Cost of first MIP

Yea so I got caught with a keg in my car last night. I was not pulled over or anything I was just chilling on the street next to my car with a few other friends and a couple of cops roll up and say they smell weed (bullshit because I had none on me and had not smoked). They said the car smelled like weed (bullshit I never ever would consider hotboxing my car) and said they had grounds to search it even though I did not consent to any searches and told them so. They found a keg in my trunk that we had been saving to take over to my friend's house later that night. So over the course of another hour I get an MIP citation but luckily nothing in the traffic code. Now I have to go to court in a couple of months.

So my question is how much did you pay in fines for your first MIP and if you're between the ages of 18-21 is it possible to get that shit dropped from your record ever?
 
you can get it dropped in court, you are still usually stuck with the fines tho. Expect to be payin at least 300-400ish and hopefully the fine will be dropped
 
300-400? fuck I didn't realize it was that much. Well fuck it, I guess its better than getting handcuffed and sent to jail like my friend Curtis for furnishing alcohol.
 
It depends on the state i think, its only like 150-175 here in montana for first MIP offense.
 
$201 for the firstt in Missoula. It's a $100 fine for the ticket and a $101 for the surcharge. the reciept breaks it down, you pay about 16 for a "victim witness", some for "techonology fee", and a TON for "Law Enforcment Academy." Such bullshit. Plus $20 for your community service fees and whatever money for your substance abuse classes.

 
$385 for the first in Butte("st pattys day city") even if your are 18 , one of my friends is 18 and just got an mip with the fine, 20 hours of cs, and aa classes
 
for me in Oregon it was $180 for my first offense

im pretty sure its cleared off your record once you turn 21 as long as its just an mip and not a dui
 
not in place of any other punishment. it was in the dorms at college so i had to go through a seperate hearing process and then an alcohol class for the school, but for the state it was just the fine with no option of community service
 
mine was around 150 and i had to go see a YES counselor, and as long as i didn't get in trouble for a certain amount of time, it was expunged from my record. i was 17 though and had no priors. have you had any other offenses?
 
for sure, I'm starting to feel a little better that this isn't so bad at all. Might have been a good wake up call for me to stop being so fucking careless and be a bit more careful from now on.

Just thank MADD and all those other militant groups for those great counseling classes that 20 year old adults go to for "underage drinking". We all need to help MADD and their goal of the 25 year drinking age and the .05 BAC DUI.

you'll be good. they usually let you have the option of getting the IP off in 6 onths if you don't get any more. it depends on the judge, though, the Sheriffs here won't let you get it off your record. Just be polite and respectful and they'll go as easily as they can on you.

Also, don't really stress if you have MIPs. Everyone and their mom has them, they're minor minor offenses. DONT get another, though.
 
well this is a whole different subject but one thing i learned at alcohol class is that at 0.08 (the legal limit in most states), your reaction time is cut in half. just a little something to think about
 
bullshit I don't believe that for a second, if you're intoxicated you're reaction time is cut in half. .08 is a slight buzz, .15 has been established by researchers to be the amount needed in most people to even begin to be considered "under the influence" at a social gathering. After a couple of glasses of wine you can easily hit .04-.07 depending on your weight. I agree that you shouldn't drive on a higher than .08 but with a .05 you'd end up with everyone getting pulled over on a friday or saturday night with a DUI
 
well its true, reactio time and being social at a party are two totally different things. at a social function after a few drinks you may have a slow reaction time but you are also friendly and laughable which often slips under the radar at a party. at .15 thats when you start to become sloppy hence the comment about everyone noticing
 
thats the dumbest thing ive ever heard. having the legal drinking age to 25 would really only make the problems of underage drinking worse. the places that have no drinking age have way less problems with young people drinking as much as places that have a drinking age because they have always been able to have alchohol while underage people when they are able to drink go overboard.
 
for sure, I noticed this when I was in Paris when I went to see the Paris nightlife with this girl I know. I was 17 at the time and went into the bar had a few beers and some shots, no big deal, just enough to get relaxed and open up more to conversation. Its extremely easy to obtain alcohol so therefore its actually frowned upon quite a bit to be intensely intoxicated. Here, because of the few times a month when a good amount of alcohol is available at a social gathering that hasn't been broken up by the cops, its easy to see why we Americans drink too much on these occasions.
 
I wouldn't say sloppy but definitely when the alcohol begins to affect your motor skills. .15 is actually considered the ideal BAC to have a good time while drinking without overindulging.
 
I know that, it isn't the first time I've been denied my rights. The cop said he could smell it (utter bullshit), and even though the keg was concealed and he only found it after removing the stuff concealing it, he said it was in plain view which gave him grounds to search my car. I told him explicitly I did not consent to any searches which I think pissed him off more. The judges in these kangaroo courts don't give a fuck about your rights (I know, I've represented myself before and asked for dismissal based on clear rights violations and lost the case) and unless you pay for a lawyer (which is more expensive than the fine), there's no way you will ever win your case.

mmm i dunno, its really your word against his about smelling the smoke. if you havent been caught before, i suggest fighting the fact that you do not smoke ganj and that there was no possible way he could smell any. if in that case, then he illegally searched you, and all evidence should be thrown away.
 
If I had been arrested or cited under anything more serious than I was, I would definitely fight it. It's just a MIP and my first one so it shouldn't be a big deal, I'm out maybe $200. I don't know about the fighting the fact that I don't smoke mary jane cause I do and had actually smoked about 3-4 hours prior to this incident. However, it wasn't in my car, I had changed my clothes, and my breath was masked with mint gum and all you can eat sushi and wasabi.
 
Mine was $332 in Utah.  I got a plea of advance, which meant I had to 10 hours of community service and take a youth alcohol class that cost $150...and if I don't get any more misdemeanors for 12 months, it won't go on my record.  Shit sucks.
 
Utah is super strict when comparing it to most other states due to the fact that most mormans dont drink at all
 
yea, those fuckers nearly threw out their backs carrying that precious keystone light. I hadn't paid for the beer beyond the usual 10 buck throwdown and the shell wasn't mine so it wasn't a painful loss. They were considering putting one of those K9 dogs in my car to search for weed. According to the officer,

Cop: "hand over the pot now! I can smell it on you and in the car! don't bullshit me!"

Me(calmly): "I have no marijuana in my car or on my clothes or breath because I do not smoke".

Cop into radio" "Can I get a K9 unit out to 8th and Oak," Cop:"If I find any pot at all and find out you've been lying I'm having a k9 dog tear up your car, and if I find any of these houses around here with broken windows or anything wrong I'm charging you with burglary and forced entry". I think my gold watch gave them the impression that I was a drug dealer hahhaa.

fuck the police, its gone so far from enforcement into abuse of power its not even funny. I'd rather be mugged anyday than have a confrontation with the fucking police. Where I live, the police are the thieves, because beyond the minor cases of shoplifting and MIPs there is no crime. Hell, I had 4 patrol cars parked around my car just for this minor incident.
 
get a good lawyer and you might have a chance of fucking over the po, probably not though, my MIP was something like 275, but that was included with trespasing, so i think it was only 165 for the MIP, good luck though
 
haha all these fucking alcohol laws are a fucking labyrinth of fucking criss crosses between whats legal and what isn't. I know if I fought the cop in court I would lose because he would say the keg was in plain view, giving him grounds to search my car. (it was not but how am I to prove this? a keg is pretty big). If it had been in the trunk of a sedan rather, I would have a good fighting chance but I drive an SUV.

God damn I wish I had not had that keg, then I could really turn around and pin these fucking assholes for illegally searching my vehicle.
