but im really great in math. i could go to MIT i guess, but i really feel like i should go to juliard. its not really my fault that i wasnt born pre-disposed to be a musician. i mean, i can get a great education elsewhere, but i really feel like i should be entitled to go to juliard. because i want to.
my point with the stupid analogies is this: there are a lot of things that we can or cant do in life due to who we are. i cant get the type of admission breaks to law schools that minorities get. i cant go to juliard because im not a good enough musician. i can, however, get a comperable education in some other subject that will do just as well for me in life.
homosexuals should get, as a lot of you put it, the 'rights' to things like hospital visitation rights and being included in their partners will, and whatever else is being discussed. this does not mean, however that they are entitled to 'marrige' just the same as im not entitled to check the box that says 'latino' on my law school applications.
my real problem, however, with this subject, that goes beyond gay marrige is that of judicial activism. if judges wanted to legislate law, then they should run for congress. When a law is passed by the majority of the people of a state or a nation, it is objectionable to me when one judge inserts what he or she might consider to be their 'superior' will. Unfortuatly for them, we are not living in a platonic society, where there is a tyrrany of the upper eschelons of society.
judges need to enforce the laws that are passed by the people. if the judiciary really did their job, then they would serve as constitutional constructions, and declare laws unconstitutional only when they actually are, in light of the literal wording of the constitution. the problem with judicial activism is that the vast majority of judges who practice this method are porgressive in nature, and who love nothing more than to assert what they see to be their superior will on the people who apparently dont know any better.
this whole phenomenon goes further than just the gay marrige thing, but its a prime example.
