Cops search rights

ok so my friends and i were walking down the street tonight and since its halloween the cops in my town were on high alert (i live in a rich town and all they have to do is give kids a hard time for partying and stuff) and we see a roll of toliet paper and we go and pick it up. all of a sudden a cop comes from outa nowhere and starts yelling at us for having TP and saying we could be arrested for vandalism. so we say that the tp is not ours (wich it wasnt) and then he asks to search my friend and pat him down. my friend then says no you cant do that you dont have that right. (he had firecrackers on him so he didnt wanna get caught with them). and the cop says "yes i do and i also have the right to do this for you giving me lip" he then calls a cruiser to come and pick him up to bring him to the station. after about 25 minutes of arguing we finally got him to let us go but my question is what rights do cops have to search you?
Spark notes: my friend got in trouble for telling a cop he cant search him. was he right. what rights do cops have when it comes to searching u?
 
Having TP in your hand is NOT probable cause. That's reasonable suspicion (what they need to search your shit at school) at best. All he could do is confiscate your toilet paper.
 
how did you not see that coming? should've run right from the start. those motherfuckers have been patrolling like crazy around essex tonight. we had a fire in my friends backyard and were leaving so as were walking out front this undercover 5-0 dick creeps next to us watching everyone go near the cars. he flipped on his 4 way flashers and stopped in the middle of the road right there so he could follow us. we waited until he left which took a while. he parked on the other corner and waited for us even after that. i swear to god they just fuck with the kids they have dealt with but haven't actually caught them for anything yet. i've been getting pulled over for doing nothing wrong lately. our rents pay mad taxes and that station is stackin'. they aren't fighting crime, rents are just paying for their kids to get hassled and bullshitted.
 
that cop was probably pre-gaming it before his shift ended so he'd be wasted when he showed up to the party. i wish i had some power to abuse right now.
 
honestly, this is probably the worst place to ask about rights regarding cops. Just look for the "fuck the police" thread. It's like talking about excessive use of force on a cop forum, you'll never get an unbiased answer
 
they have a right to pat you down, its for there safety. what if you had a gun and pulled it on him (not that you did or would). when a cop is talking to you outside (out of a car, etc.) he has the right to search you and your person for the cops safety. Just as you would if you were a cop. (im not saying you guys did anything bad or taking the cops side).
 
yeah its the stop and frisk law, they can stop just about anybody and feel them up and if they think they feel something then they can search you
 
the first part of what you said is correct, they do have the right to pat you down, but then you went on to say that they could search you, which they can't.
If the cop had the right to search you or your friend, he would have. Cops know when they are within their right, he was just waiting for you to give him the go ahead to search you by saying that he could do it. Had he searched you it would have been outside of his rights if you continued to say no... but again, he is allowed to pat you down to make sure you don't have anything that could be used as a weapon on you.
 
dude man, they were in high allert in my neighbourhod also, i was like :fuck you!" and kept steppin and walkled home and shit. and it wasas no big deal1! down worry about it

just did drivers training for less insurance and the lady said that they can search you no matter what and even for no reason whatsoever which i told her was bullshit

thats what i watched and learned that you don't have to get searched, but is this shit different in canada?
 
i watched the video and it was good. i wrote down the "correct" way to get outa the cops BS and am gonna throw it in the center council of my car for reference! cops SUCK
 
It is way different in Canada. US cops don't scare me, they have too much procedure and if your smart you'll be fine.

Canadian cops scare the shit out of me. I was at a party in Canada and a fight broke out down the road. The cops come and ask everyone for ID. I went and got my wallet from my car along with two beers. I told the cop I was 19 and I could have a beer if i wanted to. He grabbed both beers from me and shattered the bottles. Then he threw me against a car and proceeded to pat me down, called me a "fucking American pig" and handcuffed me. He then searched my car. Don't fuck with Canadian cops.
 
all a cop needs is reasonable suspicion to search you or lockers or some shit like that. cars and homes they need a warrant, not always for cars tho. if they smell weed or something like that, they can search your car
 
i got searched last night by campus security for absolutley no reason. i was walking at like 1 am with a bag and a nalgene (nothing in the bag, and water in the nalgene). the security for my school came and asked what was in the nalgene and i told them water so they took it from me and searched it, then felt my bag up to see if there was anything in it. fuckers.
 
i dont think toilet paper would justify as incriminating evidence...i would say that he shouldnt have been allowed to search you. he should have had to ask first.
 
haha my law teacher is so awesome, right outside his classroom on his bulletin board he has a sheet posted up that says "what to do if you are under 18 and questioned or arrested by the police". it has all the info, what you should do, not do, all of it. he printed of an extra copy for me to carry around with me so i know what to do/say should the time ever arrive.
 
Hahaha everyone gets hassled by the pigs on halloween. I was meeting some people at a school, and the cops came to clear it out (there were like 200 people just hanging out there). My friend just gave the cop the stink eye and he walked the other way. When we were leaving we passed the k9 unit and it was barking like fucking crazy. I had a handle in my backpack, so i was hella scared, but the cop wasnt in the car. They were just cruising around the school for like 2 hours and we had to go somewhere else just to not be scared about dick cops searching me.
 
since when do rules apply to cops? There going to search you if they want you can not stop them by saying "I have rights"
 
less than a week after i was arrested for possession of marijuana, i was pulled over at roughly 2am, just off the NMU campus by Marquette City Police. i had been smoking in my car that day, but didn't have anything in my car at that time, but after the ordeal i'd gone through when i was arrested, i wasn't in any mood to cooperate. the cop said he smelled weed and pulled me out of the car to ask me some questions. he was alone in his cruiser, so he called for another car. since i was just off NMU's campus, NMU Public Safety decided to make an apperance and since it was late and they were likely bored, they sent two cruisers. we had ourselves a little party. so, me and four officers got to talking and they explained that my car smelled like weed and they wanted to search it "for their safety". right. i repeatedly refused a search and when asked why i simply replied, "i know my rights and you're not getting in my car." i was told they were going to bring a dog and allowed to sit in my car, sans drivers license. that part never made sense to me- i have a dark tint on my windows, so they were basically giving me a few minutes to privately dispose of anything i might have had. after 3 or 4 minutes one of the officers came to my window, informed me that they were unable to bring in a dog, handed me my drivers license, and told to be on my way.
so, yes, the "i know my rights" line does work.
 
doesn't work all the time but at least you had reasonable cops. All I'm saying is cops violate peoples rights all the time, and if they bring dogs your more or less fucked because they can make the dogs have a "false positive" which is a fake reaction so they can get in your car. Not letting them search your car is also another probable cause because no law abiding citizen would turn them down. So yes, sometimes the rights line will work, but they can and do make up reasons to search peoples cars I've heard numerous stories, or just getting pulled over because they have nothing better to do at 2 AM than follow you around until they can think of a good reason to pull people over.
 
any good lawyer would take a shit on the whole "any law-abiding citizen would have nothing to hide and let them search" argument. that's a fucking joke. that night i described, i knew i didn't have ANYTHING illegal in my car- i had been arrested in the same vehicle less than a week earlier and had since cleaned it completely. regardless, there wasn't a chance they were getting into my car with my permission. i have a right to my privacy and they're going to need legitimate probable cause or a warrant to conduct a search, no exceptions.
