Constitutional Law (Commerce Clause and Police Powers)

Alright, so I really hate to come to NS for help but I am writing a paper on the commerce clause/police powers and am looking for someone who is well versed in either (or both) of these areas to help me write my paper. No, I dont want you to write it for me, I can handle that part. Some of this stuff is just a little hard for me to comprehend so I am looking for someone that can help me kind of work through it.

What will the thesis of your paper be? I know the basics of both but I'd need a thesis in order to help with supporting info.

Question: How would you describe

Congress’s commerce powers, as recognized by the Supreme Court, since the New

Deal? How are they constrained, if at all, by states’ police powers? Based upon

what you know, should Congress have broad and expansive commerce powers? (Think

about some of the more recent things Congress has attempted to regulate under

their commerce powers, like carrying guns and remedies for violence against

women.) Why or why not?

 
What a coincidence...I'm actually studying for a ConLaw final as I write this. The foundation for all commerce clause cases is Gibbons v. Ogden. Be sure to read Justice Marshall's opinion on that. Then I would read the opinions in U.S. v. E.C. Knight Co, ALA Schecter Poultry vs. U.S, Wickard v. Filburn, U.S. v. Lopez, and Gonzales v. Raich. (those are in chronological order as well) These cases will give you a strong understanding of the dynamic nature of the commerce clause and congressional power. I would also recommend reading some cases on federalism, most notably McCulloch v. Maryland. You should be able to pick a topic fairly easily if you do all of that.

also look into the whole new healthcare debate and whether it falls under the commerce clause or not

Alright, in the 5 minutes that this thread has been up ive gotten a ton of helpful responses so thanks for that everyone, Im gonna keep writing but Ill check back in a little bit if I get caught up again!
