Friend hit by car RIP

I posted earlier in the year about 3 of my friends and myself cycling across the country for breast cancer. Yesterday while riding through New Mexico (60 miles west of Albuquerque) my cousin, one of my best friends, was struck by an SUV going at a high rate of speed. The car was over the white line when it struck him. He hit off of the front windshield and was catapulted around 8 feet into the air until he fell onto the road. His helmet and bike were completely destroyed by the impact against the car and ground.
I was 30 feet ahead of him stopped watching the entire thing waiting to change a tire, and the car continued off the road towards me and missed me by inches before the driver swerved back onto the roadway from the apron.
My friend was immediately knocked unconscious and I was the first one at the scene as the two other riders were a few hundred yards ahead at the time. A few cars stopped to assist and he was life-flighted by helicopter to UNM hospital, but was declared brain-dead today at 3:30 PM.
Because this happened on Indian reservation land, the laws and court proceedings are apparantly different. I was wondering if anyone has any insight about this. I'm just asking everyone keep his family and 2 younger brothers in their prayers. I called his parents to deliver the news and picked them up at the airport today....I have never seen people more devastated in my entire life. We were 2 states and 10 days away from finishing the trip. Rest in peace John.

which indian reservation did it occur on? that kind of makes a difference. I know from living in a state with multiple reservations (south dakota) that some actually will take legal actions like Rosebud while others are very odd and legal actions are unfortunately a joke like Pine Ridge.

I remember reading your other thread about your trip, I was hoping you guys were gonna make it! Im so sorry for your loss. I hope the driver gets whats coming to him. Unfortunately I cannot help you with the reservation laws. Vibes to you and your family!
Please everybody who can drive on here, share the road with the Cyclists. They have all the rights to the road that you, as a driver do. And please pay attention to the road, do not text and drive, and even worse, do not drink and drive. I hate reading about this shit. It shouldnt happen.

so sorry man. that is a bad deal for sure. i live in mt and we have a bunch of different reservations. they all pretty much differ with laws. firstly did the person stop? were the cops notified? the best bet would be to contact a lawyer or some type of law enforcement to become clear on the law or prosecution or whatever
 
This is one of the saddest storys ive ever read. Just lost my grandpa recently, so i somewhat feel you loss, but not in such a tragic way. Your in my prayers man, +vibes to you and the afflicted ones. RIP.

But basically on indian reservations they can make their own laws(to some extent).

I hate assholes like that. Not only was the dude driving recklessly, but he fled from the scene. I hope karma kicks that guy's ass. Please remember that being foolish while driving is not just putting you at risk, but everyone else around you too.

Again, RIP and I'll be sure to keep the family in my prayers.

I think the family can sue for civil damages in the state where they live or where the driver lives so you could avoid the Indian resovior laws for that. Don't know for sure though, barley pulled a B in b-law.

I f anyone could figure out the Congress men for NM, the Governor, and Mayor of Laguna, New Mexico. Then if anyone wanted they could call them, and suggest they make sure the driver is prosecuted to the fullest extent of the law.
And does anyone know if this will be held to american laws or Indian. Because their is a bill in Oklahoma ( I don't know if it passed, heard it on radio) That says American federal law will precede over any foreign law ( they said and meant Sarigah law. http://abcnews.go.com/US/Media/oklahoma-pass-laws-prohibiting-islamic-sharia-laws-apply/story?id=10908521. So I mean if it does fall under indian law I hope it gets put in front of the our courts and juries.

I know of one student from Ft.Lewis dyeing in durango from a drunk driver, A man dragged a Mile under a car from a dad who was drunk with his kids in his cayen, drove to the next exit turned around and drover home to put the car in the garage, then on my way to visit the family, I saw a biker get tboned from a car going 30, he ended up with extensive injury 9 not life threatening. And a few more in CO.

I Didn't mention these to take away from the OP friend, I just mentioned it to show of how many idiots hit bikers and just about anything, ruining moms, dad's brothers, and whole familys.

No sorry forgot to clarify, I meant that they think Shariah Law will be a Problem In Oklahoma. I believe that is ridiculous since it is so full conservative narrow minded people ( not everybody but a lot ) and their is only 30,00 muslims
 
sorry I havn't gotten back on this post, i've been extremely busy trying to set alot of things up to help his family raise some money to help with everything.
The driver did not flee the scene, he turned around eventually and admitted to Officers that he was paying attention to an event on the side of the road. \
The accident occurred in Laguna, New Mexico and the case has been handed over from the tribal police there to the Bureau of Indian Affairs. I'm not exactly sure what that means, but the police officers told me it is a step in the right direction for prosecution.
 
Wow dude that is horrible. First off great job staying with it and getting him help, that must have been so hard to witness. Second, if ya know his family personally which it sounds like, stick with em this is gonna be rough. I know it still helps me a lot to hang out with my older brother's friends. Best wishes to his Family and you guys as well. Sounds like you're being a huge help to them already.

Are you guys gonna finish the trip??
 
dude, what you were doing was great. What happened to your freind is the worst, and just in the wrong place at the wrong time. His family will definetly be in my prayers.

consult a specialty lawer in the area that knows about indian reservation laws. really sorry to hear about that... road riding scares the shit out of me because of fears like that, knowing that all it takes is one idiot driver not paying attention. did you do the trip yet? if not make it a charity event in his name. also which route were you going to do?
 
we are meeting with police again today. We were almost done our trip, riding on a route that we chose for safety reasons. We started in PA and made it all the way to NM....
I just hope justice is served
 
RIP man, as a fellow road rider, this shit hits home. I try to advoid riding in the country where people arent paying attention. I live in a city with a large bike community, so there its usually pretty safe, but out in the middle of no where, people arent expecting to see a biker, and they are always hauling ass.

So sorry about your loss though, that awful.

Being good is a hard thing, but its worth it, even in times like this. remeber that. just think about how many people his efforts and life will be able to help in the long run. itd be stellar to prosecute the driver, and donate the majority of winnings to the cause.
 
oh man so it was on your trip... really sorry about that. such a senseless thing to happen. my parents do those cross country bike trips and stuff like that always worries me. hope everything works out as best as it can and keep on riding in his memory.

every time i see this thread i get more and more pissed off at the driver

did they get a plate number or any way to track him down? he should be prosecuted for some degree of manslaughter
