and suffering on your entire family.

The fact that youre even considering it is fucked.
 
Explain to them that you don't think its the right thing to do granted that:

1. You know skiing park is inherently dangerous and freak accidents do happen

2. You aren't in any kind of financial/life distress b/c of this, and suing would just be taking advantage of the system.

3. You probs wouldn't win anyway...
 
Was it a bolt that holds the skirting onto the rail? Not sure how 7springs does there skirting but if they bolt it on it was probably that.
 
Actually, take that back. Try and sue em and watch your dad get his ass handed to him in court.

Like you said, you ski park knowing full well the risks. Enjoy your new scar and dont be a bitch
 
do this. just because I'm sure you can. see if they can hook your whole family up with seasons passes for next year or something. or if you're a real smooth talker and think they'd be scared of getting sued, see if you can get seasons passes for life..

but don't sue. that's just being a little bitch.

also don't try and milk them if the hill isn't doing well financially. only if they're doing really well. no harm in trying at least. you wouldn't have anything to loose like you would in a lawsuit.

yeah a little settlement like that would be sick. even though I still doubt I'd wanna get involved in dealing with it
 
That could easily been caused by bashing on a non-sharp object. If you are going to be fine in two weeks, why would you sue someone for allowing you to huck yourself down their mountain with rails they made for you? Do a bit of research first - if you go back and find there is a huge screw sticking out of it, then go ahead and have them pay for everything. But, it isn't like some huge negligence that caused you to never be able to walk again.
 
i would go talk to management and tell them that you wont sue if they go through and do a full inspection of all the features to make sure that there are no potential things sticking out. and maybe try to talk your way into a pass for next year "because of the time you are missing from the injury this year." i wouldnt go beyond that, because ultimately you did accept the risks associated
 
thats what they want you to think, and how it should be. But this is MURICA where you can sue anyone for anything.
 


Well, if you have a season pass which i'm assuming you do because springs is your home mountain you cant sue them. On the back of the pass it says "You may sustain serious injury or death while engaging in skiing, boarding, tubing and other recreational activities. Use of this pass confirms your agreement not to sue Seven Springs or its employees or owners" and you also sign a paper when you buy the pass that basically says the same thing. Just throwing that out there.
 
That's gnarly! Heal up man. I work park crew at Mountain Creek and I came upon the most disturbing rail damage one day. It was on a progression box which means lots of falling. I guess a cat hit the side of the rail and put a huge chunk. It was pretty fucked that the morning crew did not see this and I came upon it on our first run... Shits crazy while riding park you should not have to worry about the condition of the rail just executing the tricks.
 
might not be anything wrong with the rail at all. i did the same exact thing 4-5 years ago. same spot on my knee and everything just not quite to bone. basically what that doctor told me is that if i bash it hard enough (i hit it right on top of the rail) it can just split clean like that. still not sure if i believe it...
