Ganja charges in Utah Advice needed ~! Park city Area

if you consented to the search there is nothing you can do (never consent to searches). IF they saw weed in your care then they had probable caused and there is nothing you can do either. However, If they just smelled weed that might not be probable cause in your state, or if they just had a suspicion and searched you car without your consent that is definitely not probable cause and your case should be thrown out.
 
yeah they do, and if the lighter has any trace of bud on it(resin, pollen etc.), it can be paraphenalia.

regardless, you arent doing any time, and its not gonna be a felony. no real long term consequences.
 
I come to seek NS advice/experience too. Last night i was with my friend just chill in in my car he was rolling weed and we were both fairly tipsy and a cop rolls up breathalizes us finds the little amount of weed and my keys weren't in the ignition so I'm pretty sure I'm facing underage drinking and possession. and i know i should get a lawyer and stuff but does anyone know what I'm facing? i hope not license suspension. its my first offense

Soo last night I got arrested for whatever they call It when a Minor is drunk in public, obstruction of justice, and possesion (a pot brownie) in Pullman, Washington. Any ideas on what I'm gonna face???
 
I got an MIP/Possesion of MJ/Paraphenalia charge in washingotn state....so i know what it's like.

you're going to end up paying ~$1000 and have to do a drug/alcohol evaluation. you will be drug tested. get a lawyer.

most likely won't do jail time but you will get probation, your license probably won't be taken away.
 
when through the same shit in ny about 10 months ago, we were at a bar on a Wednesday night like we do every Wednesday night listen to a jam/rock band instead of walking around the city like we always do, we decided to light a little j in my car, as soon as we get out 10 cops and at least 5 cars come flying out of no where and bust us, after being threatened and lied to and thrown around by the cops (I'm not going to bitch since we were being stupid for doing in a parking lot in the first place, and i wouldn't expect anything less from cops) we were brought in to jail for like 8 hours.

We were really cool with the cops after, since we were supper stoned we were asking for the food they give inmates....etc so they all got a laugh out of it, we got them to weigh the 8th we had in my car with a scale they recently took from a dealer to see if the guy we got gave us a good deal ...(the 8th was never in the police report either meaning they just pocketed it btw).

We were out on 100$ bail each, none of us could afford a lawyer so we went the OG way with a public defender. 12 month ACD is what we got (apparently the average is 6 months if its not dropped) if we dont get in trouble for the next 12 months its a peraban from our records.

Cops also told us if it was a busier night they would have let us go with a warning-its all luck of the draw/

Moral of the story, dont do stupid shit in public, cops are abusive assholes, some are ok once they have you booked as long as you are nice, if you can afford a lawyer you will get off with less, if not use the public defender-you will most likely get an ACD but still get off if you have no prior convictions.
 
you're very naive man, cops can search you/your car whenever however they want-unless you get jonny cochran to rise from the dead illegal search and seasure (4th amendment) will never hold true in ct.
 
I'm not sure whether that supreme court ruling extends to vehicles though. The law generally protects private residences far more extensively than personal vehicles. If I'm not mistaken, that ruling pertained to private residences so I'm not sure whether or not it would protect against vehicular searches.

that's a fucking joke. decriminalizing marijuana has to happen. In Mass you dont get shit for anything under an O.

unless the weed was out it was only 3/4 grams he would not have smelled it. therefore you should have not let him search.
 
One small suggestion maybe, is have one person say "it's mine", because if you play the, "OH SHIT what is that game" everyones gonna get nailed with the same charges, one person can take the blame, I mean kinda terrible if you think about it, but just an idea. Happened when a couple of my friends and I got caught with a few grams and two pipes.
 
You're looking at 5 years 6 months max prison time, and the prosecution is almost definitely going to seek the maximum. A public defender will not defend you have as well as a private attorney. With a private attorney you should be able to get off with only probation. If you stick with a public defender, you're probably looking at jail time and a fine.

From what I can tell, it sounds like it's dubious whether or not the cops actually had probable cause to search your car. That'll work to your advantage. Do not, however, discuss your arrest with anybody other than your attorney.
 
This. Also I don't understand why noone films the police.. Your fully allowed to and if they mess up at any point legally and you get it on video your off the hook.
 
Hahaha Was it summit county or PC Police? Either way, you're probably fucked. They throw the book at you for weed up here because of people trafficking it east on the interstate.
 
Why did you get pulled over? I mean if you have weed on you you should be smart enough to bay all road laws or its essentially your fault.
 
Ya i see people pulled over 24/7 my boyfriend I never even take the risk of drinking and driving. Utah sucks for things like that
 
No need to scare OP. Seriously I doubt he will get jail. At least he didn't get a DUI. He will most likely get a fine. My friend got caught for doing graffiti and they gave him a chance at paying a 2k fine and no jail time, or 6 months in the pen and $1,000 fine plus a felony record. I know that these are not the same but but what he did looked like it was going to be a felony and he got a lawyer. GET A LAWYER and don't trip out.

I have had friends get pulled over with weed and paraphernalia. The most trouble that one of my friends got into was a felony for intent to distribute. He had over an ounce. Even though he wasn't selling weed he had enough for them to charge him with that.
 
If i get pulled over I have already decided that i am going to film it because of how bad the cops are in my current town McCall, Idaho (come on vacation, leave on probation) and also Park City because when you get pulled over if you don't know how to handle things you should just pull down your pants, bend over, and just prepare to be fucked cause they goin in dry
 
come to canada, ive seen cops search peoples bags and find multiple bottles of booze and just pour it out and then leave, cops are so chill here, like they come to partys and tell us to be safe then leave
 
yes it works hahaha trust me. A cop pulled my friend over in nh and there was weed and being a nh state trooper he was a dick and unlawfully searched and seized the car, he filmed it . and afterwards he told him that he had filmed the whole thing and he would see him in court. got off with nothing.
 
Almost everything you have said about the law is incorrect. This is basic law 101, read it and know it or make your ignorance less apparent.

some people have been arrested for filming police. The appeals court ruled it is our first amendment right to be able to film in public. So its against the constitution if you are arrested for filming a police officer.

I was reading a story a while back where a guy had a go pro mount on his helmet and an off duty officer hopped out of his car and pulled his gun and ran at the guy for driving his motorcycle recklessly. The guy thought he was going to get shot and robbed of his bike but it ended up being an officer who tackled him down. He then uploaded the video and had his house raided and was arrested right then and there for filming the off duty officer. Shit like that is so wack.
