Cops word vs mine?

wel i recently got a ticket at about 11 30 the other night, i was passing a car and a state trooper came flying around the corner towards me as i was entering back into my lane, he pulls me over and says i completed the pass out of the zone. My question is in court if he has no proof and i say i made it back in to my lane in time can the judge really uphold the ticket on his word vs mine?
 
it would take it to court. cause most of the time the cops can not show up to the hearing. and so they cant deffend the tickit, and then u get off the hook
 
I'd contact the issuing department and ask to speak with the chief or someone high up, explain the situation, and see what can be done. If you know you're right, stand up and fight it, chances are they'll offer a bargain and you'll get off easier.
 
Do what Melvs said. If not bring him to court because he has the burden of proof meaning if he cannot show that you did, then you get off with it. I've seen a kid get away with hosting a party at a house that wasn't his because he was standing outside watching the door and all he said was that he wasn't near the door and showed up to see what it was all about. Plus I've went to court for traffic violations and got off both times because the cops didn't show up, nor an attorney.
 
FIGHT IT. my physics teacher got a ticket and the cop was pulled over beside a cemetery hiding. caught him. and gave him the ticket. my teacher faught it in court sayign it was disrepectful to the deseised and WON. no ticket.
 
i fought the law on an illegal search of my car 2 years ago (i clearly did not consent to it, it didn't smell like anything, i wasn't drunk, i said no i'd rather be on my way, they said they were going to search anyways, i soon told them i will see them in court) during which i got fucked for many bags of herb and mush and 5 pipes/bongs and scales/baggies etc... sucked. But i took it to court and got a good lawyer because they had no right to search me and i did not give consent; but surely enough the jury full of old farts figured there had to be a reason to search my car considering i did have such substances in the car. got fucked. the cop was sitting there lying the whole time. i wanna fucking kill him
 
there are 2 court dates you attend if you wanna fight. the first on you state if you are pleading guilty or not guilty. if guilty usually you get it redueced cause you were nice enough to come to the 'court'. if you plead not guilty you have an actual trial set up, in which you can choose jury of your peers, or a judge only trial. the cop DOES NOT HAVE TO SHOW TO THE FIRST TRAIL that is written on your ticket. Now if he doesnt show to the 2nd date after you plead not guilty THEN you get off scott free.
 
It depends on the state. In most states in traffic court the burdon of proof is perponderance of evidence, which is whatever side is more believeable, which would be the cop. In other states its "highly probable" which means they would need more than just the cops word.
 
in ontario the solid line doesnt mean you CAN'T pass it just means you SHOULDN'T unless you're on a turn or a hill
 
If you fight it and decide to go to court when you plead not guilty tell them you want to have the trial at the COUNTY SEAT, this is the main court for your county and usually much further away from where you got the ticket. You may have to drive for an hour or so but most times the cop won't drive that far.

Dude we're talking about traffic violations here. It's done all in one day. There is no hearing date. It's basically a drive through court system.
 
not in NY they dont. if they do show up you can talk to them odds are they will reduce it if you are polite. or talk to the DA
 
not in the states ive gone to. the court you go to serves traffic violations, to minor drug and alcohol charge, to abuse, to truency and many other things.
 
The courts I've been to serves more than that, but what they do is set all those cases to one date to get them all out of the way at once. I don't know what states care enough about traffic violations to do what your saying.
 
i think you are confused. i agree with what your saying. if you get a ticket it has a date you can appear in front of a judge. you go there that day with all of the ppl there on battery, or drug, or whatever other charges and your like "you judge, i got a speeding ticket but its my first one and im sorry." he says ight bboy dont do it again, and you get it reduced. Now if you wanna fight it, you can go on that day and say im right, the cop is wrong, i wanna take this to trial. then you are given a seperate day to come to court again, to have a trial.
 
Dude I've been through this process a few times. From what I've seen and experienced from two separate courts, all the people claim their stand (no lo contendre, innocent, guilty) then they go from case to case in front of the judge. It's not very formal, it moves quick because that's what it's designed to do. There's so many of these cases that if they did separate court dates for everyone that claimed innocent, it'd cost the state/county way to much time and money. There are no hearings for minor traffic/drug/alcohol violations.
 
correct. but what happens if you plead not guilty? thats what im saying. if you plead not guilty, you are given a new court date.
 
Look, they'll believe his word over yours. But without undeniable proof, they cannot charge you with a crime.
 
1. He will show up. He gets paid to show up. It's easy money.

2. He is an officer of the law and has no burden of proof when it comes to traffic violations. His word against yours? Who the fuck are you? They'll take his word. You're fucked.

3. On occasion a judge will reduce the ticket just because you showed up to court. Don't count on it though.
 
they are going to take his word against ur but your innocent until proven guilty, so in order for the ticket to stand, he needs to prove beyond a reasonable doubt that you commited the violation. so if there is anything fishy about the ticket i would take it to court
 
You don't what the fuck you are talking about... If you plead not guilty they re-schedule your court date for the upcoming trial. They do not take care of it that day unless you plead guilty, which is usually the best way to go with traffic tickets or misdemeanors.
 
its different in every state dude, in washington, for example, you go through a series of preliminary motions (to dismiss) and if any of your lame ass excuses (motions) hold up, then its dismissed. If not, you can defer, plead guilty or not. sometimes, if they have all their shit together you'll just do your little mini trial right there, swear in, tell your story and thats that.

U got a ticket in montana once, there's no dollar amount on the ticket, just a court date. So i go in, and first things first i have to plead guilty or not guilty. So I say, guilty- with circumstances. And he's like well what are they. And I was like well I've only been in this town a few days, its an extremely weird stop sign that i ran etc etc. and he was like alright.. well thats too bad. so anyway, the point is, everyone does it differently.
 
No actually you have no idea what you are talking about. I live in NH, you don't. It is different how it's handled in each state, and seeing this kid is going to court in NH, I'm right and you are wrong. So please, shut the fuck up and maybe if he got a ticket where you live, then you'd have some merit.
 
Yeah you are right, they are gonna spend an hour representing each side while tens of people are sitting there waiting for the trial process to go on so they can plead guilty and go home. And I'm sure I would like to bring my lawyer in for the trial after I plead not guilty. Is the judge going to deny you that request because there is insufficient amount of time? Brilliant!
 
where i live you go to court and plead guilty or innnocent and if you plead guilty they reschedule but you cant go to traffic school and get the ticket erased
 
Umm... yeah that's actually how it happens with a few exceptions though...

1. It doesn't take an hour per case, more like ten-fifteen minutes.

2. If you plead guilty, it takes even less and last time I checked, no one gets arrested for a speeding ticket so yeah they go on their way home if they are found guilty.

3. You bring your lawyer with you if you find it that necessary you jackass. You're assigned your court date a month or so beforehand so you got plenty of time to do so.

4. You don't live in NH and you've never been inside a NH courtroom so everything you say is invalid.
