Cops invading privacy?

say 2 people ran from a party and one got caught. If a cop asked to see your cellphone to read your texts with the other kid that ran do you have the right to refuse?
 
they didnt run from the party, they were going to get ones car. and the only reason they got interigated was because there was a break in a from houses down from the party. and cops were pulling over EVERYONE. seeing as how the cop found half an O of bud one of kid, id say he has the right to look through his texts
 
unless my school has its own version of Virginia Tech, I don't think that they can help with anything. But they will: Keep pulling over people for going 68 in a 65 zone and giving them massive tickets, while saying they weren't wearing a seatbelt when they were and giving them another massive ticket, getting every kid(that they can) in trouble with half a gram of weed on them and fucking up the kids record, wasting tax money and just all around being worthless people.

It depends on the situation. If you were running from the cops, then they can do anything. if you were talking on the street? without some sort of probable cause, they cant really do anything
 
Ya unless they are detaining you, you dont need to even talk to them and you are free to leave at any time. if you are running, chances are they are detaining you, but i do think they need a warrant. they need a warrant on csi: miami i know that

Cops have the right to treat people like trash? No wonder everyone hates them... Respect gets respect and until cops quit pulling over every second car in my town, I will continue to not like them. That's in my town though. City cops are usually more professional and I depend on them to keep me safe from crackheads.
 
Not true, at least in Denver. They're nothing but power-tripping assholes who'll go out of their way to get you in trouble to meet their quota since Denver's a relatively low-crime city.
 
i challenge their authority every time I am questioned, or if they want to search me. sometimes it works, but a lot of the time its better to let them win, because they will try to fuck you even harder if you resist too much.
 
some cops are cool. some are trash. I had a cop pull me over not to long ago and i had been drinking moderately, no dui. He was a badass. I have also had dickhead power trippen cops. I got a ticket for my music to loud one time and i dont even have subs. I have also gotten a ticket for tinted windows. I fucken hate most cops, but there is still some good ones out there.
 
i would never let a cop search through any of my belongings, and i would rather smash my blackberry than let a cop put his greasy mitts on it.
 
yah cops in denver suck this is prob why were the only ones that hate them cause we're experiencing the same thing.
 
OK, and how about I am in my friends car with fairly dark(not tinted, just a bit dark, 100% legal) windows, he is in the back of a line of three cars behind an RV so we are going like 10mph under the speed limit, and my friend gets pulled over and the cop says he didn't have his seat belt on. My friend says he did(which he did)..not much else he can say. The cop says stop arguing and maby it's your fault since I can't see through your windows too well, and gives him a $202 ticket or something like that because we were near a construction zone so he doubled it. But yeah, they just help us out so much!
 
I find that it mainly depends on the jurisdiction whether the cops are good or bad. For example, in Duluth where they actualy have real problems to deal with, their not bad at all and I never get pulled over for stupid little things, but in nearby Hermantown which has virtually no crime and therefore nothing to do, they are pricks and pull people over for going 2 over the speed limit.
 
It is illegal for any persons such as teachers and cops to read your text messages or even open your phone unless they have a search warrant that you have signed so you can report it to the police if someone other than a parent or guardian goes through your phone without your permission.
 
this debate is endless, and everybody is right and wrong on it.

some cops are bad, some are good. i choose to always exercise my rights every time, so long as i am guilt-free, no matter whether the cop is decent to me or a dick. i treat every cop that i meet as a reckless authority figure, until he proves me otherwise. of course, this still means that i treat ALL of them with due respect (ie they have a gun and badge). however, i trust none to have my best interests at heart, but I do still expect them to have my preservation at heart. thats all.

cautious, realistic, but never sleeping.

it also helps when you are not consistently breaking the laws, no matter how stupid they are. if you are doing something illegal, you have no recourse when you run across a tool cop. if you are in the right, you either wont get in trouble, or you take it to court and hope for the best.
 
No a cop can't look through your phone without a warrant, that's highly illegal, even if you shot someone in the head, they can't search your phone without a warrant. And what's with all these people defending cops? I've noticed a lot of cops with no real crime to tend to gravitate towards being faggots on power trips because they have nothing to do. If you wanna be a real cop go to the city and save some lives, those are good cops. If your a cop and a small town the most he should be doing is taking peoples weed and giving speeding tickets because hes a glorified mall cop who couldn't hack it in the city.
 
That's wierd, I don't know what your talking about. Maybe if you don't break laws, police will leave you alone?

To the OP (and I could talk about this all day), but the officer would have to put the person with the phone under arrest to have the right to see the phone (because technically that is search and seizure) and he would have to have probable cause to make the arrest.
 
I've only gotten pulled over twice in Duluth one was for speeding and I just got a warning, and the other was for having my license plate lights out.. the second time the car reeked like weed and there were a couple drunk kids in back (sober cabbing) and he just said fix that light and let me go. They don't usually mess around with unimportant stuff.
 
i dunno me n some friends ran from the cops and while runnin one of my friends told the cop to "catch me if you can BITCHES" while he was tellin him to get on the ground.. he said it laughing and was actually really just tryin to be funny. Well long story short a fat kid we were with got caught and brought them back to the house we were out.. they found the kid who said it and acted like they were gonna put him in handcuffs, then busted out laughing and said it was the funniest thing theyve heard and made fun of him for the face he made when they were putting him in handcuffs.. ive done some messed up stuff and have only had nothing but good experiences with the police in my town so i dunno.. i dont mind em
 
i don't see how it's a waste of taxes when all in all, the money you pay for the fine would make up for the waste...
 
Maybe if they were decent people with something to do with their lives I would've have ended up in jail for a night. That time, all I was doing was walking home through a popular alley way at University of Denver and a cop just happened to be standing there. He stopped me just to ask what I was doing, to which I responded "walking home to let my dog out of my room and go to sleep". He proceeded to accuse me of being drunk and decided arrest me with no breathalyzer test in order to "teach me a lesson". He called three backup cops on me when I was being polite while still trying to excecise my rights while I was being stepped all over by them. They took me downtown and while I was trying to make my phone call (which I never got), the arresting cop came up to me and told me, "I'm going to teach you a lesson boy, you're going to jail for 90 days". I respond, "I've done nothing wrong and you have no right to do that" so he scoffed and walked away. If scared is what he wanted me to be, he did it very well. I was tripping out until the next day when my emergency contact number was called by the jail clerk and I was bailed out. Now I have to go to court to fight this because some cop decided to fuck with some college kid's life.

Oh, and when I got let out of jail, the same cop came up to me and told me that "If I ever see you in that alley way again, I'm going to arrest you for trespassing". To which I walked out the jail laughing informing him that alleyways aren't private property. That was the ONLY time I gave him any lip and I was on the way out of jail when he couldn't do anything about it.

Now do you know what I'm talking about? I have more examples but I don't feel like stressing myself out thinking about the bullshit I've been through with the police. I've never gotten in trouble for something I deserved to get in trouble for.

but not ALL cops are like that

next time, i would advise you say absolutely nothing (even though you did nothing wrong), don't argue, don't say he's wrong. Request a lawyer, the lawyer will speak to the cop or who ever and easily get you off(no homo), being that you DID do nothing wrong... did you?
 
why, because he chooses not to follow a bullshit law that perpetuates improper drinking in America and sends kids to the hospital all the time because they rebel by drinking since they're not allowed to have it?
 
I don't know, I've found that a lot of people are just stupid....

I mean I'm 16

I go out, there is more than enough beer to get bombed, but I'm fine having 4 or so. I get a nice buzz, I'm fine for when i have to see my parents, and i have fun... I CAN get bombed, but i don't need to, or want to

Its all the stupid mentality that kid have...

but anyway, there is no reason to blame cops for underage drinking... they don't make the laws, they just enforce them
 
everyone loves to hate on cops. But for most people they are the first person they call when their house is broken in, you just got your car stolen or other bad situations you can find yourself in.

I definitely agree with the trend of cops who work in areas with low crime hassling people for lesser offenses. I live in nyc and have never gotten a ticket from a cop. Ive ran from the nyc cops for skateboarding multiple times and never got caught tho.

I go to college in long island (right next to nyc for those who dont know the area), ive been pulled over twice for speeding/ window tints. I've also been pulled over in upstate ny for tints.

Cops in the city dont give a fuck most of the time about tints. And I speed/weave (gotta love the BQE {brooklyn queens expressway}) a lot more in nyc than i do in long island.

some cops are dicks, just like some people in any profession are dicks. But lower crime rates=bored cops. and bored cops try their best to find something to do i guess.

besides if you are doing the dirty right, then you wont get caught by the cops in the first place lol. ya dig?
 
you missed the point. i wasn't blaming cops for underrage drinking, i was commending the cop mentioned above for relaizing it's a bullshit law. underage drinking is a huge problem in the US when compared to places like Europe where it is socially acceptable to drink as a kid.

The problem lies where the Uhmericuh's version of "drink" is drink to get hammered. This is a result from the drinking age being 21. I mean, if you can have the responsibility to sign your life away to join the military, you should be granted the responsibility to be able to buy a drink if you want.
