Crashed my car on my 18th birthday

well, last night here in NY was an icy one. and it seemed to carry over into this morning. but with midterms coming up, my school really didnt want to close school.

so like every day, i drive to school down this curvey, sort of narrow, road.

im taking it easy, not crawling along, but not speeding. i come up to this part which is a down hill, hard right hand curve.

over the curve i see a acura SUV. i figure it was backing out of a driveway or something, but its not moving and i start to brake.

well its a sheet of ice, and shes not moving. i jam on the clutch and the brakes, but its too late, im fucked. i turn the wheel right to try to avoid t boning this car and getting in a head on collision.

my car fishtails, and i tail whip her with my rear drivers side tire. the bounce off her car faced me down hill, but there was another car trying to pass her that the time. so to avoid that car, i turn hard right again. i end up driving up into a lot of snow, and large rocks, and then finally get down the hill and stop in a driveway.

i get out of my car, look at the damage, and flip a shit. im really pissed. i start walking towards the car but there is no one in it...

a guy comes out of the house that i stopped at and i go "where is the owner?"

he goes "oh, shes inside. i'll go get her..."

the man then starts accusing my of going to fast, he "heard" me. it was most likely the sound of me hitting the rev limiter because when i jammed on the brake, i hit the gas hard as well. i tell him "unless you can show me a radar gun of me speeding, stop accusing me..."

so the women comes out and goes "well i couldnt move the car and i didnt want to get hit, so i took my kids and left the car"

then a guy comes, stops, looks at the car and asks if he can get it out of the way... she says you can try. two turns later and no slipping, her car is down the road and parked in a driveway.

so my father comes. we exchange information, and all that jazz

now it should be 100% her fault, since she left her car obstructing the road, and instead of walking up the road to stop traffic, she went inside someones house. and the two people that lived in the house also stayed inside. this easily could have been avoided.

my car is pretty banged up. most of the damage is on one panel, the read fender, but the tire is angled in towards the car, probably snapped the axel or something.

I love this car, its my baby. 2004 audi a4 1.8t. thankfully it will be cleaned up nicely though

wtf? what a dumb cunt leaving a car in the middle of an icy road on a corner...sorry to hear about your car at least it looks mostly cosmetic, hopefully you wont have any alignment issues in the future

she didnt have her hazard lights on or anything? Hopefully she doesnt go after you for partial blame because of excessive speed/not giving yourself enough room to stop

why did you jam on the clutch? Downshifting I hope?

i wish it was cosmetic. the wheel is angled at about a 70 degrees as apposed to 90. that could mean a snapped axle, or possibly a lot worse (bent chassis or other shit)

she had nothing on in the car. didnt put up a cone or a triangle or anything. she literally left the car and went inside the house this happened in front of.

i doubt she could go after me for speeding, she wasnt even there when it happened.

and yes i was trying to downshift, thats why i tried to heel toe but ended up just red lining it

deffinately her fault. I witnessed a bad accident today leaving school, scared the shit out of me

even though she wasnt out there they can still figure out your approximate speed (in a normal accident, ice kinda changes things) by looking at the damage between cars, skid marks, how far her car moved down the road...but since she moved it into the driveway i guess thats kiind of void

either way shes an idiot and deserves 100% blame

maybe you can ask them to them to bend the other 3 wheels and get some sick camber liek this guy haha

it was pure ice, no way they will be able to figure that out, and yes all the cars were moved and stuff.

she left her car obstructing the road, possibly considered leaving the scene of an accident, without any warning at all

Holy shit that road looks icy as fuck! Like an inch of pure water ice covering the road....

But yeah, she's an idiot for leaving a car in the road...

What you need to do now is get a dr's report saying you have whiplash etc etc and claim injury from her insurance as negligence.....

police couldn't come. they were busy dealing with too many other accidents.

just got off the phone with the insurance company. supposedly she claimed her car was parked on the side of the road. she is owned, i told them the entire story on a phone interview, and then sent them the picture of her parked in the middle of the road, sideways. after the interview, the insurance lady goes "ughhh, happy birthday!!! im sooo sorry this happened... that really sucks..."

I hope the lady isn't a crazy bitch, cause if you take this to court, you'll lose. Sorry man, same thing happened to my sister a couple years ago, kid was stalled in the middle of the road, she tried to brake, couldn't stop and hit his car. Cops came, said they were sorry, but she was liable since she was the one moving.
:( good luck though!

good for taking those pictures man, photo evidence does a lot for making your case, good thing its getting all worked out for you

oh and happy b-day!!

and this is why you only tap the breaks even if you have abs when it is icy out, from what you say it seems like it is your fault if you slammed on the breaks even if here car was parked on the side of the road, you probably would have been fine if you didnt slam on the breaks and cause the car to lose traction

she abandoned her car and lied to the insurance company... it wasnt like she randomly stalled while i was behind her. she left the car and went into someone house....

her car was perpendicular to the road, front end covering a significant amount of the lane i was traveling in. even if the roads were dry and i was traveling at 5mph, i would have had to drive way off the side of the road to avoid touching her

OK so let me get this strait. Your cars tires are the most important driving medium for you're control on the car. The only way you can turn and direct you're car is for the tire to continue rolling. ABS simply pulses the braking to keep your tire moving and your car stopping at the same time (while you're Brake pedal is to the floor). You would only pulse you're cars brake pedal manually in a car without ABS. ABS does the pulsing for you. The reason you could't steer youre car in this situation is because the roads were slick so the abs didnt work as well.

I now have no simpathy for you because lets face it you got into a car and you don't even know how its braking system works. If you started pumping the breaks in a car with abs then thats not smart. The computer can out pump you anytime.

I would suggest (and be supervised) all the youngings who get their new licenses to go into parking lot shoot to 50 and then slam on your brakes you will feel the abs come in and you will be able to steer a little even with youre foot to the floor.

whoa hey, someone that knows what they're talking about! amazing.
and to the poor child that got into the car accident, test the driving conditions next time you fucking idiot.

Exactly, when teaching someone to drive it's good for them to know what it's like not to have control. But still it sucks that this happened at all let alone on your birthday. Vibes.

i just told you exactly how the braking system works. i did not copy a single sentence of what i said, im in ap physics and thats how i know it. and then you completely just repeated what i said

I did not pump the brakes. i jammed on the brakes and let the abs do it work. i dont know where you got that i pumped the brakes from

you clearly understand then that abs wont give you much leeway in steering right? So even if he didnt pulse his brakes and allowed abs to kick in he still would have most likely hit the car. In fact in some driving conditions its better to slide because it allows you to slow faster. Abs will pull you farther forward (trust me its happened to me)

It;s 100% the womans fault:

1. because she's a woman

2. She was parked illegally on the side of the road (obstructing the driving lane)

fuck you. it is a blind turn. by the time i was in the car and jammed on the clutch, i was pretty much into the other car

One: That sucks massive amounts of dick, hope you fuck the bitch up because it is her fault for leaving her car in the fucking street. Due to the road conditions, the police and insuarance companies know had her car not been there you would not have crashed so ya.

Two: Have a Happy Birthday, get hammered and forget it all
